Kathryn Cupp presented information regarding her proposed "The Caring Cupboards" project: The cupboard would contain free non-perishable food and toiletries toi those in need whenever they need it. Ms. Cupp said she would monitor the first six months the cupboard is in place and then responsibility will be turned over to the property owner or designated committee. Action Item: Gary Fankhauser provided information regarding two renderings of options for landscaping for the Veterans Memorial. Commissioner Atkinson stated he would like to see lighting included with the budget for this landscaping project. Thej proposed project would be a thirty (30) foot linear wall at the rear of the memorial. Construction of a two (2): foot tall retaining brick wall will create an area for seating similar to the current downtown bike area. Discussion was held regarding ADA accessibility and other landscaping options. A hybrid drawing will be created that will have two taller trees at each end. This information will be sent to the Town Manager for distribution to the Board. Mr. Fankhauser recommended any landscaping plantings be completed in the fall around mid- 1. Attorney Wolter reviewed the new laws being passed by the State which allows the receipt of written comments which can be taken up to twenty-four (24) hours after we the virtual public hearing is held. Written comments can be accepted from the date the public hearing is posted and will be accepted through August 17th. The public hearing can be closed at the August 6th meeting and the Board can vote on August 20th. Any comments received: after the August 6th meeting will bei read into the record at the. August 20th meeting. Discussion was held regarding the August 6th meeting being held as a virtual meeting. Commissioner Abernathy stated this is a very important meeting and the decision at that hearing will make a significant impact on the town. She stated her personal preference was to have an in-person meeting. Commissioner Rice stated this is a large project and it is important for people to be heard in person. Attorney Wolter stated a hybrid public meeting could be held allowing one person at a time in Town Hall while practicing social distancing. Mayor Cauthen advised that social distancing is not feasible for the size of the Board Room at Town Hall. NCDOT /1 Road Projects in Cramerton. The Town Manager stated he and Commissioner Neeley spoke with Dr. Houchard about the Helix R artwork. Dr. Houchard advised them that the school operations committee has not met since March. Field worki including surveying has been completed fori thel Masonic Lodge parking lot. An appraisal was completed a year ago. No: meetings are being held at the Masonic Lodge currently due to the COVID 19 pandemic. Mayor Pro Tempore Koutsoupias stated the town is getting ready to put up wayfinding signs that will direct people toj park at this parking lot. Mayor Cauthen stated an informal conversation with some of the stakeholders may be needed to expedite the process. Commissioner. Abernathy recommended consideration oft the town going ahead and paving our portion of the parking lot. Commissioner Neeley asked about the grading at Central Park. Mr. Smallwood stated the restrooms are about ninety (90) percent completed and should be finished by the end oft this week. A meeting is scheduled with the trail contractor to begin laying out the trails. The Town of McAdenville Council and: staffisinagreement to move: forward with the Wilkinson Boulevard and Market Street improvements and to contact Senator Harrington. An information meeting was held with both Cramerton and McAdenville representatives to discuss private funding donations for the Cramerton and McAdenville North Connector Greenway. Manager's Report: The Town Manager read an email that was received from a citizen about the great job that public works did. Mayor Pro Tempore Koutsoupias asked about the future of the Parks and Recreation athletic programming. Mr. Smallwood stated the Parks and Recreation Department is reaching out to gather information about what other municipalities are planning regarding their fall sports programs. Commissioner Neeley asked about the procedures that are inj place for people using the pool. Mr. Smallwood stated temperatures are being taken including the staffa and a log is being kept that individuals are being asked the recommended questions from COVID-19 (Coronavirus): The Town Manager stated Phase II of the Governor's order will continue until the first week of August. Town Hall remains closed to the public. The Parks and Recreation Department is open for administrative purposes only. Playgrounds remain closed. A new slide was ordered for the Goat Island playground and needs to be adjusted. Commissioner Abernathy asked about the unevenness of the bridge on the Lakewood side of Goat Island. The trestle belongs to Norfolk Southern and this portion of the Eighth Avenue belongs to the state. The exact boundaries of the Development Areas may be subject to modifications to account for Development/Site Elements (as defined below) and other modifications needed to fulfill the design and development intent of the Rezoning Plan. d. Graphics and Alterations. The schematic depictions of the uses, parking areas, sidewalks, structures and buildings, building elevations, driveways, streets, Development Areas (as defined below), open space areas and other development matters and site elements (collectively the Development/Site Elements") set forth on the Rezoning Plan should be reviewed in conjunction with the provisions of these Development Standards. The layout, locations, sizes and formulations of the Development/Site Elements depicted on the Rezoning Plan are graphic representations of the CHAR2218082v10 38 Development/Site elements proposed. Changes to the Rezoning Plan not anticipated by the Rezoning Since the project has not undergone the design development and construction phases, it isi intended that this Rezoning Plan provide for flexibility in allowing some alterations or modifications from the graphic representations of the Development/Site Elements. Therefore, there may be instances where minor modifications will be allowed without requiring the Administrative Amendment Process per Section 19.10 ofthe Ordinance. These instances would include changes to graphics ifthey are: expressly permitted by the Rezoning Plan (it is understood that if a modification is expressly permitted by the Rezoning Plan it is deemed a minor modification for the purposes of these ii. minor and don'tmaterially change the overall design intent depicted on the Rezoning Plan; or iii. modifications to move structures graphically depicted on the Rezoning Plan closer to adjacent properties in a residential district or abutting residential use but no closer than the "external building line" (in this case the external setbacks, rear yards or buffer areas) indicated on Sheet RZ- The Planning Director will determine if such minor modifications are allowed per this amended process, and if it is determined that the alteration does not meet the criteria described above, the Petitioner shall then follow the Administrative Amendment Process per Section 19.10 of the Ordinance; in each instance, however, subject to the Petitioner's appeal rights set forth in the Plan will be reviewed and approved as allowed by Section 19.10 oft the Ordinance. Development Standards); or 2. Ordinance. e. Number of Buildings Principal and Accessory; Accessory Building Design. Notwithstanding the number of buildings or lots shown on the Rezoning Plan, the total number of principal buildings to be developed: (i) on the portion of the Site designated as Development Area A on the Rezoning Plan and to be developed for detached and/or attached single family residential dwellings, shall not exceed 1,070 principal buildings or residences; (ii) on the portion of the Site designated as Development Area B on the Rezoning Plan and to be developed for retail, commercial, and office use, shall not exceed ten (10) principal buildings; and (i) on the portion of the Site designated as Development Area C and to be developed for business park and/or light industrial use, shall not exceed ten (10) principal buildings; (iv) on the portion of the Site designated as Development Area D and to be developed for municipal service use, shall not exceed three (3) principal buildings. Accessory buildings and structures located on the Site, including, without limitation, the community clubhouse, picnic/gathering pavilions, recreation and related uses, equipment storage structures and the like shall not be considered in any limitation on the number of buildings on the Site. Accessory buildings and structures will be constructed utilizing generally similar building materials, colors, architectural elements and designs as the principal building(s) located within the same Development Area as the accessory structure/bulding. f. Planned/Unified Development. The Site shall be viewed as a planned/unified development plan as to the Development/Site Elements, Development Areas and portions of the Site generally depicted on the Rezoning Plan. As such, side and rear yards, buffers, building height separation standards, public/private street frontage requirements, FAR requirements, and other similar zoning'subdivision standards will not be required internally between improvements and other Development/Site Elements located on the Site. Furthermore, the Petitioner and/or owners of the applicable portion of the Site under development reserve the right to subdivide the portions or all ofthe Site and create lots within the interior of the Site without regard to any such internal separation standards, public/private street frontage requirements and FAR requirements, provided, however, all such separation standards along the exterior boundary of the Site shall be adhered to and all FAR CHAR22180882v10 2 39 requirements will be regulated by any development limitations set forth in Section 3 below as to the Site as a whole and not individual portions, Development Areas or lots located therein. g. Five Year Vested Rights. Pursuant to the provisions of N.C.G.S. Section 160A-385.1, due to the master planned large scale nature of the development, the level of investment, the timing of development and certain infrastructure improvements, economic cycles and market conditions, this Petition includes vesting of the approved Rezoning Plan and conditional zoning districts associated with the Petition for a five (5) year period, but such provisions shall not be deemed a limitation on any Permitted Uses, Development Area Limitations, and Transfer & Conversion Rights: Development Area A may be developed with up to 1,070 single family residential units, of which no more than 275 can be developed as single family attached dwelling units as allowed by right and under prescribed conditions, together with accessory uses as permitted in the R-4 zoning district and in accordance with the design standards set forth in Section 6 below, including, without limitation, community clubhouse, recreation, open space and related uses (e.g. improved passive and active open spaces, /gathering shelters, gazebos, ball fields, maintenance buildings, outdoor recreational uses, and other vested rights whether at common law or otherwise. 2. a. other uses typically associated with residential communities). b. Development Area B: may be developed with up to 80,000 square feet ofretail/commercial uses and 100,000 square feet of office uses as allowed by right and under prescribed conditions, together with accessory uses as permitted in the 0-1/NB and B-3 zoning districts and in accordance with the design standards for commercial uses set forth in the Ordinance. C. Development Area C may be developed with up to 1 million square feet of gross floor area of business park and/or light industrial uses, as allowed by right and under prescribed conditions, together with accessory uses as permitted in the 0-1/NB and I zoning districts. In the event the Catawba Crossing is not developed or is not prioritized on a STIP list prior to December 31, 2040 as set forth in Section 3.II.f below, the uses in Development Area C may converted and developed with up to 350 single-family attached and/or detached units as permitted by right and under prescribed conditions, together with accessory uses as permitted in the R-4 zoning district and subject to Section 6a (below). d. Development Area(s) D1, D2, and D3 may be dedicated and developed as more specifically described below: i. The Petitioner shall dedicate the areas generally depicted in Development Area(s) D, approximately 15 acres, in fee simple and at no land value cost to the Town of Cramerton as development occurs in the adjacent Development Area(s) or upon the request ofThe Town of Cramerton, whichever occurs first. The Petitioner shall submit a plat within 90 days of written request from the Town. In the event the land in Development Area D occurs to prior to development in adjacent Development Areas, the Petitioner reserves the right to grade and access the dedicated areas sO long as it does not interfere with Town's use or development ofDevelopment Area D. ii. Development Areas D1 and D2 may be developed with municipal service uses together with accessory uses as permitted in the 0-1/NB zoning district. ili. Development Area D3 may be developed with municipal service and/or commercial uses together with accessory uses as permitted in the 0-1/NB zoning district. Commercial development levels shall not be deducted from the permitted uses in Development Area B and/or C. Development levels shall be established by the limitations and provisions set forth in the Ordinance. CHAR2218032v10 3 40 e. The cemetery generally depicted on Sheet RZ-2 will be preserved or relocated as permitted. 3. I. Transportation Improvements and Access: Proposed Improvements: The Petitioner plans to provide or cause to be provided on its own or in cooperation with other parties who may implement portions of the improvements, the improvements set forth below in accordance with thej phasing described below: Phase L.A Improvements: a. The following roadway improvements shall be substantially completed prior to the first plats to be released for the Site, and upon substantial completion of such improvements up to 500 residential dwelling units may be developed prior to completion ofa additional improvements: i. Internal Road Improvements Realign Lake Wylie Road to intersect with McCullough Road Construct a roundabout at the intersection of Lake Wylie Road and Public Street A Construct Public Street A from Lake Wylie Road to Armstrong Ford Road Public, Street A may be developed inj phases subject to thej following: When lots andlor commercial areas are being developed between Armstrong Ford Road and Lake Wylie Road, the. section of "Public Street A" between. Armstrong. Ford. Road and Lake Wylie Road. shall be constructed. When lots and/or Development Area C are being developed south ofLake Wylie Road, the section of "Public Street. A"from. Lake Wylie Roadt to Development Area C: shall be constructed. Armstrong Ford Road & Public Street A Signalize the intersection 11. Construct a southbound turn lane with 175' of storage on Armstrong Ford Road Construct a westbound turn lane with 100' ofs storage on Public Street A ii. Lake Wylie Road & South New Hope Road (Hwy 274) Signalize the intersection Construct a northbound turn lane with 250' ofs storage on Lake Wylie Road Construct an eastbound turn lane with 125' ofs storage on South New Hope Road b. Phase 1.B Improvements: The following roadway improvements shall be substantially completed prior to the 501st plats to be released for the Site, and upon substantial completion of such improvements up to an additional 570 residential dwelling units may be developed prior to completion of additional improvements: i. Armstrong Ford Road & South New Hope Road Construct a northbound turn lane with 250' of storage on Armstrong Ford Road CHAR22180882V10 4 41 Construct a westbound turn lane with 100' ofs storage on Public Street A ii. South New Hope Road & Roxie Lane Construct an eastbound turn lane with 100' ofs storage on South New Hope Road iti. South New Hope Road & Armstrong Road Construct a northbound turn lane with 100' ofs storage on Armstrong Road Restripe the center lane on Armstrong Road C. Phase 2.A Improvements: The following roadway improvements shall be substantially completed prior to the issuance of the first certificate of occupancy for the first building associated with the Development Area B1 along South New Hope Road prior to completion of additional improvements: Commercial Site Access A & South New Hope Road Construct a northbound tum lane on Commercial Site Access A Construct and eastbound turn lane with 100' of storage on South New Hope Road. ii. South New Hope Road & Lake Wylie Road Extend the westbound turn lane to a total of325' ofs storage on South New Hope Road ili. Lake Wylie Road and Duck Cove Road Construct a northbound turn lane with 100' of storage on Lake Wylie Road d. Phase 2.B Improvements Full Build Out: The following roadway improvements shall be substantially completed prior to the issuance of the first certificate of occupancy for the first building associated with the Development Area B2 along the realigned Armstrong Ford Road: i. Realigned Armstrong Ford Road & Public Street A Signalize thei intersection Construct and eastbound turn lane with 100' ofs storage on South New Hope Road e, Contribution: The Petitioner shall contribute $25,000 to the Town of Cramerton and/or NCDOT toward additional construction related to transportation improvements in the area. The contribution shall be provided in conjunction with the Phase 2A Improvements or as otherwise mutually agreed to by the Town of Cramerton and/or) NCDOT. II. Standards, Phasing and Other Provisions. CHAR22180882v10 5 42 a. Cramerton Standards. All of the foregoing public roadway improvements will be subject to the standards and criteria of Cramerton and/or NCDOT (as it relates to the roadway improvements within their respective road system authority). It is understood that such improvements may be undertaken by the Petitioner on its own or in conjunction with other development or roadway projects taking place within Cramerton, by way of a private/public partnership effort or other public sector b. Phasing. Phasing of the roadway improvements is set forth in Section I above but can be altered with mutual written consent of the Petition, the Town of Cramerton and as applicable NCDOT project support. on an administrative basis. c. Substantial Completion. Reference to "substantial completion" for certain improvements as set forth in the provisions of Section 4.II above shall mean completion of the roadway improvements in accordance with the standards set forth in Section 4.II.a above provided, however, in the event certain non-essential roadway improvements (as reasonably determined by the Town of Cramerton) are not completed at the time that the Petitioner seeks to obtain a certificate of occupancy for building(s) on the Site in connection with related development phasing described above, then the Town of Cramerton will instruct applicable authorities to allow the issuance of certificates of occupancy for the applicable buildings, and in such event the Petitioner may be asked to post a letter of credit or a bond for any improvements not in place at the time such a certificate of occupancy is issued to secure d. Right-of-way Availability. Iti is understood that some of the public roadway improvements referenced in subsection a. above may not be possible without the acquisition of additional right of way. If after the exercise of diligent good faith efforts over a minimum of a 120 day period, the Petitioner is unable to acquire any land necessary to provide for any such additional right of way upon commercially reasonable terms and at market prices, then the Town of Cramerton may agree to proceed with acquisition ofa any such land. In such event, the Petitioner shall reimburse the applicable agency, department or governmental body for the cost of any such acquisition including compensation paid by the applicable agency, department or governmental body for any such land and the expenses of such proceedings. Furthermore, in the event public roadway improvements referenced in subsection a. above are delayed because of delays in the acquisition of additional right-of-way as contemplated herein and such delay extends beyond the time that the Petitioner seeks to obtain a certificate of occupancy for building(s) on the Site in connection with related development phasing described above, then the Town of Cramerton will instruct applicable authorities to allow the issuance of certificates of occupancy for the applicable buildings; provided, however, Petitioner continues to exercise good faith efforts to complete the applicable road-way improvements; in such event the Petitioner may be asked to post a letter of credit or a bond for any improvements not in place at the time such a certificate of completion oft the applicable improvements. occupancy isi issued to secure completion oft the applicable improvements. e. Alternative Improvements. Changes to the above referenced roadway improvements can be approved through the Administrative Amendment process upon the determination and mutual agreement of Petitioner, and the Planning Director; provided, however, the proposed alternate transportation improvements provide (in the aggregate) comparable transportation network benefits to the improvements identified in this Petition. f. The Petitioner will reserve a one hundred eighty (180) foot wide right-of-way for the proposed In as much as the Catawba Crossing is in the conceptual stage, it is acknowledged that the right of way width) for the Catawba Crossing and the accompanying improvements may be modified to result in "Catawba Crossing" as generally depicted on RZ-01. The right of way. for the Catawba Crossing and any adjustments to its width shall be determined in coordination with the Town of Cramerton and/or NCDOT and in connection with the final design/alignment ofthe Catawba Crossing. Anyreduction or elimination in the right of way width may occur either before or after completion of the building(s) contemplated by the development Petitioner shall provide for dedication of the Catawba Crossing at The Petitioner shall reserve, for the sole benefit of the Town of Cramerton and/or NCDOT and solely for the purpose of the Catawba Crossing, a one hundred eighty (180) foot wide corridor (the "Reserved Corridor") along the south east property boundary as generally depicted on the Rezoning Plan to provide a possible future Catawba Crossing which shall be constructed by and at the cost of others; the request of the Town ofCramerton andlor NCDOT. such reservation shall be subject to the provisions set: forth below: i. The Petitioner may conduct site work, including but not limited to grading and utility work, and install and maintain pavement, driveways, sidewalks, parking areas, landscaping and similar improvements within the Reserved Corridor until such time that the possible future Catawba Crossing connection within the Reserved Corridor is developed by others (but subject to the provisions and time limits set forth below); but in no event shall building footprints be located within the Reserved Corridor. ii. The Reserved Corridor is to be reserved for the sole benefit oft the Town of Cramerton and/or NCDOT and solely for installation of the Catawba Crossing therein for a period of thirty-five (35)years from the approval oft the Rezoning, and (x) upon the passage of such 35 year period, (y) the earlier issuance by the Town of Cramerton and/or NCDOT written notice that the Catawba Crossing will not be installed, or (Z) the Catawba Crossing is not prioritized on a STIP list prior to December 31, 2040, such Reserved Corridor shall automatically be withdrawn and Petitioner may use the Reserve Corridor for any purpose and use allowed by the provisions set forth above. ili. The Petitioner shall not bear any costs or expenses associated with the construction of the proposed Catawba Crossing within the Reserved Corridor or any other implications derived therefrom, and the related construction shall not interfere in any material respect with the operations and activities taking place on the Site, including without limitation parking, access, facilities operations, and the like. Further, all development, processes, permits, and land preparation, including but not limited to the removal of any Development/Site Elements located within the Reserved Corridor, shall be the responsibility oft the Town of Cramerton and/or NCDOT. iv. Development associated with the Catawba Crossing within the Reserved Corridor will not result or cause the Site, its uses, any Development/Site Elements located or future buildings on the Site to become non-compliant or non-conforming with the Ordinance, the Rezoning Plan or any other applicable regulations or laws, and to ensure such compliant status the Town of Cramerton alone would be required, to the extent needed, to secure variances and/or other alternative compliance measures without cost or expense to Petitioner, its successors and assigns, and otherwise in accordance with the provisions of this Section. V. NCDOT. The Petitioner shall dedicate the Reserved Corridor in fee simple and at no land value cost to the Town of Cramerton and/or NCDOT upon the request of The Town of Cramerton and/or vi. In the event that Development Area C is developed with residential uses, the Petitioner shall be able to cross the reserved corridor to provide access through an established right of way. The Petitioner will reserve the right-of-way for the proposed "Armstrong Ford Road In as much as the Armstrong Ford Road Realignment is in the conceptual stage, it is acknowledged that the right of way width for the Armstrong Ford Road Realigmment and the accompanying improvements may be modified to result in a reduced or eliminated right of way width. The right of way.for the Armstrong Ford Realignment and any adjustments to its width shall be determined in coordination with the Town of Cramerton andlor NCDOT and in connection with the final designaligmment of the Armstrong Ford Road. Realignment. Any reduction or elimination in the right of way width may occur either before or afer completion of the building(s) contemplated by the development. Petitioner shall provide for dedication of the Armstrong Ford Road Realignment at the The Petitioner shall reserve, for the sole benefit of the Town of Cramerton and/or NCDOT and solely for the purpose of the Armstrong Ford Road Realignment, a corridor (the "Armstrong Reserved Corridor") along the north property boundary as generally depicted on the Rezoning Plan to provide for the possible Armstrong Ford Road Realignment which shall be constructed by and at the cost of Realignment" as generally depicted on. The Petitioner may conduct site work, including but not limited to grading and utility work, and install and maintain pavement, driveways, sidewalks, parking areas, landscaping and similar improvements within the Armstrong Reserved Corridor until such time that the possible future Armstrong Ford Road is developed by others (but subject to the provisions and time limits set forth below); but in no event shall building footprints be located within the Armstrong Reserved Corridor. ii. The Armstrong Reserved Corridor is to be reserved for the sole benefit of the Town of Cramerton and/or NCDOT and solely for installation of the Armstrong Ford Road Realignment therein for aj period oft thirty (30) years from the approval ofthe Rezoning, and (a) upon the passage ofs such 30 year period, or (b) the earlier issuance by the Town of Cramerton and/or NDCOT written notice that the Armstrong Ford Road Realignment will not be installed, such Armstrong Reserved Corridor shall automatically be withdrawn and Petitioner may use the Armstrong Reserve Corridor for any purpose and use allowed by the provisions set forth above. ii. The Petitioner shall not bear any costs or expenses associated with the construction of the proposed Armstrong Ford Road Realignment or any other implications derived therefrom, and the related construction shall not interfere in any material respect with the operations and activities taking place on the Site, including without limitation parking, access, facilities operations, and the like. Further, all development, processes, permits, and land preparation, including but not limited to the removal of any Development/Site Elements located within the Armstrong Reserved Corridor, shall be the responsibility of the Town ofCramerton and/or NCDOT. iv. Development associated with the Armstrong Ford Road Realignment will not result or cause the Site, its uses, any Development/Site Elements located or future buildings on the Site to become non-compliant or non-conforming with the Ordinance, the Rezoning Plan or any other applicable regulations or laws, and to ensure such compliant status the Town of Cramerton alone would be required, to the extent needed, to secure variances and/or other alternative compliance measures without cost or expense to Petitioner, its suçcessors and assigns, and otherwise in accordance with the provisions oft this Section. CHAR2218082v10 8 45 V. and/or NCDOT. The Petitioner shall dedicate the Armstrong Reserved Corridor in fee simple and at no land value cost to the Town of Cramerton and/or NCDOT upon the request ofThe Town of Cramerton III. Access, and Pedestrian Circulation. a. Access to the Site will be from Armstrong Ford Road and South New Hope Road as well as other public street extensions and connections made from the Site and into the Site from adjoining b. The number and location of access points to the internal public streets will be determined during the building permit process and thereafter additional or fewer driveways and/or additional private/public streets may be installed or removed with approval from appropriate governmental properties as generally depicted on Sheet RZ-01. authorities subject to applicable statutes, ordinances and regulations. C. The alignment of the internal vehicular circulation and driveways may be modified by the Petitioner to accommodate changes in traffic patterns, parking layouts and any adjustments required for approval by the Town of Cramerton in accordance with published standards. 4. Design Intent Statement: a. The Petitioner proposes to develop a walkable residential community where the residents oft the community will have convenient and easy access to a series of passive and active open spaces that are interconnected by a network of streets, sidewalks, and trails. The emphasis of the design will be to provide alternative modes of transportation to the residents oft the community which will allow them to access the community's amenity areas as well as the proposed Carolina Thread Trail located along the Site's [eastern property line] as generally depicted on Sheet RZ-01. 5. a. Residential Architectural Standards: Architectural Materials. The principal buildings constructed on the Site (Development Areas A,B, Cand D) may use a variety of building materials. The building materials used for buildings (other than structured parking facilities, if any) will be a combination of the following: glass, brick, stone, simulated stone, pre-cast stone, precast concrete, synthetic stone, stucco, cementatious siding (such as hardy-plank), EIFS or wood. Vinyl as a building material will not be allowed except on b. Architectural Variation. Every lot shall provide a different architectural model from the lot(s) adjacent to it. No two identical architectural elevations which include identical facades, roof lines, door and window placement and details, shall be built on lots adjacent to or directly across from each other windows and soffits. with the exception of townhomes. Garage doors visible from the public or private streets shall be staggered and protrude no more than five (5) feet from the front of the front facing façade oft the building unless a front porch is used in which case the garage shall not extend further than five (5) feet from the front of the porch excluding side loading garages. h. is employed. i. enclosed. j. k. The location, size, and type of storm water management systems depicted on the Rezoning Plan are subject to review and approval as part of the full development plan submittal and are not implicitly approved from and engineering perspective with this rezoning. It is acknowledged that given the large master planned nature and long timeline of development for the Site, changes in the various civic services/community uses described in subsections 9. b., C., and d. above, may take place over time or commitments regarding the same may be met on property beyond the Site or by parties other than Petitioner, or assigns, with the approvals of the applicable governmental authorities authorized for such services/community uses. In such event, the Petitioner, or assigns, with the written approval by the applicable governmental authorities, may request an administrative amendment to the Rezoning Petition to address the changes associated with the civic services/community uses in Petitioner or assigns. e. question. 10.
