Consent Agenda Tax refunds/releases Mayor Whiteside asked were there any comments on the consent agenda item at the time. Council had no comments at this time on the Consent Agenda. Update on Asheville Regional Airport-Lew Bleiweis, Executive Director. Mayor Whiteside state that Lew Bleiweis will be here with us next week for this Discussion and Approval of Resolution # R-20-04, a resolution affirming support for implementation of a compliant NPDES MS4 Storm water program- Planning & Zoning Director Eric Rufa gave an overview of the recent storm water audit and the notice of violation that the town received. He stated that we would need to contract with an engineer to work on these items tol be within compliance. (These audits are about overall water quality) He stated that he would be working towards having an overall plan in place hopefully by this winter to bring back to council. He asked that this Resolution be moved to consent agenda for approval at presentation. Eric Rufa, Planning & Zoning Director. the: regular meeting next week. Discussion Followed: Council has no objection to: moving this item to the Consent Agenda for approval Approval ofs second agreement and amendment of restrictive covenants on town owned property near Meritor-Mark Biberdorf, Town Manager. next week. Town Manager Mark Biberdorf stated that in your packet you have a copy of a memo thatI Ij prepared along with a second copy of an agreement and restrictive covenants that Meritor prepared. Ibrought this up over a year ago about doing industrial improvement on the property andIhad: received approval from council to revise our agreement with them that was last revised in 2007. Currently the agreement reads that we cannot annex the property until 2029. (The way the laws read right now we cannot annex anyway) Meritor would like it extended out until 2049. To further solidify that we would have to get a bill introduced and passed by the end of the calendar year. Discussion Followed: Amendment to budgetconcerming. modified equipment purchase for solid waste collection services-Jabbo Pressley, Public Works Director. Public Works Director Jabbo Pressley gave a presentation on a request to modify his budget for the FY 20/21. He request is to amend the requested budget item of a 20 ton low boy trailer to a bed mounted lifter system that would mount to any standard 8' pickup bed instead of the trailer. This would be used in the areas of town where the roads are very narrow and it makes it difficult for the trash truck to get in and out of these roads and cull de sacs. He would purchase this item instead of the low boy trailer. Discussion Followed: Comments from the Town Manager Mark Biberdorf. On the town center project nothing new on the RFP process other than the letters of interest that we. have had and are answering questions. We finally closed on the last parcel of land (Bill Walker property) on July 23rd. Public Works has worked really Last month we. had the discussion on the lease with Carolina Truffieres and obviously we are stuck on not wanting to have the option to purchase at the end of the 10 years. Ihad a conversation with Mr. Upchurch and he will be discussing this with his son. I don'tthink that this will go anywhere. Obviously you saw the governor's order to stop alcohol sales after 11:00 pm. The next update from the Governor's office is August 7th maybe something will change and hopefully things are leveling off and the numbers are coming down and we can get into Phase We just about finished Summer Day camp and despite all the restrictions we were Hunter Automotive is consolidating dealerships with Subaru, Hyundai and Volvo and they are: now located next to Broadmoor. This has been a great addition to the town. The shred event and pill drop is scheduled for September 12th from 9:00-noon. III soon. able to still have camp available. Executive Director Lew Bleiweis gave a power point presentation of the current projects going on at the Asheville Regional Airport. He also passed out a hard copy oft the recent annual report for council to: review. Discussion Followed: Approval of second agreement and amendment of restrictive covenants on town owned property near Meritor-Mark Biberdorf, Town Manager. Town Manager Mark Biberdorf stated that he went through the agreement last week with council last week. We have been able to address the issues that are highlighted in yellow in the copy that you have in front of you. This agreement will give you the option for light manutacturing use on the property (HCPED) and still leave the agreement valid for the town to develop if the manufacturing option does not work out. Mr. Cavagnini (plant manager) is comfortable with the document. Discussion Followed: Mayor Whiteside asked do we have a motion on the amendment to this agreement. Mayor Pro-Tem Bob Davy made ai motion to approve the second agreement and the amendment to the Restrictive Covenants and it was seconded by Councilman Preston Blakely. Motion carries all in favor. Public Works Director Jabbo Pressley answered council's questions on the requested amendment to his departmental budget. Mayor Pro Tem Bob Davy asked how much would this lifter system hold and the height of this compared to the lifter system on the actual garbage truck. Public Works Director Jabbo Pressley stated that it will hold 15 to 20 cans of garbage and that this is designed to dump the trash from the pickup truck into the actual garbage truck so that the crew will not be handling any of the garbage. Discussion Followed: Councilwoman Sheila Franklin made a: motion to approve the amendment to the budget for the modified equipment purchase and it was seconded by Councilman Preston Blakely. The Town Center project is moving forward with our RFP process andIc did follow up with one of the two that submitted a letter ofi interest. Iknow that they are working on submitting a full proposal. We are all done with our Hwy 25 land acquisition with July 25 was our last closing on the Kevin Walker property Discussion Followed: There has been no more feedback on our. lease arrangement discussion with Carolina Truffieres. Ireached back out to Brian Upchurch and he pretty much said that not being able to purchase the property at the end of the lease term would keep them from being interested in thé property. They have another piece of land that they were looking at as well. Iimagine that this is going to die. Discussion Followed: COVID-19 update: The governor. had another press briefing last Wednesday, andI am sure that you have heard that that there is a 5 week extension Phase II. The numbers in the state are dropping Ijust don't think that we are where they want to be. The biggest way it affects us: right now is Parks & Recreation events. We have the outdoor movie scheduled at the park and people can watch it in their car and not having to get out of their car. We are charging a fee of 10.00 per car and getting people to register for this. On our family festival we may have to cancel that because a lot of] planning goes intoi it.
