North Carolina Mayor Seaford called the regular meeting of December 6th, 2022 to order. He led us in thel Pledge of Allegiance. Mr. Stroud amended the agenda with the addition to discuss 911 South Main Street in Other Business. Mrs. Sheets amended the agenda with the addition to discuss Non-profit Funding in Old Business. Mr. Phillips made a motion to adopt the agenda. Mr. Stroud seconded the motion, which carried unanimously. Mayor Seaford called roll. All council members were present. There was a quorum. Mr. Stroud seconded the motion, which carried unanimously. CITIZENS COMMENT None QUASIJUDICIAL, HEARING I) 2022-SUP-01 Auto Sales and Service testimony during the hearing. Mrs. Mills swore in Franklin Gover, Assistant Town Manager, Jeff Young, Consultant for Petra Rodriguez, for Mr. Gover stated the applicant is requesting a Special Use Permit to redevelop an existing site along Us 291 HWY for automobile sales and service. He stated this was formally Gatton's Towing Service. He stated Jeff Young is a planner and is representing the property owners. He stated historically the site was used for used car sales. He stated to the east is R&L Carriers on the corner of US 29 and Pine Ridge Road. He stated Rose Street is directly to the south and Cherry Street is directly behind. He stated the Cotton Mill Village is zoned Town Residential, the subject parcel is zoned Highway Business, and R &L Carriers is zoned) Light Industrial. He stated the property owners have cleaned it up the site and all junk cars have been removed, the building has been painted and new concrete has been poured. He stated they are proposing 14 parking spaces that will need tol be striped. He stated this would be the first project utilizing our reuse provisions. He stated with the adoption of the UDO in April there was a provision added to allow for nonconforming sites to be reused. He stated they are proposing to close three or four curb cuts to allow for one main entrance. He stated they are proposing Type A buffer shrubs along the rear of the property and smaller shrubs along Rose Ave. He stated one part of the reuse provision is to allow for planter boxes to be used for 367Page, Minute Book 7 screening when planting is not feasible. He stated the LUP focus on improving traffic flow to promote safety. He Mayor Seaford asked if the use is tire, repair and auto sales. Mr. Gover stated the primary use is repair, light mechanical and tire replacement, but there is a small vehicle display area for auto sales. Mayor Seaford asked how many bays are located at the front. Mr. Gover stated there are three bays and there is a vacant apartment above the shop. Mayor Seaford asked if the apartment would be rented out. Mr. Gover stated the applicant has not indicated if Mr. Stroud stated when he hears tire shop, he envisions stacks of old tires sitting outside the building. He asked if we have any provisions to stop that from happening. Mr. Gover stated yes, the town can enforce that through our general nuisance authority. He stated our town code is clear enough to not allow the storage of tires outside a Mr. Heggins stated with auto repair businesses sometimes a vehicle will sit a long time before being repaired. Mr. Gover stated with auto shops vehicles tend to accumulate but with our ordinance we can address the issue ifi it Mr. Bringle stated one thing that happens at repair shops is thej job is completed and the owner cannot afford to pay for the repairs. He stated those vehicles tend to sit on thel lot. Hes stated the mechanic or the auto shop owner can take He stated he has been in City Planning over 35 years and Mrs. Rodriguez was referred to him by some engineers from Kannapolis. He stated he has worked closely with the applicant and Mr. Gover. He stated Mrs. Rodriguez has been agreeable to everything that has been suggested. He stated he has revised the plan from the Staff and Planning Board comments. He stated from his understanding the primary use will be vehicle repairs and then if they have vehicles that are not paid for after the repairs, they would go through the process to sale those vehicles. Mr. Phillips stated at the Planning Board he understood the intend of the repair business was to get the vehicles ready for sale. He stated he is not clear on ift the majority of the business will be repairs to vehicles for resale or just repairs to customer vehicles. Mr. Young stated iti is his understanding that the business will be sales and service. He Mr. Phillips asked if they will be performing body work. Mr. Young stated they don't intend to do body work on vehicles. Mr. Phillips asked if the repair work would be done inside the building or outside. Mr. Young stated the Mr. Phillips asked where the vehicles would be plaçed fors sale. Mr. Young stated the vehicles for sale will be on the Mr. Phillips asked what the hours of operation will be. Mr. Young stated he is not certain but knows it is typical businesses hours. He stated the applicant does know that late night operation is prohibited. He stated if the hours Mr. Bringle stated limiting hours may be something that the Council should consider. He stated especially with the residential area directly behind. Mr. Stroud stated he would like to place a dusk until dawn or an 8:00 am - 6:00 pm Mr. Phillips stated he would like to place a condition that all repair work has to be done inside the building. Mr. Heggins stated some work cannot be done inside the building. Mr. Heggins seconded the motion, which carried unanimously. Mr. Phillips made a motion to approve the Finding of Facts that this use meets all required conditions and specifications due to the fact the proposed site plan meets the minimum standards of the UDO and has been approved by the China Grove Planning Board and NCDOT will require a Driveway Permit. Mr. Heggins seconded Mr. Phillips made a motion to approve the Finding of Facts that this use will not substantially injure the value of adjoining or abutting property unless the use is a public necessity due to the fact that no material evidence has been presented that this development will affect the property values of adjoining or abutting properties. Mr. Stroud Mr. Phillips made a motion to approve thel Finding of Facts that the location and character of the use, if developed according to the plan as submitted and approved, will be in harmony with the area in which it is to be located and will be in general conformity with the: adopted land use plans and other plans for physical development of the China Grove area as adopted by the Town Council due to the fact that this project is located in along US 29 Corridor, a major thoroughfare and fulfills the following strategies of the China Grove Land Use Plan and US 29 Corridor Plan: Future Land Use Plan 5.2A-3 Encourage. a mix of housing types and compatible uses, 5.2B-1 Promote walkability and minimize traffic congestion, 5.2C-3 Promote effective screening, US 29 Corridor Plan Access Management by reducing conflict points, and Landscaping by providing a variety of options. Mr. Bringle seconded the Mrs. Sellers stated she would like to discuss changes to current events and addition of new events. She stated she has already set the dates for the events that do not change for 2023. She stated the events that need to be discussed are ap potential Snow Day, the Cruising the Grove series, Fall Movie in thel Park and al Fall event. She stated potential days for a Snow Day are. January 21S and February II"h. She stated we have a credit on file with Zippy Ice that was paid for by a corporate sponsor since 2018 of $8,000.00. She stated we have not been able to use this credit since 2018 and the price has increased for the sledding hill. She stated she would recommend pivoting this into a new event at the Community Building. She stated the town could offer Hot Chocolate and crafts along with the snow. Mr. Bringle asked if there would be sledding at this event. Mrs. Sellers stated the sledding that we had in the past requires no more than an inch of rain up to three weeks before the event and temperatures below 50 degrees up to three weeks prior to the event. She stated also the price has increased by $3,800.00 for the same length of sledding Mrs. Sellers stated she implemented a survey at the last Cruising the Grove. She said this was given out to the participants and available online. She stated one of the questions was in what months would the participants want to attend Cruise Ins. She stated most people suggested April, May, September and October. She stated last year the Cruise Ins were held in April, June, August and October. She stated it was noted that the. June and August Cruise Ins Mayor Seaford asked if having the Cruise Ins in back to back months would affect town staff any. Mrs. Sellers Mrs. Sellers stated participants asked for food trucks, vendors in Hanna Park and themed Cruise Ins. Mr. Phillips asked if any of the merchants have indicated if they were affected by the Cruise Ins in a negative or positive way. Mrs. Sellers stated she has heard both negative and positive feedback. Mrs. Sellers stated she is proposing moving the Old-Fashioned Evening and Tractor Parade to Friday and there has been discussion about adding the night time entertainment back on Saturday night. Mrs. Sellers stated the Fall Nights in China Grove movie is based in our town. She suggested the addition of a Fall Movie in the Park event at the Community Building. She stated potential dates are September 29th or September Mrs. Sellers stated the opportunity for al Fall event and to partner with the Board of Trade. She suggested holding a truck or treat at the October Cruise In. She stated a costume contest could still be held at Hanna Park. She stated Mr. Bringle asked Mrs. Sellers to email a reminder to all the Council and staff when an event coming up. Mayor Seaford asked the Council and Town Manager toj join Walk with the Mayor on January 15, 2023 at 3:00 pm. He stated the group will walk from Town Hall to Main Street Market and back. COUNCIL OPDATES citizen question and answer session. 370Page, Minute Book 7 OLD BUSINESS I) Discussion on Non-profit funding Mrs. Sheets stated we started last December discussing funding for Non-Profits. She stated we have received one application from Main Street Market Place. She asked if the Council is going to give any funds to this Non-Profit. Mayor Seaford stated these funds are meant for bettering our community and the Main Street Market Place does a Mrs. Sheets made a motion to award $35,000 to the Main Street Market Place. Being no second the motion failed. Mrs. Sheets stated shei is very disappointed that the Council will not support al local non-profit. Mr. Stroud stated there is no question they do a good job and he supports them. Hes stated with the expense the Town isf facing, he does not believe giving a non- profit funds would impact the community as a whole. He stated the Town Mrs. Sheets stated in the past money has been budgeted for non-profits and this year no money was budgeted. She Mr. Bringle stated the Council has an obligation but he does not see it being $35,000.00. He asked the Council to lot for the town and for the community. He stated they are asking for $35,000. has an opportunity to fulfill al lot of capital items the Town has needed for years. stated al lot of towns have supported the non-profits in their towns. look and see what we could contribute, but he is not comfortable giving $35,000.00. OTHER BUSINESS I) Discussion on 911 South Main Street Mrs. Sheets made a motion to table this discussion until January based on a motion made in April, by the Council to table this discussion until thel Main Street Corridor Study being complete. She stated the: area 911 South Main Street isin was included in the study. She stated in October the Council signed a resolution to support the Downtown Revitalization Grant that the' Town applied for. She stated the Town will find out if they will receive funds from this grant midDecember. Mr. Stroud seconded the motion, which carried unanimously. Houston, Lecturer in Public Law and Government North Carolina Sheriffs' Association Vehicle Procurement Program The UNC School of Government has been asked to render an opinion about the legality of purchasing law enforcement vehicles directly through the North Carolina Sheriffs' Association Vehicle Procurement Program ("the NCSA Program") under the group purchasing program exception to competitive bidding requirements under North Carolina General Statute 143-129(e)(3). The following opinion is not a recommendation for or endorsement of the products or services offered through the NCSA Program. Under North Carolina law, when a local government subject to Article 8, Chapter 143 oft the North Carolina General Statutes decides to purchase apparatus, supplies, materials, or equipment: involving the expenditure of $30,000 or more, that local government: must follow certain statutory bidding procedures unless an exception applies. G.S. 143-129 contains several exceptions to thesel bidding requirements. Oneofthesee exceptions, found in G.S.143- 129(e)(3), allows local governments to purchase apparatus, supplies, materials, or equipment through a' "competitive bidding group purchasing program" instead off following the bidding requirements of Article 8. G.S. 143-129(e)(3) defines a "competitive bidding group purchasing program" as "a formally organized program that offers competitively obtained purchasing services at discount prices to two or more public agencies." In my opinion, the NCSA Program qualifies as a competitive bidding group purchasing program Accordingly, local governments subject to Article 8, Chapter 143 of the North Carolina General Statutes have the legal authority to purchase vehicles directly from vendors under contract through the NCSA Program under the group purchasing program exception in G.S. 143-129(e)(3), unless such purchases are: inconsistent with local policies or procedures. An analysis of the NCSA Program under the group purchasing program exception follows. In order to qualify as a group purchasing program under G.S. 143-129(e)(3), the entity offering products and services must be "formally organized." While the statute does not define this term, it suggests some level of organization beyond an ad hoc group that decides under G.S. 143-129(e)(3). Formally Organized. Program NC Sheriffs' Association Opinion Memorandum August 27,2015 Page 2 to enter into contracts jointly. The North Carolina Sheriffs' Association is a nonprofit organization formed in 1922. According to the NCSA website Wwww.ncsherifs:org), the organization is governed by al board ofdirectors, has an office, contactinformation, and staff. Competitively Obtained Purchasing Services Under the group purchasing exception, the items and services offered must be "competitively obtained," meaning the organization's contracts were procured through a competitive process. While this process does not have to mirror in every respect the competitive bidding requirements of G.S. 143-129 for purchase contracts in the formal bidding range, it must ensure a reasonable opportunity for interested vendors tol be notified ofand submit bids with fair evaluation oft those bids leadingt to a contract award. The vehicle contracts available through the NCSA Program are entered into by the NCSA after broadly disseminated advertising (including through the North Carolina Bid Network), a pre-bid conference, and receipt of sealed bids by an advertised bid deadline. Bids were evaluated and awarded based on the lowest, responsive, responsible bidder standard ofa award. Inmy opinion, this process meets the statutory requirement that the contracts be obtained competitively. (See NCSA website for specificbid-related documents). Discount Prices A third element of the group purchasing program exception is that the prices offered by vendors must be discounted. Typically such discounts take the form ofaj price less than list price, although this is not specifically required under the group purchasing program exception. The competitive bid prices received by the NCSA and the contracts awarded contain competitive discount pricing, thus satisfying this requirement of the statute. This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement may be modified or amended, if the amendment is made in writing and is signed by both parties. 9. Severability. If any provisions of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable.
