Telownf 9Davidson August 8, 2023 SECOND TUESDAY WORK: SESSION TOWN OF DAVIDSON BOARD OF COMMISSIONERS The Town of Davidson Board of Commissioners held its regularly scheduled meeting on Tuesday, August 8, 2023 int the Town Hall and Community Center Board Room. Present were Mayor Pro Tem. Jane Campbell, Commissioners Matthew Dellinger, Ryan Fay, Tracy Mattison Brandon and Autumn Rierson Michael. Mayor Rusty Knox was absent. Town Manager. Jamie. Justice, Assistant Town Manager Austin Nantz, Interim Town Attorney Karen' Wolter and Town Clerk Betsy Shores were also present. CALLTOORDER Mayor Pro Tem Campbell called the meeting to order at 6:00 p.m. Mayor Knox was absent from the meeting. ANNOUNCEMENIS Communications Director Jessica Eggimann announced the following: The Stuff the Truck' event hosted by the Davidson Fire Department and partnered with the Police Department and local non-profit, FeedNC was al huge success. Our community contributed 314 pounds of back-to-school. supplies for those in need. Every donation, no matter how small, contributes to al larger mission of ensuring that no child goes hungry as they embark on their educational journey. The Annual Lake Norman Fondo Cycling Event for LKN Area Charities will take place this Sunday, August 13. Please exercise caution when traveling around town. Lorimer Road will be closed from the CVS parking lot (127S S. Main! Street) to Davidson-Concord Road beginning, Saturday, August 12 at 6:00 p.m. through Sunday, August 13 at 4:00 p.m. Participating cyclists are asked to park in the public lots along Jackson Street. Please note duei to! Sunday's church services, available parking Downtown may be limited. The Village Green will host all Lake Norman Fondo event related activities throughout the day. The town's Concert on the Green will take place starting at 6:00 p.m. with a performance by Riggsbee Road. The Town kindly requests concert goers refrain from setting up their chairs and/or tents until after 4:00 p.m.t to ensure the cycling event has officially concluded and its event organizers have ample time to restore the Nominations fori the 2023. Jackson Burney and those who improve the Davidson community through unselfish Village Green. service over a lifetime. CHANGES/ADOPTION OF1 THE AGENDA Town Manager. Justice requested removal of business item (g) Consider Approval of Settlement Agreement- Gregory! Scoggins and Carol Scoggins V. Town of Davidson, et. al. 22-CVS-19307. Commissioner Rierson-Michael. made a motion to adopt the agenda as amended. The motion passed unanimously (5-0). BUSINESSITEMS (a) Town Manager. Justice discussed with the board the proposed Ordinance 2023-07 to Amend the Charter to Change Terms of Office from 2-Year Terms to 4-Year Staggered Terms and the two options for transition if the voter referendum were to pass in November. The board chose option 2 as the method of transition. This means that should the charter amendment by approved byt the voters in a referendum on November 7,2023, at the 2025 election, voters and the candidates know who would get which term length. The method of transition would bet three 2-year seats and two 4-year seats on1 the ballot. At the next election, everyone (except the mayor) runs for 4-year terms. Commissioner Dellinger made a motion to adopt Ordinance 2023-07 to Amend the Charterto Change Terms of Office from 2-Year Terms to 4-Year. Staggered Terms of Office for Commissioners with Option. 2 as the method for transition. The motion passed (4-1) with Mayor Pro Tem Campbell and Commissioners Dellinger, Mattison-Brandon, and Rierson Michael voting yes and Commissioner Fay voting no. (b) Town Manager. Justice reviewed Resolution 2023-24 Calling a Special Election to Amend the Charter to Change Terms of Office for Commissioners from 2-Year Terms to 4-Year Staggered Terms. Following the previous item to adopt an ordinance to amend the Town Charter, the amendment shall be effective upon approval by a vote of the people pursuant to a special election/referendum for the upcoming fall 2023 election with the Mecklenburg County Board of Elections and Iredell County Board of Elections on the November 7, 2023 ballot. Mayor Pro Tem Campbell made a motion to approve Resolution 2023-24 Calling a special election, for the purpose ofsubmitting to a vote on Ordinance Amending the Charter of the Town of Davidson to Change the Terms of Commissioners to four-year staggered terms. The motion passed unanimously (5-0). (c) Finance Director Piet Swart presented information regarding the proposed issuance of General Obligation (G.O.)Bond Debt. The Board willl be asked to consider approval ofa Sale and issuance Resolution at the (d) The Board approved the Davidson Tax Assistance Program in conjunction with the FY2024 Budget. Finance Director Piet Swart presented to the board proposed parameters and eligibility requirements of the program. The Board willl be asked to consider approval oft the final program at the August 22, 2023 Board meeting (e) The Town plans to use a $2 Million American Rescue Plan Act (ARPA) grant from Mecklenburg County to renovate thel historic gymnasium behind the Town Hall and Community Center Gym for the town's first public indoor recreational space that can also be used for youth and senior activities. One of the requirements for securing the grant funding is that the project is bonded by the end of 2023. To meet that requirement, Project Manager Doug Wright reviewed with the board the option to utilize the design-build method of construction. September 26 meeting to issue $5.1 million in voter approved G.O. Bond Debt. This method is allowed by statute, with the requirement that the town establish and meet criteria to determine that design-build construction method is appropriate for the project. Commissioner Rierson Michael made a motion to approve Resolution 2023-25 Determining the Design-Build Construction Method for the Historic Gymnasium Renovation Project. The motion passed unanimously (5-0). (f) Davidson' Walk by Hopper Communities (Davidson Bay Phase Il, Envelopes A, B,& C) will include at total of54 residential units and +/-20,000SF commercial office space. An Affordable Housing Plan was approved by the town board in August 2021. It includes eight (8) affordable housing units on the ground to satisfy the affordable housing requirements ranging between 80%-120% of Areal Median Income (AMI) with the option to make a payment in lieu of each unit that is not soldt to a qualified buyer after 61 months, specifically the last four (4) remaining units. Hopper is proceeding with building all 8 units in the two quadplexes and they are under construction now with one oft the buildings nearing completion. We are currently in the process of securing Housing and Equity Director Eugene Bradley shared that staff have recently been preparing for the sale of the units and have determined that changes to the plan are needed. The change of most importance is to provide more flexibility for qualified buyers to purchase the units. Originally, the units have floors with thel low end of the AMI. For example, 4 of the units are to be between 100% and: 120% AMI, with the floor being 100% AMI. Staffrecommended changing this so therei is no floor. The outcome would be ifa qualified buyer wants to purchase a certain unit, they are not excluded from that. For example, ifac qualified buyer at 90% AMI is able to purchase one oft the units int the 100%- 120% AMI range, this change would allow that. The rest of the changes were minori in nature and recommended by the town attorney. The First Amendment will provide more opportunities for qualified buyers and will allow for better implementation oft the Davidson Walk Affordable Commissioner Dellinger made a motion to approve the First Amendment to the Davidson Walk qualified buyers for thei first 41 units.
