Approval of Resolution R-19-06 to close out Parks & Recreation Maintenance Building No comments were made on the Consent Agenda at this time. Public Hearing to consider Rezoning # 2019-01 a request to rezone PIN#9 9643- 94-9427, owned by Robert Lance from R-2 (residential) to C-2 (commercial)-Eric Planning & Zoning Director Eric Rufa stated that Mr. Lance has a current offer on his property and since he got the negative recommendation from Planning Board he has since gotten a realtor who has been working with him. The potential closing is not until October so whatIa am suggesting to the owner is that we continue the public hearing until September to keep it alive if the property sale falls through sO we don't have to re-advertise. We could move this to the Consent Agenda for next week and Rufa Planning & Zoning Director. Mr. Lance has agreed to this. Item Number 7 is moved up at this time. Consideration of a request from Chris Eller to release a bond for Phase I improvements in Sycamore Cottages and to approve a new reduced bond from Windsor Built Homes to cover the remaining improvement items-Exic Rufa, Planning & Zoning Director Eric Rufa stated when it was approved that they put upal bond to cover remaining infrastructure improvements in Phase Ifor: road surfacing, sidewalks, and street trees. Fast forward a couple of years the bond that was set up to expire in two years and is set to lapse August 29. The original approval had been for one developer and then it subsequently transferred rights to another developer. So basically it has come to release the bond on Phasel Everything that is not done in this phase Iwill be in the new bond. Planning & Zoning Director. Mayor Whiteside asked council do they have any objections to placing this on the Council had no objection to placing this item on the Consent Agenda for next week. Public Hearing on approving development appropriation and an application to the Local Government Commission for a financing agreement-eather Taylor, Town Manager Mark Biberdorf stated that this Public Hearing is a requirement from the Local Government Commission for a financing agreement. The ad that is Consent. Agenda next week. Assistant Town Manager. attached in your packet was advertised on Friday. It authorizes the expenditure of up to $150,000 for this land acquisition. Discussion Followed: Approval of Resolution # R-19-07 supporting an application to the Local Government Commission for approval of a financing agreement-leather Taylor- Assistant Town Manager. Town Manager Mark Biberdorf stated that this Resolution is basically authorizing the appropriation of the funds. Iti is up to 150,000 the purchase price is less but there will be some closing costs. Our arrangement with that piece of land is to put a parking lot down and then finish the land swap. That is why iti is that amount then the rest of the Resolution is authorizing up to 1.8: million in financing for an installment purchase loan. Discussion Followed: Approval ofl low bid for purchase of playground equipment at Bill Moore Community Park-Greg Walker, Parks & Recreation Director. Mayor Rod Whiteside stated that the lowest bid for the playground equipment was $93,669.45 and asked the Town Manager was there anything additional on this item. Town Manager Mark Manager further explained the information in the agenda packet and he stated that Greg Walker will be here to discuss this more in detail next week. Proposed schedule for distribution of recycling carts-Jabbo Pressley, Public Mayor Rod Whiteside asked council if there are any uestons/comments on the Town Manager Mark Biberdorf stated that he asked Jabbo to comment on this at the regular meeting. Discussion Followed: Resolution requesting contingency funding from the General Assembly fora Town Manager. Mark Biberdorf stated that he mentioned this at the last meeting about the request from the residents of The Cove for a flashing light at this intersection. (Hooper's Creek & Wildbriar Road) Idid mention the contingency funding with the General Assembly that may be available to help with this. We have used contingency funding in the past with the flashing light at Rutledge: road. This is going to cost around $40,000. If council approves this then the Resolution goes to road safety project-Mark Biberdorf, Town Manager. Representative McGrady and Senator Edwards. Discussion Followed: Comments from the Town Manager Mark Biberdorf. Ihave provided you with a copy of a flyer here that Ihave put together about our policies for brush collection, recycling collection and Connect CTY for our: residents. Discussion Followed: Greg Walker received an email from a resident in South Chase (Doug Igor) about the pedestrian bridge (on vacant lot that joins) in the recreation area in South Chase. The vacant property next to the area is now being built on and we may get a request to put a pedestrian bridge in place of the other one that may be removed. Ifwe go this route we may need to get something built with railings etc. to avoid any issues. Mayor Rod Whiteside stated that he lives in South Chase and he has used that bridge occasionally and it was not put there by the town to begin with so he is not in favor of us putting anything there to replace the existing bridge should it be removed. Council agrees that the town should not put any type of replacement bridge in due to the possible liability should something happen. On thel Highway 25 Corridor project looking at early October for the extension date. Our engineering firm and the contractor do not think that it is going to take thatlong. DOT has to sign off on this. Things that still need to be done are curb cuts, traffic loop, crosswalks and then the lane narrowing, lights and the monumentation. Discussion Followed: Riverstreet/WGN is working on their efforts with another direct mailing getting to The Fall Litter sweep is in September from the 14th to the 28th in case anyone is Council has decided to wait until spring to do another litter sweep at this time. Summer Day Camp picnic this Friday at noon if anyone is interested in attending. This is an acquisition of properties for our town center. Tonight we have two pieces of property along HWY 25 that we are considering as part of this public hearing. Also we are looking at financing part of this project with an installment purchase contract ofno more than 1.8 million dollars. We have been talking to Representative McGrady about some contingency funding from the General Assembly to get this flasher put in because Powell Bill will not cover it because the intersection involves a DOTroad and a town road. This is just a Resolution will provide support for Representative McGrady to take back to the Councilwoman Sheila Franklin made a motion to approve Resolution R-19-08 to request some funding and it was seconded by Mayor Pro-Tem Eddie Henderson.
