He led us in thel Pledge of Allegiance. Mayor Seaford called roll. All council members were present. There was a quorum. Mr. Stroud made a motion to adopt the agenda. Mr. Heggins seconded the motion, which carried unanimously. HEARING I) 2020-CUP-01; Ketchie Estate Road multi-family Special Use Permit Extension Mr. Gover stated the applicant is requesting a two-year extension to Special Use Permit 2020-SUP-01 permitting the construction of a multi-family development on Rowan County Tax Parcel 124 101. He stated the special use permit was issued in 2020 for the Ketchie Estates multi-family project. He stated a special use permit is good for two years and the end oft the two years is coming up. He stated nothing has changed on the site plan. He stated thel Planning Board recommended to extend the special use permit for two more years. Mayor Seaford asked if Liberty Grove will tie into this project. Mr. Gover stated these projects would tiei into each other by ai road. Mayor Seaford asked how many entrances will these projects have when combined. Mr. Gover stated there would be two entrances for this project, one off the end of Ketchie Estates Road and one would connect into what is tentatively called Elm Forest Drive within Liberty Grove. Mayor Seaford stated from Elm Forest Drive there will be two other entrances from Lentz Road and Grove Street. 319/Page, Minute Book 7 Mr. Bringle asked if the property has been sold. Mr. Stroud made the motion to extend special use permit 2020-SUP-01 for an additional two years to allow a multi-family residential development on Rowan County Tax Parcel 124 101. Mr. Heggins seconded the 2022-Z-01; Morton - Zoning Map Amendment Highway. Business to Mixed Residential Mr. Gover stated the applicant is requesting a rezoning from Highway Business district to the Mixed Residential district to allow for residential use located at 1755 South US 29 Hwy. He stated the property is located on the southern end which is predominantly Highway Business. He stated the property has an existing structure which historically was a single-family residence. He stated the structure has since been used for a real estate office, a conforming use. He stated since the property is zoned Highway Business a single-family residence cannot exist. He stated the parcel is located along US 29 a major thoroughfare road, and China Grove's primary commercial corridor. He stated the China Grove Land Use Plan recommends General Commercial along US 29 Corridor; however, the US 29 Corridor Plan recommends allowing a mixture of uses along the corridor including muiti-family. He stated the Mixed Residential district is appropriate for higher density residential uses near major thoroughfare roads. He stated looking into the future this could evolve into Mayor Seaford asked if Mixed Residential use would allow for retail below and residence above. Mr. Gover stated it could. He stated with the update to the UDO, Mixed Residential will take on a whole new meaning. He stated any changes to this] property would have to go through the conditional zoning process. Mr. Gover stated this project is located in a water supply water shed area and could be subject to increased Mr. Bringle asked if there is connectivity for water and sewer in the area if the property were developed as multi-family. He stated there has been no interest in four years for commercial use. He stated the family that originally built the home would like to buy the property and have their daughter live in thel home. Mayor Seaford closed the public hearing. Mr. Phillips made a motion to approve the request to rezone Rowan County Tax Parcel 129046 from Highway Business to Mixed Residential due to the fact that 2022-Z-01 is appropriate and necessary to meet the development needs of China Grove for the following reason not previously envisioned by the China Grove Land Use Plan because the Mixed Residential District is appropriate for higher density residential uses near major thoroughfare roads. Furthermore, the adoption of 2022-Z-01 is deemed an amendment to the China Grove Land Use Plan and is reasonable and in the public interest. Mr. Stroud seconded the motion, which carried unanimously. OTHER BUSINESS I) ARP Discussion 320Page. Minute Book 7 Mr. Stroud stated he would like to table any discussion for ARP until we are in the budget process. He stated it appears we can now use the ARP funds for employees' salaries and then use the funds we would have used on Mrs. Sheets asked if deciding on if the town would like to give a grant to a nonprofit would be discussed during the budget process as well. She stated she feels strongly that there are nonprofits that are in need for funds due to the Covid pandemic. Mayor Seaford stated we need to look into if the funds that a nonprofit is requesting is tied back to a Covid related issue. Mrs. Sheets asked what would be the process moving forward, will the town have an application to fill out requesting funds or do they need to submit a request. Mr. Bringle stated during the budget process we should set aside a dollar amount the town would like to give as grants. He stated then the town should devise a grant application form. He stated then the Council should review those Mr. Stroud asked Mr. Deal to have staff devise a grant application form for nonprofits and guidelines on how Mr. Stroud made a motion to adjourn. Said nonprofit corporation or trust shall only dispose of or use said real or personal property subject to covenants or other legally binding restrictions which will promote the preservation or conservation of the property, and, where (c) A city council may adopt regulations prescribing procedures for disposing of personal property valued at less than thirty thousand dollars ($30,000) for any one item or group ofi items in substitution for the requirements ofthis Article. The regulations shall be designed to secure for the city fair market value for all property disposed of and to accomplish the disposal efficiently and economically. The regulations may, but need not, require published notice, and may provide for either public or private exchanges and sales. The council may authorize one or more city officials to declare surplus any personal property valued at less than thirty thousand dollars ($30,000) for any one item or group ofitems, to set its fair market value, and to convey title to the property for the cityi in accord with the regulations. The resolution or order shall identify the property to bes sold and may, but need not, specify a minimum price. A notice summarizing the contents ofthe resolution or order shall be published once after its adoption, and no sale shall be consummated thereunder until 10 days after its publication. The sale of property by advertisement for sealed bids shall be done in the manner prescribed byl law for the purchase of property, except that in the case of real property the advertisement for bids shall be begun not less than 30 days before the date fixed for opening bids. (1971,c.6 698,s. $160A-268. Advertisement for sealed bids. 1.) $160A-269. Negotiated offer, advertisement, and upset bids. Acity may receive, solicit, or negotiate an offer to purchase property and advertise it for upset bids. When an offer is made and the council proposes to accept it, the council shall require the offeror to deposit five percent (5%) ofhis bid with the city clerk, and shall publish a notice oft the offer. The notice shall contain a general description of the property, the amount and terms oft the offer, and a notice that within 10 days any person may raise the bid by not less than tenj perçent (10%) oft the first one thousand dollars ($1,000) and five percent (5%) of the remainder. When a bidi is raised, the bidder shall deposit with the city clerk five percent (5%) of the increased bid, and the clerk shall readvertise the offer at the increased bid. This procedure shall be repeated until no further qualifying upset bids are received, at which time the council may accept the offer and sell the property to the highest bidder. (a) Real Property. - When it is proposed to sell real property at public auction, the council shall first adopt ai resolution authorizing the sale, describing the property to be sold, specifying the date, time, place, and terms of sale, and stating that any offer or bid must be accepted and confirmed! by the council before the sale willl be effective. Theresolution may, but need not, require the highest bidder at the sale to make a bid deposit in a specified amount. The council shall then publish a notice oft the sale at least once and not less than 30 days before the sale. The notice shall contain a general description of the land sufficient to identify it, the terms of the sale, and a reference to the authorizing resolution. After bids have been received, the highest bid shall be NC General Statutes Chapter 160A. Article 12 2 reported to the council, and the council shall accept or reject it within 30 days thereafter. The city or county shall attach to any such conveyance covenants or conditions which assure that the property will be put to a public use by the recipient entity. Provided, however, that a city or county may convey to anypublicorprivate entity, which is authorized to receive appropriations from a city or county, surplus automobiles without compensation or without the requirement that the automobiles be used for a public purpose.
