January 10, 2023 SECOND TUESDAY WORK SESSION TOWN OF DAVIDSON BOARD OF COMMISSIONERS The Town of Davidson Board of Commissioners held its regularly scheduled meeting on Tuesday, January 10, 2023 int the Town Hall Board Room. Present were Mayor Rusty Knox and Commissioners. Jane Campbell, Matthew Dellinger, Ryan Fay, and Autumn Rierson Michael. Commissioner Tracy Mattison Brandon was absent. Town Manager. Jamie. Justice, Assistant' Town Manager Austin Nantz, Town. Attorney Mary Ann Swan, and Town Clerk Betsy Shores were also present. CALLTOORDER Mayor Knox called the meeting to order at 6:00 p.m. ANNOUNCEMENTS Communications Director Amanda Preston Sloan announced the following: Community members are invited a special Martin Luther King, Jr. Day Ceremony in the Town Hall Board Room, 216 S. Main Street. on Monday, January 16 at 10:00 a.m. The program willi feature, guest speakers President Douglas Hicks of Davidson College and Reverend Reginal Coffey of Reeves A.M.E. Zion Church in Davidson. The event will alsoi include. spoken word performances by Michael Connor and Chandra DuBose, as well as several musical selections. Light refreshments will be served before the program. Thet town will also follow up the celebration by hosting a public meeting to launchi the planning oft the 2024 MLK Day. Please join us on Wednesday, January 18 at11:00 a.m. int the Community Roomat the Davidson Public Library, as it will be critical for community members to bei involved to plan a robust MLK celebration that The Town of Davidson offices will be closed Monday, January 16i in observance oft the Dr. Martin Luther King, Jr. holiday. We will re-open Tuesday, January 17 for regular 8:00 a.m. to 5:00 p.m. business hours. Garbage and recycling will be collected on a regular schedule the week of January 16. The Town of Davidson invites the community to a reception honoring Police Chief Penny Dunn on Monday, January 30, 3:00 p.m.-5:00 p.m. at Davidson College Presbyterian Church Congregation House (208 Concord Road, Davidson). Special remarks will be made at 4:00 p.m. Chief Dunn has served the town for over five years and has been int the field of law enforcement for over 37 years. The reception will be an opportunity to thank her for her service and to wish her well as she retires on January 31, 2023. best reflects our town. BUSINESSITEMS (a) Parks and Recreation Director Leslie Willis presented an update on ARPAI Park Projects. In. June 2022, the approved Capital Improvement Plan (CIP) included 3 park projects funded contingent upon grants. Staff was tasked to pursue the grants and come back for an update/discussion of how to proceed. The American Rescue Plan Act (ARPA) Strategy Framework approved by the board included $345,000 for Park Improvements. Staff recommended the following approach: Proceed with Bradford Neighborhood Park- $100,000 from ARPA funding Determine in Marchi if town received grant for Roosevelt' Wilson Park-$181,250; utilize Continue working through plans for Ada. Jenkins Playground-580,000 ARPA funds for grant match or full cost Commissioner Rierson-Michael. made a motion to approve the recommended approach including the authorization of ARPA funds of $100,000 for Bradford Neighborhood Park. The motion (b) Police Chief Penny Dunn discussed with the board a proposed ordinance related to shared micromobility business operations in the Town of Davidson. The ordinance details the regulation of operations for rented, commonly referred to as shared micromobility devices. The regulations are intentional in a manner to strike al balance fore encouraging the use of alternative mobility devices while preserving Davidson's historic places, environmental conditions, and strong pedestrian usage of sidewalks in identified areas of town. The proposed ordinance is in alignment with the Strategic Plan, Core Values, Comprehensive Plan, and Mobility Plan and provides more guidance and regulation than current Peddler Permitting Ordinance. The board will consider adoption at the. January 24 meeting. (c) Finance Director Piet Swart discussed with the board proposed changes to the Town,ofD Davidson Finance Policy. Based on previous discussions with the board of commissioners, staffi is recommending changes to the Town of Davidson Finance Policy with regard to the Budget Development, Capital Improvement Plan, Stabilization Threshold and Debt Policy sections. The board will consider approval (d) Assistant Town Manager Austin Nantz presented an update of the Public Facilities project. Voters approved General Obligation (GO) bonds in support of public facilities for public safety, town staff, and community use. The project includes two phases: Adaptive reuse and rehabilitation oft the historic 251 South Street for a new1 town hall and community center; and reconfiguring the current town hall to better accommodate the needs of the Davidson Police and Fire Departments. Due to various factors including but not limited to, challenges related to the adaptive reuse of an historic property, record inflation resulting ini increases of the costs of goods and services, and code compliance challenges and resulting mitigation efforts, staff is requested $50,000 in additional funding passed unanimously (4-0). of the policy changes at the. Commissioner Campbell made a motion to approve Budget Amendment 2023-12 allocating $450,000 from the Unassigned Fund Balance to Public Facilities Capital Projects Fund. The (e) Housing and Equity Director Eugene Bradley presented an update on two affordable houses available for purchase. On. July 26, 2022 and August 23, 2022, staff presented an affordable housing buy-back/sale program for the Town of Davidson. There are currently 80 homes with deed restrictions associated with the affordable housing program. This will provide an opportunity for the town to enhance and update deed restrictions and to make minor repairs prior to listingi it for sale. Staff recommended the board exercise the right of first refusal option to purchase 12511 Stonebriar Ridge Drive and 13022 Claudel Court affordable homes that are intended to go to the market in February 2023. The reason this is necessary and recommended is that it provides an opportunity for deed restrictions to be updated. These updates include, but are not limited to, extending the period of affordability, clarifying thei town's and the owner's responsibilities int the sale process, and expanding a specific Area Median Income (AMI) requirement to include a range (i.e. from 80%1 to 80%-120% AMI). The intent is to purchase select homes with board approval using funds from existing MI Connection. Town ownership of the home willl be short-term. The plani is that within 120 days, updates to the deed restrictions, any necessary repairs, and the sale of the home willl be complete. Proceeds from the sale motion passed unanimously (4-0). will be returned to the original funding source. Commissioner Fay made a motion to approve Resolution 2023-01 and Resolution 2023-02 authorizing the Town Manager to execute the buy-back/sale of 12511 Stonebriar Ridge Drive and. 13022 Claudel Court, and approve Budget Amendment 2023-10 allocating $500,000 from the MI Connection Capital Project Fund to the General Fund and Budget Amendment. 2023-11 allocating. funds in the General Fund. The motion passed unanimously (4-0). (f) Town Manager. Justice presented Resolution: 202508-M-Comnection Terminate Interlocal Agreement and Dissolve the Joint Agency. At the October 25, 2022 board meeting, the board approved a resolution declaring thei intent to terminate the MI-Connection interlocal agreement between the towns of Davidson and Mooresville. The Town of Mooresville likewise approved the same resolution. Subsequent to declaring this intent, thej joint agency created byt the Interlocal Agreement has withdrawn from the Local Government Employees Retirement System ini accordance with the procedures and requirements of North Carolina G.S. 128- 30(1). Thei final action needed is to terminate the Interlocal Agreement between the towns of Davidson and Mooresville. Mooresville took action to terminate the Interlocal Agreement at their. January3, 2023 meeting. Commissioner Dellinger made a motion to approve Resolution 2023-03 to terminate the Interlocal. Agreement and dissolve the joint agency. The motion passed unanimously (4-0).
