November 23, 2021 VIRTUAL WORK SESSION MEETING TOWN OF DAVIDSON BOARD OF COMMISSIONERS The Town of Davidson Board of Commissioners held a virtual meeting on Tuesday, November 23, 2021, via Zoom due tot the COVID-19 global pandemic. Present were Mayor Rusty Knox and Commissioners Jane Campbell, Matthew Fort, Jim Fuller, Autumn Rierson Michael, and David Sitton. Town Manager Jamie. Justice, Assistant Town Manager Austin Nantz, Town Attorney Mary Ann Swan and' Town Clerk Betsy! Shores were also present. CALLTOORDER Mayor Knox called the meeting to order at 6:00 p.m. Mayor Knox did a roll call to confirm that all board members were present. ANNOUNCEMENTS & PROCLAMATION Communications Director Amanda Preston announced Town of Davidson Offices are closed Thursday, November 25 and Friday, November 26 in observance oft the Thanksgiving Holiday. Garbage and recycling collection will take place on Friday, November 261 for those whose regular pick-up dayi is Thursday. Town offices will reopen on Monday, November 29 at 8:00a a.m. for regular business hours. There'sstill time to participate in the Davidson Police Department's annual Angel Tree Program. This tradition of supporting the community spans more than twenty years. The program has historically provided toys and clothing for children in need but expanded in recent years to include providing elder Those interested in participating, either by becoming a sponsor or by making a monetary donation, are asked to contact the Davidson Police Department: at 704-892-5131 during normal business hours. Christmas in Davidson willl be held on Thursday, December 2 through Saturday, December 41 from 6:00 p.m. -9 9:00 p.m. nightly. All activities will be held outside. We encourage all attendees to observe COVID- 19 protocols. Main Street will be closed from Concord Road to. Jackson Street to allow for pedestrians to The 39th Annual North Mecklenburg Holiday Parade returns on Saturday, December 4 at 1:00 p.m. The Parade begins on the corner of Griffith and Main Streets in Davidson and proceeds south on Main Street New this year will be al Merry Main Street Tricycle Race that will take place after the parade at 3:00 p.m. on Saturday, December 4. The racet features four-person trike teams sponsored by Davidson businesses and disabled residents in need with gifts of grocery and gas gift cards. spread out and enjoy the holiday fun. Mayor Knox read a proclamation Honoring the Davidson Wildcat Football Team as they make their second NCAA Football Championship Subdivision appearance in 2021. The Wildcats will travel to Kennesaw State University to play the Owls ini thet first round oft the FCS Playoffs on Saturday, November 27. CHANGESTOTHE AGENDA There were no changes to the agenda. DISCUSSION (a) Housing & Equity Director Eugene Bradley provided an update on Davidson Housing Coalitions the Bungalows. At the November 9 meeting during the Public Comment section, there were several comments regarding the conditions at The Bungalow apartment complex. Staff have been working with Mecklenburg County Code Enforcement to have the 32 units at The Bungalows inspected for minimum housing code violations. Eugene provided an update on the progress at the Bungalows and discussed next steps moving forward. Ina addition to the minimum housing code enforcement process, staff will continue to work with the partner agencies on the maintenance issues and report back to the board. (b) Housing and Equity Director Eugene Bradley provided an update on thet town's work on al Non- Discrimination Policy. Based on the board'sfeedback, local businesses, the Housing and Equity advisory board, and the community at-large, the Housing and Equity board made a recommendation to the board ofcommissioners to approve the final draft of the ordinance prohibiting discrimination in public accommodations. Commissioner Fort made a motion to adopt version 2 of Ordinance. 2021-08 Prohibiting Discrimination in Public Accommodations. subject to appropriate compliance mechanisms. The motion passed unanimously! (5-0). (c)P Project Manager Doug Wright presented an update on the Potts-Sloan-Beaty right-of-way sale. The Potts-Sloan-Beaty Corridor project is being managed by the NCDOT andi is funded by Bonus Allocation (BA) Funds. The project has been designed and is int the right-of-way acquisition phase. The NCDOT needs to acquire right-of-way from the town to construct the project. There are acquisitions from 8 town-owned parcels, totaling $462,925. All parcels have been appraised. Per previous agreement with NCDOT in conjunction withi the State Historic Preservation Office (SHPO), these revenues are to be used to offset project costs borne by the town, for the purchase and relocation of the historic house located at 335 Sloan Street. This item was previously discussed at the November 9 meeting. Al budget amendment will be placed on at future board consent agenda once the relocation cost is finalized. Commissioner Fort made a motion to approve Resolution. 2021-26 and authorize the Town Manager to execute agreements, for the sale of right-ofway to the NCDOT for the Potts-Sloan- Beaty Corridor. Staffi is directed to provide the board with al budget amendment to allocate the proceeds of the agreement as follows: relocation of the house at. 335 Sloan. Street F Reimburse the Affordable Housing fund for costs related to the purchase and A Retain the remainder of the funds in the Potts Sloan Beaty Capital Projects Fund for use in the project corridor for additional project costs including, but not limited to, pedestrian safety and landscaping needs. The motion passed unanimously (5-0). (d) Project Manager Doug Wright presented an update on the proposed Pedestrian Hybrid Crossing Beacon at the East Rocky River Road greenway crossing. The project has been designed andi is under review withi the NCDOT. We anticipate review will be completed by the end oft the year, and that we will receive bids for project in mid-January 2022. The Engineer's Estimate of Probable Cost for the project, including contingency, is $125,000. The Town has $89,000 available in in bond funds and are requesting an additional $36,000 to cover the project cost. Commissioner Fort made a motion to approve Resolution 2021-27a and Budget Amendment 2022-07 East Rocky River Road Greenway Crossing HAWK: Signal. The motion passed unanimously (5-0). (e) The Town of Davidson has five citizen advisory boards: Affordable Housing & Equity Board, Design Review Board/Historic Preservation Commission, Livability Board, Planning Board, and Public Art Commission. Appointments are made by December to fill the expiring terms. Each year, the town advertises for citizens to apply to serve on these advisory boards. Ai nominating committee consisting of the mayor, two commissioners, the manager, the chairs of the advisory boards, and the staff liaisons to the advisory boards reviews the applications and determines who to recommend for appointment. The board of commissioners receives the nominations and makes the final decision on appointments. This item was discussed at the November 9 meeting. Commissioner Fuller made a motion to approve the. 2022 recommendations for advisory board appointments and reappointment of Brian Bumann as Chair of the Design Review Board/Historic Preservation Commission and appointment of Shawn Copeland as Chair of the Planning Board. The motion passed unanimously (5-0). (f) The board of commissioners reviews the Town Manager's Employment Contract and considers amendments upon renewal. The only amendment to the agreement was a salaryi increase of 6.5% to his base salary effective. July 1, 2021 - June 30, 2022. Commissioner Fuller made a motion to approve the amendment to the Town Manager's Employment Agreement effective. July 1, 2021- June. 30, 2022. The motion passed (4-1) with Commissioners Campbell, Fort, Fuller, and Rierson Michael voting yes and Commissioner. Sitton voting no, (g) The Town Attorney has successfully completed the 6-month probationary period as per the employment agreement. The board of commissioners reviews the Town Attorney's Employment Contract and considers amendments upon renewal. The only amendment to the agreement was as salary increase of 5%1 to her base salary effective October 1, 2021 - June 30, 2022. Commissioner Campbell made a motion to approve the amendment to the Town Attorney's Employment. Agreement effective October. 1, 2021 - June 30, 2022. The motion passed (h) Police Chief Penny Dunn and Town Attorney Mary Ann Swan provided an overview anda recommendation that Davidson ordinances should be amended to provide for civil penalties and to remove all criminal penalties. A new law requires that local governments remove the current unanimously! (5-0). presumption that alll local ordinances may be enforced criminally. The law goes into effect December1, 2021. The board will consider approval oft the amended ordinances on the consent agenda at the (i) The board of commissioners have discussed various growth management tools that include improvements to the development process and toi implement the comprehensive plan'srecommended utility service and annexation criteria (USAC) tool. The board discussed Commissioner Sitton's interest in December7meeting. reviewing a growth management tool called urban growth boundary. Commissioner. Sitton made a motion to adopt the historical Urban. Services Boundary at East Rocky River Road. The motion, failed (1-4) with Commissioner Sitton voting yes and Commissioners Campbell, Fort, Fuller, and Rierson Michael voting no. () Town Manager. Justice and the board reviewed items for the December 7 regular meeting and the December 14 ceremonial meeting.
