TOWN OF COATS Board of Commissioners November 14, 2013 7:00 p.m. OFFICIAL MINUTES LA ABSTRACT: A regular meeting ofthe Board of Commissioners was held on Thursday, November 14, 2013 at' Town Hall Board Room. II. ROLLCALL: Mayor Walter Weeks, Mayor Pro-Tem Dr. Linda Robinson, Commissioner J. C. Allen, Commissioner Allen Mosby, and Commissioner Jerry Beasley were in attendance. Commissioner Don Pleasant was not in attendance. Attorney Al Bain was present. II.C CALLTO ORDER: A quorum being present, Mayor Weeks called the meeting to order at 7:00 p.m. Mayor Walter Weeks delivered the invocation as well as lead those in attendance in the Mayor Walter Weeks congratulated Commissioner Beasley and Commissioner Mosby on Pledge of Allegiance. their reelection and welcomed the future Commissioner John Raynor. Minutes from the 9/12/13 and the 10/10/13 meetings had to be edited and revised. Correct copies oft the new minutes were submitted for review and asked to be approved. LINDA ROBINSON NOES (0) V.MANAGER & COMMITTEE REPORTS DEPARIMENTUPDATES: Town Manager Kenny Cole told department heads to stay at the recognition dinner and enjoy. He then thanked those for attending the 9/11 Relics Meeting. The meeting was held November 7,2013 at 3:30 p.m. Mayor Walter Weeks, Town Manager Kenny Cole, Coats Grove Fireman Brad Capps, Coats Museum Employee HL Sorrell, Coats Chamber Vice President Pat Godwin, and Coats Police Chief. Jeremy Hall were all in attendance. The meeting went well and included information about signing out the relic with the Town Clerk. The relic would only rotate between the Library, Museum, Chamber of Commerce, and the Fire Department for certain events. Ifanything happens to the relic under the watch of someone else they are responsible for replacing or fixing the relic. Town of Coats Employees are responsible for coming up with a display for the relic in Town Hall Building. The Board had to endorse the committee work. LINDA ROBINSON NOES (0) Town Manager Kenny Cole went on to talk about the Harnett County Local Government Association Meeting on Tuesday, November 19 at the Brass Lantern at 6:30 pm. Town ofCoats is still Chairman oft this Association. Campbell School of Medicine spokesperson will be in attendance. He then reminds the board oft the December Sth Christmas Parade. Anyone interested in riding in the parades needs to let him know. Kenny Cole received a letter for the Martin Luther King Celebration and Parade and the committee has extended an invitation to the Town of Coats to attend in Dunn on 1/20/2014. VI. NEW BUSINESS A. Consider Street Closures for the Annual Christmas Parade: Same street closures as last years parade. The parade takes place on December 5th at 6:30 pm. Mayor Weeks ask MOTION BY: MAYOR: PRO-TEM DR. Discussion of Animal Issue at 78 South Denise Avenue: Mr. Holland requested to be placed on the agenda to discuss a dog issue that occurred on. his property located at South Denise Avenue. Mayor Walter Weeks welcomes Mr. B.W. Holland to the meeting. Mr. Holland explains he wants to discuss aggressive animals in1 the town. Hel had a 9 year old Shitzu that was dragged under his fence and mauled to death. The animal that attacked his dog was not taken by the Harnett County Animal Control. He is worried that ifit had been a child and not an animal he would have done the same thing to the child. He states that maybe the town should add something about aggressive animals to the animal ordinance. This is the third animal this particular dog has killed. Mayor Pro-Tem Dr. Linda Robinson asks ifanimal control tried to get the dog who had done the attacking. Mr. Holland explains that animal control only checked to make sure the dog had been vaccinated for rabies. Mayor Pro-Tem Dr. Linda Robinson asked if the dog had been leashed or contained. Mr. Holland says no he had broke off his chain and then attacked. The owner of the dog proved the dog had been vaccinated for rabies and animal control apologized for the situation and said there was not much else that could be done. Mayor 3 Pro-Tem Dr. Linda Robinson asks about Harnett Counties Law on Aggressive Animals. Town Manager Kenny Cole explains the Town of Coats has adopted their ordinance since they provide animal control for the Town and there is no law stated pertaining to certain animals. Mayor Walter Weeks mentions the review panel for Harnett County and we can bring this issue to their attention. Mayor Pro-Tem Dr. Linda Robinson asks if animal control has ever been called on this particular dog before. Kenny Cole states he is unsure. B.W. Holland explains this dog has killed two other dogs. He is concerned that children in the neighborhood are in danger. Mayor Walter Weeks says he is sorry for his loss. Mayor Pro-Tem Dr. Linda Robinson asks that the board review the ordinance and look into this situation. Mayor Walter Weeks suggests that Kenny Cole contact the Harnett County Review Board and have them look at this animal as a vicious animal. Cindy Calles from 369 E. South St. spoke and expressed her concern about dogs attacking small children. Animal Control explained there was nothing there could do ina dog-on-dog" situation, only in a dog-on-human" situation. Mayor Walter Weeks asked C. Consider the Request to Install Guardrails at 365 S. Lincoln St: Due to the numerous accidents along 365 Lincoln Street, the property owner has requested a protective barrier to be installed to protect the residence. In August 2013, a vehicle missed judge the curve andran into the house causing significant structural damage. Mr. Cole has contacted the Department ofTransportation and they did not think rails were needed. He is requesting in writing to NCDOT1 toi install a protective barrier along 365 Lincoln Street. Mayor Walter Weeks ask for a motion to write a letter to the NCDOT requesting to placea guardrail to protect the houses. Consider Installment Purchase Contract for the Purchase of the Town LeafTruck: In the 2012-2013 Budget, the Board approved the replacement of a leaf truck ini the Public Works Department. Request for financing quotes were solicited by the Town October 23,2013. Mr. Cole has submitted two proposals for the financing oft the equipment. Proposal one is from First Citizens Bank: fixed term at 2.4% for 7 year period. Proposal two is from BB&T: fixed term at 2.98% for 7 year period. Itisamulti-purpose truck and will be purchasing off of state contract. Ifwe go with First Citizens it will cost the town about $7,000 a year and wel have $7,500 budgeted. Itisa a two step process where we purchase the truck, then get a bed placed on it. Commissioner Beasley asks ift the price includes the bed work. Mr. Cole says yes, the truck is not to exceed $45,000 all inclusive. Mayor Walter Weeks ask for a motion to adopt the: resolution. 4 MOTION BY: MAYOR PRO-TEM DR. Consider Interlocal Agreement for Debris Management and Removal: InJuly 2010, Harnett County bid and awarded a three year contract to Unified Recovery Group, LLC for debris removal in the event ofa a natural disaster in Harnett County. The Town adopted this interlocal agreement in December 2010. Harnett County has rebid for the same services and has awarded the contract to CrowderGulf, LLC. For the benefit of our citizens and for the purposes of greater economy and efficiency, Mr. Cole recommends entering into the Interlocal Agreement pursuant to N.C. Gen. Stat. 160A-460. CLOSED SESSION The Mayor, Board of Commissioners, Town Manager, Town Clerk, and Town Attorney conduct a closed sessions pursuant to: Sell or acquisition ofreal property and to Consider a grievance by or against an individual public officer or employee. Attorney Al Bain also asked to add item three: Consulting with an attorney. Mayor Walter Weeks ask for a motion to go into closed session. Closed session began at 7:36 pm. OLD BUSINESS 5 A. Discussion oft the Sale ofTown Property: Mr. Cole passed out an offer on the Old Town Hall Building. We did: not get a deposit with the offer so if board acts on the offer, ac deposit will be required. Mayor Pro-Tem Dr. Linda Robinson asks about the water line that is being requested by the potential buyers. The water line present is not standard for residential occupancy. The building would require a 4 inch pipe. IfGary did the work it would cost around $8,000. We would deduct this amount from the offer SO the Town would not hold liability on repairing and replacing the waterline. The offer is $100,000 unless they have to repair waterline themselves, then it would be $90,000. Other contengencies listed are: Rezone for residential or residential/business, all city records must be removed, the furniture that is there must stay, and Town Seal must remain in the main lobby. Any person can raise an upset bid. There is no official offer until the property is rezoned. If we get deposit and the property cannot be rezoned we: must return APPROVED, AYES (4) MAYOR PRO-TEM DR. Adjourn Mayor Walter Weeks reminds everyone in the change in government at the next meeting and say "goodbyes" and "thank yous" to Commissioner Pleasant. Also do not forget Committee Appointments in January.
