Town of Hertford Special Call Meeting (Zoom) Monday, October 4, 2021 -6:00PM Horace Reid Community Center, 305 W Grubb Street Mayor Pro Tem Hodges announced that the Facebook link was not working. The sister sites more broadly communication problems today, SO we are online on Zoom but Zoom can't connect to Facebook, which is a problem. COUNCIL MEMBERS PRESENT Mayor Earnell Brown Ashley Hodges, Mayor Pro Tem STAFF PRESENT Pamela Hurdle, Town Manager John Leidy, Attorney A quorum was present. Allegiance. Jerry Mimlitsch The invocation was offered by Councilman Mimlitsch followed by the Pledge of Mayor Brown asked Attorney Leidy to give them the rules going forward. Attorney Leidy stated he wanted Council to be clear that if they're going to discuss specific individuals, identify individuals for purposes of considering them for the position ofi interim manager or even permanent manager, and if they're going to talk about the performance of prior managers or interim managers; anything that's going to specifically identify personal information would be confidential and should only be discussed in Closed Session. If Council is going to discuss processes, procedures and the options that are available for research or a way of recruiting an interim manager or permanent manager, those process or procedure questions should all be discussed in Open Session. But it's important to remember that when you're in Open Session, if there is going to be a discussion of confidential personal matters, then that should be withheld until entering Closed Session. This is because the town does not want to disclose any information of employees or prospective employees and doing sO could constitute a violation of the rights of the employee or applicant. Also, it can result in a misdemeanor charge. Attorney Leidy wanted to remind everybody oft the confidentiality requirements. Mayor Brown stated that they will proceed with the interim town manager, and she will give each member of Council time to speak. Town of Hertford Special Call Meeting October 4, 2021 1 Mayor Pro Tem Hodges stated that at the last meeting with Mr. Hartwell, it would be good to give him the green light as soon as possible, to have a common understanding of how responsibilities are handled in intervening time with our current manager while she is on leave and when she does retire, what does the transition look like with an interim, and at the same time just making sure we understand the logistics of how that works. Mayor Pro Tem stated that he assumed it's probably a Closed Session topic and Councilman Mimlitsch state he completely agrees that Mr. Hartwell did a great job explaining when he came last week for the meeting. The Board just has to keep up with the legalities to make sure everything is done properly. Councilman Mimlitsch also Mayor Pro Tem Hodges made the motion to go into Closed Session pursuant to $143- 318.11(a)(6) Personnel and $143-318.11(a)3) Attorney-Client Privilege. The motion was seconded by Councilman Mimlitsch.
