TOWN OF BERMUDA RUN AN ORDINANCE TO REGULATE THE OPERATIONS OF GOLF CARTS WITHIN' THE CORPORATE LIMITS ON' TOWN STREETS AND ROADS AS AUTHORIZED PURSUANT TO NORTH CAROLINA GENERAL STATUTE 160A-300.6 WHEREAS, pursuant tol North Carolina General Statute 160A-300.6, the Town of Bermuda Run is authorized, by ordinance, to regulate the operations of golfc carts as defined inj North Carolina General Statute 20-4.01(12a), on any public street, road, or highway where the speed limit is 35 miles] per hour or less within it municipal limits or on any property owned or leased by the city; and WHEREAS, the Town Council ofthe Town of Bermuda Run has taken into full consideration the recommendation ofTown Staff and Legal Counsel to regulate the operation of golfo carts within the corporate limits on town streets and roads; and WHEREAS, the Town Council has concluded and! hereby declares that it is in the NOW,THEREFORE, BE IT ORDAINED by the Town Council ofthe Town Iti is unlawful to operate a golf cart on a public street or road within the Town of public interest to regulate the operations of golfcarts; ofBermuda Run that; Bermuda Run unless the following requirements are: met: 1. requirements below: The golf cart may only be operated on streets and roads that meet the (a) Golfcarts may not be operated on or alongside a public road or (b) Golfcarts may not operate on or alongside USI HWY 158 within street with a posted speed limit greater than thirty-five (35) miles per hour. the corporate limits, or on or alongside NC: HWY 801 within the corporate limits, or on ora alongside Yadkin Valley Road within the corporate limits, or on or alongside Interstate 40 within the corporate limits. Golfc carts must be operated on Town Streets and roads in accordance with all the applicable state and local laws and ordinances, including all laws, regulations and ordinances pertaining to the possession and use of alcoholic beverages. 9. Golf carts must have the basic equipment supplied by the manufacturer, including a vehicle identification or serial number. Rear view or side view mirrors are required. Lights are: required ifthe vehicle is to be operated at any time other than daylight hours, as provided in Section (7). 10. Golf carts may only be operated on Town streets and roads in the corporate limits when the purpose for such travel is for transport to and from a destination, play on a golfcourse ini the corporate limits, or licensed drivers employed by the golf course. 11. Enforcement. Violation oft the provisions ofthis ordinance shall constitute ani infraction, the maximum penalty for which shall be fifty ($50.00) dollars. Notwithstanding the foregoing, persons who, while driving golf carts on public streets within the Town, violate the "Rules oft the Road" applicable to motor vehicles generally (as set forth in Part 10 oft the N.C.G.S.
