Marc Powell Members Absent: Mayor Chris Coats Mayor Pro-Tem Jerry Beasley LCALLTOORDER StaffPresent: Nick Holcomb, Town Manager All Bain, Town Attorney Connie Lassiter, Finance. Director/Town Clerk Nick Holcomb, Town Manager, informed thel Board that they would need to select someone to preside over the meeting due to the absence oft the Mayor and Mayor Pro-Tem. RESOLVED, that Commissioner. Allen Mosby would preside over the meeting. MOTION BY: Commissioner Marc Powell, SECOND BY: Commissioner Shirley Allen A quorum being present, Commissioner Allen Mosby called thei meeting to order at 6:00 p.m. Commissioner Mosby delivered the invocation and led those in attendance in thel Pledge of Allegiance. APPROVED: 4-0, unanimously approved II. PURCHASE AND EXCHANGE OF: PROPERTY Commissioner. Allen Mosby stated the purpose oft the special meeting was to clear up the item from the Town Manager Nick Holcomb expressed that the Board went into closed session to discuss purchase and exchange of aj piece of! property at the last meeting with the majority oft the Board wanting to proceed with ita and because of the exchange there were State requirements to advertise public notice ten days prior toa vote. Town Manager Holcomb explained that coming back in the room for open session the recorder was not set, and there was confusion of the motion that Mayor Pro-Tem Beasley made to proceed appeared to be to allow the Manager to negotiate. Town! Manager Holcomb stated that although it seemed the majority of thel Board wanted to proceed with publishing the notice, the Mayor Pro-Tem made the motion and there was al big difference in allowing to negotiate and allowing to proceed. Town Manager Holcomb indicated that discussion with the' Town Attorney led to the conclusion that it was best to present the Board with the actual notice that would run in the paper to satisfy the State law last meeting. 1 and tol have a motion that was clear to allow the' Town Manager to proceed with required notice oft the Town. Attorney. Al Bain stated that at this point the Board would just be giving the Town Manager the authority to proceed with publication ofr notice; he went on to read NCGS 160A-271 "A city may exchange any real or personal property belonging to the city for other real or personal property by private negotiation ift the city receives a full and fair consideration in exchange for its property. A city may also exchange facilities ofa a city-owned enterprise for like facilities located within or outside the corporate limits. Property shall be exchanged only pursuant to ai resolution authorizing the exchange adopted at a regular meeting oft the council upon 10 days' public notice. Notice shall be given by publication describing the properties tol be exchanged, stating the value oft the properties and other consideration changing hands, and announcing the council's intent to authorize the exchange at its next regular Town Attorney Bain reiterated that what was needed now was authorization from the Board to publish notification and then the Board would consider to adopt the exchange at the next meeting.
