The "rolling" flooding amount has been increased from $15,000.00 to $25,000.00. The Planning and Zoning Department is requesting $25,000.00 to update the Cramerton Ordinance and Zoning Coding. The The Finance Director stated that the company who services the generator at Town Hall offers a 24/7 monitoring software. The initial setup cost would be $5,800.00 and then an annual Board of Elections estimate for the next election is $7,500.00. maintenance fee of$600.00. Adams provided information to the Board regarding the effect of the MT Land Project and the need. for additional officers and an increase of salaries to maintain retention. Chief Adams stated a salary analysis was completed using local municipalities. The police department currently has sixteen(I6)ful-time sworn officers and three (3)part-time: reserve officers. Chief Adams asked that one (1) full-time officer be added to his staff along with an additional vehicle. The Board consented to this request. Chief Adams stated that the lanes have been redone with new targets and Gaston College has been able to provide all training dates that have been requested. Body cameras are serviced by Verizon and currently there are only (6) cameras. Chief Adams stated he Firel Department: ChiefFoulk stated the fire department is attempting to have full 24/7 coverage. The department currently has one (1) full twenty-four (24) hour day. A second full day will begin on. July 1Sand ai third full day on January 1, 2022. The department is comprised of one (1) chief, one (1) assistant fire chief, three (3) captains, and twelve (12) part-time members. All members except for three (3) are. EMT's. Discussion was. held about the purchase of a ladder truck. A new truck takes about a year to build. The current ladder truck is a 1987. Truckers older than 1991 lack many of the significant safety enhancements. A new truck would service the Town for approximately twenty-five (25) years. The estimated build time for a truck would be 350 days. The fire department will be receiving its ISO: rating next week. The fire department currently has an ISO rating oft three (3). The Board asked that several finançing options be provided for their Public Works: A request is being made for an additional staff member. The prison inmate program has been uncertain due tot the pandemic. Anew. dump truck is needed to replace the 1987 truck along with a dump site tol be used forj placement ofleafcollection. Commissioner Abernathy asked ifa salary analysis was needed for the Public Works Director. The. Town Manager advised that the director's salary is competitive and this will be considered in future budget cycles as the Town'sp population grows. Engineering in-house would: include code updates and additional legal counsel. Mayor Cauthen asked about when stormwater fees are set up to be collected. The Planning Director stated when the water meter is plaçed by Two Rivers Utilities then the stormwater fee Parks and Recreation:, Ai request was made this year foramini skid steer. Mr. Smallwood stated there were three (3) flood évents this past fiscal year. Commissioner Helms asked about possible sharing the expense. of maintaining the parks with other municipalities. Volunteers from the Carolina' Thread Trail might be able to assist and the Gaston County Travel and Tourism might be able to be involved. The lawn serviçe contract is out for bid and only two (2) responses were received. The bid was put out for another two (2) weeks for possible additional bidders. The contract would. bei for three (3)years with a one (1)year option at the end. The contract allows the bidder to bid either on the Public Works and/or Parks and Recreation Department's items as separate or combined. A request was made for hanging baskets that would be placed on the downtown decorativé poles. There are: fourteen (14) decorative poles. The cost would be $42.50 for at twice a year service. New flooring and lighting are being requested for gym. The Parks and Recreation Director stated thére is a moisture mitigation issue upstairs and he is working with Talley and Smith. Heavy rains cause moisture to enter the building through the door and the floor tiles are peeling up. Commissioner Abernathy asked about the $8,500.00 listed on the line item for hanging baskets. Mr. Smallwood said the total amount of $8,500.00 includes the hanging baskets, the plantings for the Stuart W. Cramer High School roundabout, and Centennial Center planters. The Finance Director stated that the fuel charge adjustment is a variable and there is no set cost per gallon at this point. Commissioner Atkinson asked accent lighting for the Veterans Memorial and Town Hall. Commissioner Abernathy asked if the hanging baskets would belong consideration. Action Item: Consider approval of. additional funding allocation for further build out of the Rocky Branch Park Trail, per the Cramerton Parks & Recreation Master Plan. The Town Manager stated staff is requesting the Board of Commissioners to realloçate operating funds from the fiscal year 2020-2021 budget to à capital project from, the full build out ofthe Rocky Branch Park Trail. This build out would include the main trail, the single-track mountain bike trail with enhanced features, the trailhead kiosks, and the trailhead monument (a 5 to, 7 foot boulder cairn): The Tarheel Trailblazers are still committed to reimbursing the Town for fifty (50) percent of the original project, request which is $25,000.00 and have agreed to perform all general maintenance on the park and. trails. Mayor Pro Tempore Koutsoupias asked about thei trailhead at the GEMS station. David Baker, 2219 Lexington Street, advised that the orange trail: which is the main trail is complete. The trail ends in Belmont at: Woodrow Avenue. Commissioner Helms stated he spoke with Çity ofBelmont's Manager Adrian Miller and this is a great investment and is terrific for both communities. The total cost for the park is $137,000,00 The Town Manager stated $50,000.00 has already been alloçated and: Tarheel Trailblazers are still committed to $25,000.00 to reimburse the Town. Commissioner Abernathy stated this trail will encourage people to: explore and provide connectivity to walk to Belmont. Assistance for trail maintenance will be provided by the Tarheel Trailblazers. A motion was made by Commissioner. Abernathy to approve additional funding allocation for further build out ofthe Rocky Branch Park Trail, per the Cramerton Parks and Recreation Master Plan. Unopened Unnamed Alley Closure Request 1. Resolution #2021-10: A resolution to close an unopened alley Right-of-Way, which was never assigned a name and is located off of Tenth Street in Cramerton (adjacent to C.B. Huss Complex Park). This is a paved stub out located off of Tenth Street and Willow Street. The Board asked if the Town would have to remove the asphalt area, The Planning Director stated this asphalt area is part of the 1947 plat and the Town does not have to remove it. This resolution will also set a public hearing on this request for Thursday, June 3rd, Town ofo Cramerton- May2 20, 2021 Page6 14 2021 at 6:00 p.m. Mayor Pro Tempore Koutsoupias made a motion to approve Resolution #2021-10 to close an unopened alley right-of-way that is located off of Tenth Street adjacent to the C.B. Huss Complex Park. The motion was seconded by Commissioner Neeley. The vote was 41 to Oin favor. 2. Cramerton's 2022 Stormwater NC Audit preparation. ii. Stormwater a. Action Item: Consider approval of stormwater funding to address recommended stormwater "gap areas" and tasks be performed and administered by HDR Engineering Group. Per BOC direction, this item isb being brought back from the April 15, 2021 meeting. The HDR Engineering Group has been assisting the Town with stormwater tasks. At the April 15thn meeting a proposal for $95,220.00 from HDR was presented to the Board to assist the Town in bringing the Town's program closer to compliance in anticipation of the stormwater audit. Following Board discussion at that meeting staff was asked to révisit and see if there were any elements of the order that çould be performed by in-house staff. Items removed from the original proposal included CSR/PCSM Coordination; Training and Materials Development; and Town Coordination and Support. The new proposed proposal cost. is $58,650.00 which created a thirty-eight (38) percent reduction from the previous quote. Staff requested approval of the revised amount in order for preparation to begin for the upcoming stormwater audit to oçcur sometime in 2022. Commissioner Helms asked if all municipalities are going through this audit process and what are the penalties ift the Town fails. The Planning Diréctor said not all municipalities will be audited in 2022. The City of Gastonia is finishing up their audit. The Planning Diréctor stated there are multiple levels of non-compliance which include notices" of deficiencies and notices of violations. A notice of deficiency. allows the Town an opportunity to correct or make repairs règarding any deficiencies: If the Town receives a notice of violation, then NCDEQ will follow up if répairs have been made and the Town could be fined. At this time most municipalities are receiving notices of deficiencies. Commissioner Helms asked if the City of Gastonia utilized a firm such as HDR Enginéering to assist with their gap analysis. The Planning Director stated that due to the number of staff the City of Gastonia has they possibly did not need to hire an outside firm. The City ofLowell is using an outside firm as they, were recently audited and needed assistance in setting up their program. The Planning Director stated that once you have the audit timeline you usually have 901 to 120 days to address any issues. Commissioner Helms asked about the fees for notices of violation. The Planning Director stated the NCDEQ fine is $25,000.00 daily and there are additional fines from the EPA that occur simultaneously. Commissioner Abernathy asked about the audit checklist and if the gap areas have already been identified. The Planning Director stated yes. Commissioner Abernathy stated she was trying to understand the audit checklist. The Planning Director advised that NCDEQ will audit the Town's stormwater program. Some ofthe stormwater program has been delegated to Gaston County and some items remain incomplete. To Town of Cramerton- May 20, 2021 Page7 15 prepare: fort the audit, HDR Engineering Group willl help the' Town prepare for the audit. Staff is currently working on some audit items. Commissioner Abernathy asked if staff had always known about this audit. The Planning Director stated municipalities were aware but most had not taken it seriously as it was not being enforced by NCDEQ. The NCDEQ had to rebuild their program after it was found to be failing and out of compliance. Mayor Cauthen stated he attended a stormwater seminar and it was stated that NCDEQ had not been promoting or enforcing the stormwater program. The EPA is enforcing the stormwater regulations and NCDEQ has had to develop a program. The timeline given was 2-1/2 years to respond. The Planning Director stated no one was prepared and: many municipalities lacked the revenue. Many municipalities had to begin collecting stormwater fees. The fees collected are not only used for underground infrastructure but also educational outreach. The Town increased stormwater fees in response tot the NCDEQ request. The Planning Director stated that some: municipalities that have a stormwater program inj place still received notices of deficiencies. If the Town repairs all the deficiencies per the gap analysis, then we will have a fully operating program with éducation and be better prépared for the next audit ini five (5)years. Mayor Pro Tempore Koutsoupias asked whati ifat town cannot handle this fiscally. The Planning Director stated municipalities will be given an opportunity to show that an effort is being made. Commissioner Neeley asked ifthis àspect oft the stormwater program would affect possible future. grant funding: The Planning Director said yes as this program is part of. the, federal government. This. could affect the Brownfields Grant as itis environmentally based. Commissioner Abernathy asked about the subtasks andifthe Town was aware that by collecting stormwater fees that we: needed tol have educational outreach, The Planning Director stated yes and the Town has been working on this. The Çarolina Thread Trail Days was part of the Town's educâtional outreach. Staff borrowed the City of Belmont's watershed model to provide demonstrations along with documenting the number. of attendees and providing goodie bags. Regional Stormwater Partnership. is assisting the Town as part of the educational elements. Commissioner Abernathy commented that the Town is going toj pay someone else to do these types of activities. No action was taken by the Board. 3. Action Item: Consider developer (Wilcox Homes, LLC) request to waive: fee in lieu ofs sidewalks. Mayor Cauthen asked to be recused. The Board consented. Mayor Pro Tempore Koutsoupias asked stafftoprovide information on this topic. The Planning Director stated Jeremy Wilcox spoke to the Board of Commissioners about a year ago about sidewalks along the front of Standpipe Hill. The sidewalks along the frontage ofthe property were not going to be beneficial and there were issues with the ditch sections as there is no curb or guttering in this neighborhood. The Board voted in May of2020 to allow Jeremy Wilcox to avoid installing sidewalk along Standpipe Hill as part of the Riverside infill residential development. Staff requested an engineer's estimate sO the Town's iii. Riverside Development (on Standpipe Hill) Town of Cramerton- May 20, 2021- Page8 16 engineer could review and approve the amount. Once approved, the developer could then pay the estimated cost and fulfill the sidewalk requirement via fee in lieu payment. To date the developer has not provided an engineering estimate forreview. The Planning Director said removal ofthe sidewalk along with removal ofthe feei in lieud ofas sidewalk may require an amendment to the conditional zoning. Mayor Pro Tempore Koutsoupias asked why an estimate was not received on the sidewalk. The Planning Director stated the developer was provided an estimate from another engineer to use for informational purposes. A conditional rezoning would require a public involvement meeting, Planning Board recommendations, and a public hearing before the Board. Commissioner Helms stated he did not want to waive the fee and possibly use the fee in lieu of monies for a neighborhood pocket park. Commissioner Abernathy stated she was not in favor of waiving the fee. The Board asked that staff spéak to the developer about possible options. Mayor Cauthen returned tot the meeting. iv. Cramerton 2021 Road Maintenance Project Public Works 1. Loan Finançing 2. Action Item: Discussion and reaffirmation of financing rate amount and terms for the road maintenance project. Three (3) bids were received.: Discussion was held about the use of a new fiberglass polymer paving process that] NCDOTis using. Mayor Pro Tempore Koutsoupias asked- about the roads to be paved in the Timberlake neighborhood. The Town Manager said all Timberlake streets would be paved with the exception of Southfork Lane as it was payed during the last paving project. Mayor Pro Tempore Koutsoupias asked about paving of the downtown parking lot and slowing traffic down on Cimarron Boulevard. The proposed paving project in the Timberlake neighborhood does not include striping for Cimarron Boulevard. Commissioner Abernathy asked about the proposed. newer paving technique and what type of research has been completed. This paving product has been used for the last five (5): years by NCDOT and is considered to be a very good product. A motion was made by Commissioner Neeley to reaffirm the financing rate for seven (7)years with' Truist Bank for $1.44 million. The motion was seconded by Commissioner Abernathy. The vote 3. Commissioner Abernathy asked that the wording be changed to Centennial Center parking improvements instead of Masonic Lodge parking lot. The Masonic Lodge parking lot continues tol be roped off and people are parkingi inj private areas. Commissioner Neeley stated the parking lot is in poor shape and could the building be taken down. Mayor Cauthen stated no. Commissioner Helms stated the safety concerns need to bé addressed while due diligence is occurring. The Town Manager stated Central Park improvements are almost complete and the park looks great. The Town Manager stated the. Town's grant application will not be funded during this Brownfields Grant cycle. A debriefing has been requested with the EPA staff on how Manager's Report: Per the governor's orders municipality facilities are beginning to open up with lessened mask restrictions. She said she was recently riding her bike and when she came down Eighth Avenue when she went to turn onto the Goat Island Bridge she had had to do a hard 180: turn.. She asked about a possible ramp for bikes and wheelchairs SO they do not have to maneuver around the end: of the bridge. The subdivider shall obtain a performance bond from a surety bonding company satisfactory to the Town, as applicable. A surety bonding company must at minimum be: (I) registered to do business with the North Carolina Secretary of State; (2) licensed to issue surety bonds in the State ofl North Carolina by the North Carolina Department of Insurance; (3) rated at least "B+" by a reputable bond rating agency; and (4) possess a minimum of $50,000,000.00 in assets. The Town Board may, within its sole discretion, insist upon alternative standards based upon the particular project, the estimated cost of completion of the improvements, and/or other factors indicating higher standards are warranted. The bond(s) must contain the following provisions: (I) the bond(s) shall remain in effect until such time as all improvements are installed and approved by the Town; (2) the surety bonding company, within 15 days of the Town providing notice of default, shall take over and complete all improvements or pay the Town in cash the estimated costs of installing the improvements as determined by the Town's planner or engineer; and (3) the Town shall be able to draw upon the bond(s) in the event that the subdivider defaults upon its agreement with the Town in accordance with subsection (3). The Town Board may, within its sole discretion, insist upon alternative standards based upon the particular project, the estimated cost of completion of the improvements, and/or other factors indicating higher standards are warranted. The letter(s) of credit must contain the following provisions: (I) the letter(s) of credit shall be evergreen and shall not be subject to expiration until such time as all improvements are installed and approved by the Town Board, and shall require the issuing commercial bank to give at least 60 days' notice of its intent to terminate the letter(s) of credit, upon which the Town can draw upon the letter(s) of credit; (2) the Town shall be able to draw upon the letter(s) of credit at any time on or before its expiration; (3) the commercial bank shall, upon written notification by the Town Board that the subdivider is in default, immediately pay to the Town the full amount, or any lesser amount of the letter(s) of credit, ifr requested by the Town Board; (4) the Town shall be able to draw upon the letter(s) of credit in the event that the subdivider defaults upon its agreement with the Town in accordance with subsection (2) of this section; and (5) the letter(s) of credit shall allow for presentment and collection at a verification shall be borne entirely by the subdivider. location within a 30-mile radius ofthe Town. 15-17 33 4. Upon payment, the Town shall expend said funds to complete all or any portion ofthe required improvements as it deems necessary. For purposes ofthis section, default shall constitute any oft the following: (1) failure on the part oft the subdivider to complete, within the time period specified in the agreement in subsection (G) oft this section, the required improvements as specified on the approved preliminary plat for that portion oft the subdivision to be shown on the final plat; (2) failure on the part ofthe subdivider to install any improvement in accordance with the specifications or the regulations in the Town's ordinances; or (3) transfer of ownership ofa any portion oft the property or lots located within the subdivision to another person or entity under no legal obligation to install the required improvements (e.g., foreclosure). Ifone of the above events occurs, nothing herein shall preyent the Town from declaring default prior to the expiration oft the time period specified in subsection 4(c) of 10. Release of guarantee surety. In its sole discretion, the Town Board may release a portion of any security posted as the improvements are completed and recommended for approval by the Town Planner, sO long as the Town maintains the posted security in an amount equal to at least 1.25 times the estimated costs of installation of the remaining improvements. However, notwithstanding the above, nothing shall require the Town Board to release any portion ofs security posted until such time as all improvements are installed and approved by the Town Board. Within 30 days after receiving the Town Planner's recommendation, the Town Board shall approve or not approve said improvements. Once all required improvements on the preliminary plat for that portion of the subdivision to be shown on the final plat have been installed and approved, then all security posted for said improvements shall be released by the Town Board. b. All subdivision construction, whether or not guaranteed by a surety bond or irrevocable letter of credit or other approved form of security, shall be inspected at all phases by the town engineer or his designated representative. Section 15.34 Variations to the terms of this Chapter a. The Town Board shall have the authority to vary the terms of this Chapter as it applies to the subdivision requirements on a case-by case basis after having first held a public hearing and having found in the affirmative each of the following 1. There are special circumstances or conditions affecting said property such that the strict application of the provisions of this chapter would deprive the 2. The modification is necessary for the preservation of a substantial property 3. Section 15.35 Notice of New Subdivision Fees and Fee Increases; public comment a. Section 19.7, Action By Board of Commissioners Conditional zoning decisions are a legislative process subject to. judicial review using the same procedures and standard of review as apply to general use district zoning decisions. Once the public hearing has been held, the Board of Commissioners shall take action on the petition. The public hearing, once opened, can be continued to a later date and action taken at that time. The board shall have the authority to: 1.3 Approve the application as submitted. 2. Deny approval oft the application 3. Approve the application with modifications that are mutually agreed upon by the applicant and the governing board. Such conditions shall be in compliance with 4. Submit the application to the Planning Board for further study. The Planning Board shall have up to thirty (30) days from the date of such submission to make a report to the governing board. If no report is issued, the governing board can take final action on the petition. The governing board reserves the right to schedule and advertise a new public hearing based on the Planning Board's Section 19.8. report. Section 19.8 ConditionsotApprovalofPetition In approving a petition for the reclassification of a piece of property to a CZ district, the Planning Board may recommend, and the governing board may require that reasonable and appropriate conditions be attached to approval of the petition. Such conditions shall be limited to those that address the conformance ofthe development and use oft the site to Town ordinances and an officially adopted comprehensive or other plan and those that address the impacts reasonably expected to be generated by the development or use oft the site. The petitioner will have a reasonable opportunity to consider and respond to any additional requirements prior to approval or denial by the governing board. Such conditions may exceed any performance criteria or minimum requirements listed elsewhere in this Ordinance that pertain to that development. Statements that (1) analyze whether the rezoning is consistent with an adopted comprehensive plan and any other officially adopted plan, and (2) other matters that the Town Board deems appropriate and (3) why it considers the action taken to be reasonable and in the public interest shall be prepared and accompany each final decision relative to the CZ rezoning request. 19-4 42 Section 21.4 Remedies Inc case any structure is erected, constructed, reconstructed, altered, repaired, converted or maintained in violation ofthis Ordinance, the Administrator, or any other appropriate Town Official, or any person who would be damaged by such violation, in addition to other remedies, may institute an action for injunction or other appropriate action or proceeding to prevent such violation. Section 21.5 Complaints Regarding Violations Whenever a violation of this Ordinance occurs, or is alleged to have occurred, any person may file a written complaint. Such complaint stating fully the cause and basis thereof shall be filed with the Administrator who shall properly record such complaint, immediately investigate, andt take action as provided by this Ordinance. Section 21.6 Enforcement And Penalties Any person, firm or corporation convicted of violating the provisions of this Ordinance shall, upon conviction, be guilty of a misdemeanor and shall be fined an amount not to exceed five-hundred dollars ($500) and/or imprisoned for a period not to exceed thirty (30) days. Each day that the violation exists shall constitute a separate and distinct offense. Section 21.7 Early Vesting OfDevelopment Rights Upon Approval OfSite Plan Pursuant to G.S. 160-A-385+ 160D-108 and not withstanding any other provision of this Ordinance or amendment thereto, a landowner may apply for a site specific development plan approval which shall entitle said landowner to develop property in accordance with said site specific development plan. The procedure for establishing a vested right is set forth debt. or use in or about the premises. in this section. 21.7.1 Definitions For the purpose of this section only, the following definitions shall apply: 1. Landowner Any owner of a legal or equitable interest in real property, including the heirs, devisees, successors, assigns, and personal representative of such owner. The landowner may allow a person holding a valid option to purchase to act as his agent or representative for purposes of submitting a 21-4 44 proposed site specific development plan in the manner allowed by Ordinance. Property Cramerton. Vested Right 2. All real property located within thej planning. jurisdiction oft the Town of 3. The right to undertake and complete the development and use of property under the terms and conditions of an approved site specific development plan. Types and duration of statutory vested rights shall be as set forth in N.C.G.S. 160D-108 and 160D-108.1. Amendments in land development regulations are not applicable or enforceable without the written consent of the owner with regard to any vested rights. 21.7.2 Submission OfA Site Specific Development Plan To apply for vested right, a landowner shall first submit to the Administrator asite specific development plan. The plan shall be submitted in completed form at least fifteen (15) days prior to the next regularly scheduled or called Planning Board meeting. The site specific development plan shall be considered complete if submitted with a fee (in accordance with a fee schedule adopted by the Town Board) and an accompanying application which, at a minimum, contains all information listed in Section 20.2(A) of this Ordinance. 21.7.3 Planning Board Review The Planning Board shall have a maximum of forty-five (45) days from the date it initially met to review the application to submit a recommendation to the Town Board. The Planning Board may at any time during this period, require additional information to evaluate an application. Should such information be requested, the review period shall not resume being counted until such information is presented to the Planning Board. Ifno recommendation is made to the Town Board after the end of the forty- five (45) day review period, the application shall be forwarded to the Town Board without ai recommendation. 21.7.4 Public! Hearing Once aj recommendation is received from the Planning Board (or the forty- five day period expires without a recommendation) the Town Board shall conduct a public hearing on the application. Notice of the public hearing shall be given as follows: 21-5 45 effective with respect to the subject property upon the expiration or termination of the vested right. The Town may also enforce on the property any additional regulations (adopted during the time the vested right was in effect) which are general in nature and applicable to all property subject to the regulations oft this Ordinance. 21.7.10 Permit Choice Ifa land development regulation is amended between the time a development permit application was submitted and a development permit decision is made ori ifa land development regulation is amended aftera development permit decision has been challenged and found to be wrongfully denied or illegal, G.S. 143-755 applies. 21.8 Types of Decisions Forc clarity, there are three types of decisions: 21.8.1. Legislative. Legislative decisions set policy and provides the decision-making board with the maximum amount of discretion. The legislative process typically includes public engagement. In connection with any requested rezoning of property or amendment to this UDO, there isar required public hearing with broad public notice and ai mandatory planning board review. Examples ofl legislative decisions are: a. Text Amendments b. Zoning Map Changes C. Conditional Rezonings 21.8.2. Quasi-judicial. Quasi-judicial decisions require the board to apply standards that are already set in the ordinance using a legalistic process to gather quality evidence to resolve contested facts, and to apply those facts tos standards that involve judgment (such as being "compatible "or "harmonious" with the surrounding neighborhood). Public engagement is limited to those who have relevant evidence on whether the proposal meets the standards. Examples ofc quasi-judicial decisions are: a. Variances b. Appeals 21.8.3. Administrative. Administrative decisions require staff to apply objective standards set in the ordinance to facts that are supplied in applications. Ifthe application meets the standards it is approved; ifnot, it isdenied. The process is bureaucratic in nature, with minimal discretion or public engagement. Examples of administrative decisions are: b. Construction Plans, Zoning Permits, Erosion Control Permits, and Miscellaneous Permits, such as Temporary Use Permits a. Subdivision Plats Building Permits, Sign Permits, 21-9 46 21.8.4 Voting Majority Vote Sufficient on First Reading. A legislative decision for development regulation on ar matter for which there has been a public hearing as set forth herein is permitted on first reading by a simple majority vote. There is no need for two-thirds majority on first reading, as was required for cities under prior law. 21.9 Moratoria. Temporary moratoria may be adopted by the Town in accordance with the requirements of 160D-107. 21.10 Conflicts ofInterest 21.10.1 Governing Board. A Town Board member shall not vote on any legislative decision regarding a development regulation adopted pursuant to this UDO where the outcome ofthe matter being considered is reasonably likely to have a direct, substantial, and readily identifiable financial impact on the member. A Town Board member shall not vote on any zoning amendment ift the landowner of the property subject to a rezoning petition or the applicant for a text amendment is a person with whom the member has a close familial, business, or other associational 21.10.2 Appointed Boards. Members of appointed boards shall not vote on any advisory or legislative decision regarding a development regulation adopted pursuant to this UDO where the outcome oft the matter being considered is reasonably likely to have a direct, substantial, and readily identifiable financial impact on the member. An appointed board member shall not vote on any zoning amendment ifthe landowner oft the property subject to a rezoning petition or the applicant forat text amendment is aj person with whom the member has a close 21.10.3 Administrative Staff. No: staffmember shall make a final decision on an administrative decision required by this UDO ifthe outcome oft that decision would have a direct, substantial, and readily identifiable financial impact on the staff member or ift the applicant or other person. subject to that decision is aj person with whom the staffr member has a close familial, business, or other associational relationship. Ifas staffmember has a conflict ofinterest under this section, the decision shall be assigned to the supervisor ofthe staff person or such other staff person as may be designated by the development regulation or other ordinance. No staffmember shall be financially interested or employed by a business that is financially interested in a development subject to regulation under this UDO unless the staff member is the owner oft the land or building involved. No staffmember or other individual or an employee ofa company contracting with the Town to provide staffs support shall engage in any work that is inconsistent with his or her duties or 21.10.4 Quasi-Judicial Decisions. A member ofany board exercising quasi- judicial functions pursuant to this UDO shall not participate in or vote on any quasi- judicial matter in a manner that would violate affected persons' constitutional rights to an impartial decision maker. Impermissible violations of due process include, but are not limited to, a member having a fixed opinion prior tol hearing the matter that relationship. familial, business, or other associational relationship. with the interest oft the Town, as determined by the Town. 21-10 47 is not susceptible to change, undisclosed ex parte communications, a close familial, business, or other associational relationship with an affected person, or a financial 21.10.5 Resolution of Objection. Ifan objection is raised to a board member's participation at or prior to the hearing or vote on a particular matter and that member does not recuse himself or herself, the remaining members oft the board 21.10.6 Familial Relationship. For purposes oft this section, a "close familial relationship" means a spouse, parent, child, brother, sister, grandparent, or grandchild. The term includes the step, half, and in-law relationships. interest in the outcome oft the matter. shall by majority vote rule on the objection. 21.11 Oath ofOffice. All members appointed to boards under this Article shall, before entering their duties, qualify by taking an oath of office as required by G.S. 153A-26 and G.S. 160A-61. 21.12 Miscellaneous Administration Authorities 21.12.1 Development Agreement. The Town may consider and enter into Development Agreements at the request ofa property owner in accordance with 21.12.2 Building Code Enforcement. Building Code Enforcement shall be in accordance with G.S. 160D, Article 11. As of the date oft this UDO, Building Code 21.12.3 Additional Authority. The Town has certain Additional Authority as 21.12.4 Judicial Review. N.C.G.S. 160D, Article 14 authorizes judicial review of certain Town decisions. Challenges to Town decisions shall be in accordance with G.S. 160D. Article 10. enforcement is handled by Gaston County. provided in G.S. 160D, Article 13. the applicable provisions ofG.S. 160D, Article 14. 21-11 48 property or any portion thereof or fora a similar change in the zoning text until the expiration ofone(I)year from the date ofs such previous denial. Once a completed application for a change on the zoning map has been submitted to the Administrator, the petitioner may have the petition withdrawn. If the petition is withdrawn after it has been reviewed by the Planning Board but prior to a public hearing being called by the Town Board, no new petition for any change in zoning classification of the same property or any part thereof may be filed (except by the Planning Board) for ap period of six months following the date of withdrawal. If the petition is withdrawn after aj public hearing has been called by the Town Board, no new petition for a change in zoning classification of the same property or any portion thereof may be filed (except by the Planning Board) for a period of one year following the date ofwithdrawal. 22.1.11 Governing Board Statement. A. Plan Consistency. When adopting or rejecting any zoning text or map amendment, the Town Board shall approve a brief statement describing whether its action is consistent or inconsistent with an adopted comprehensive plan. The requirement fora a plan consistency statement may also be met by a clear indication in the minutes ofthe Town Board that at the time ofa action on the amendment the Town Board was aware ofa and considered the planning board's recommendations and any relevant portions ofa an adopted comprehensive plan. Ifa zoning map amendment is adopted and the action was deemed inconsistent with the adopted plan, the zoning amendment shall have the effect of also amending any future land-use map int the approved plan, and no additional request or application for a plan amendment shall be required. A plan amendment and a zoning amendment may be considered concurrently. The plan consistency statement is not subject to judicial review. Ifaz zoning map amendment qualifies as a "large- scale rezoning" under G.S. 160D-602(b), the Town Board statement describing plan consistency may address the overall rezoning and describe how the analysis and policies in the relevant adopted plans were considered Additional Reasonableness: Statement for Rezonings. When adopting or rejecting any petition fora a zoning map amendment, a statement analyzing the reasonableness oft the proposed rezoning shall be approved by the Town Board. This statement of reasonableness may consider, among other factors, (i) the size, physical conditions, and other attributes oft the area proposed to be rezoned, (ii) the benefits and detriments to the landowners, the neighbors, and the surrounding community, (iii) the relationship between the current actual and permissible development on the tract and adjoining areas and the development that would be permissible under the proposed amendment; (iv) why the action taken is in the public interest; and (v) any changed conditions warranting the amendment. Ifaz zoning map amendment qualifies asa "large-scale rezoning" under G.S. 160D-602(b), the Town Board statement on reasonableness may address the overall rezoning. int the action taken. B. 22-5 49 C. Single Statement Permissible. The statement ofr reasonableness and the plan consistency statement required by this section may be approved as as single statement. 22.1.12 Citizen Comments and Input (Public Hearings before the Town Board). Ifany resident or property owner in the Town submits a written statement regarding aj proposed amendment, modification, or repeal to a: zoning regulation, including a text or map amendment, to the Town Clerk at least two business days prior to the proposed vote on such change, the Town Clerk shall deliver such written statement to the Town Board. Ifthe proposed change is the subject of a quasi-judicial proceeding under G.S. 160D-705 or any other statute, the Town Clerk shall provide only the names and addresses of the individuals providing written comment, and the provision of such names and addresses to all members oft the board shall not disqualify any member of the board from voting. 22.1.13 Down-Zoning; Property Owner Consent Required. No amendment to zoning regulations ora zoning map that down-zones property shall be initiated nor is it enforceable without the written consent ofall property owners whose property is the subject ofthe down-zoning amendment, unless the down-zoning amendment is initiated by the Town. For purposes ofthis section, down-zoning" means a zoning ordinance that affects an area ofland in one oft the following ways: (I)By decreasing the development density oft the land to be less dense than was allowed under its previous usage. Such private street, private property installations may be approved by the Board of Commissioners on a case-by-case basis subject to mutually agreed contracts addressing financing, property access and other terms and conditions. General Policy The Town of Cramerton, as part ofi its municipal service program, provides street/sidewalk lighting along all public streets within the corporate limits. All requests for lighting installation and removal are to be submitted in writing to the Town Manager. IV. Definitions Collector Street-- A road with low to moderate traffic volumes that connects major thoroughfares to residential streets. The style of fixture to be installed must be consistent with the style of fixture already installed in the neighborhood. Any cost differential from the amount charged to the Town for a standard fixture (cobra head fixture on a wooden pole) and a decorative fixture, at the date of authorization must be paid lump sum to the Town by the requester prior to authorization. If decorative lighting is requested and the neighborhood has no decorative lighting previously approved, an authorized endorsement by the neighborhood association (or ifnone is present, then 75% of adjoining property owners) is required, since future requests for lighting would need to conform to the same decorative lighting option. IX. Annexation Areas Upon annexation of an area by the Town of Cramerton, residents along a street may request additional street lighting, beyond that already installed, provided current street lighting does not meet Town standards and the request includes an approved petition. However, there are still some items that require al higher-level building inspection certificate or a specialized certificate like electrical or plumbing that our Code Enforcement Officer does not have. These specialized items are not widespread, but in the rare cases that they arise, the Town needs to have the County's assistance as an expert in these fields. When staff reached out to the County, we discovered that the Town does not have an interlocal agreement with the County for these services. Previously, staff had been under the impression that an agreement was in place, but this was not the case. In the past, Gaston County has assisted the Town with minimum housing code violations, and even assisted in having some serious violations dealt with teardown and removal, but there was never: an agreement in place to formalize this relationship. After speaking with Gaston County staff, we have determined that an interlocal agreement is the best format to use going forward. The attached interlocal agreement spells out the assistance that the County will offer the Town on an as-needed basis. Again, this would only be int the rare cases where an issue arises that exceeds our own staff's certification level; 95% of cases should be able to be handled internally. This agreement would provide us witha resource that we could use in those 5% of cases that require additional assistance. The current data collection method is to use the US Geological Survey (USGS) river gauge located in Lowell, NC. Flood tracking and data collection from the Lowell gauge has continued to be reliable. Outreach efforts to County Emergency Management and NC Emergency Management departments has yielded the question if there should be the similar type of river gauge located in Cramerton. Below is a report from Parks and Recreation Director Eric Smallwood regarding this topic: Iwas contacted aj few months ago by the state Department of Public Safetyl requesting to, place ariver gauge on the Goat Island. The two responding firms were Sign Connection (Gastonia) and RiteLite (Charlotte). These firms along with the initial Bizzell designs were reviewed by the Wayfinding Sign Committee. All bids/ designs are included in this agenda as Attachment A". Please note that in some cases, one firm submitted multiple design possibilities and locations for a neighborhood sign. Wayfinding Sign Committee Recommendations Based on all design options, the Wayfinding Sign Committee is recommending: to work with Buzz Bizzell reconfigure his initial neighborhood sign designs. The two specific sign designs that the committee referenced as positive base examples are the Bizzell designs for Old Town and Lakewood.
