Village of Cedar Rock May 16,2023. Minutes The regular meeting of the Village of Cedar Rock was held at Cedar Rock Country Club at 11:30 a.m. on Attendance: Present were Mayor Bob Floyd, Ernie McAteer, Bill Griffin, Howard Edwards, and Mike Shows. Pamela Mayberry was: not able to attend. Call to Order: Mayor Bob Floyd called the meeting to order at 11:39 a.m. Adoption of Agenda: Howard Edwards made a motion to adopt the agenda; Ernie McAteer seconded the Approval of Minutes: Bill Griffin made a motion to approve the minutes; Howard Edwards seconded the Committee Reports: Administrative: No report. Bob Floyd informed the board that the hourly rate for security patrols would be increasing to $40.00 in the next fiscal year. Finance: Bill Griffin presented financials. Assets currently total $598,240.72. Mr. Griffin noted an overage inl leaf pick-upo of $4,060.00. Mr. Griffin noted that this could be due to multiple invoices from Tyler Sime. Howard Edwards made a motion to move $5,000 from snow-removal to leaf pick-up to cover the overage; Mike Shows seconded the motion; motion carries. Bill Griffin stated that he would request an itemized list from Tyler Sime for thei invoices. Transportation: Ernie McAteer was joined by ownership and: staff from Caseyslandscaping. Casey provided a quote of $10,000 to cut back brush and limbs from the right-of-ways throughout the entire village. Ernie McAteer shared that the village is currently paying $5,000.00 every other year for a less extensive trim, and that Casey's services were al better value. Howard Edwards voiced concern over worker's compensation insurance coverage for vendors hired by the Village. Mr. Edwards stated that the Village does not carry Workers Compensation coverage, and all contractors need to carry their own to protect the Village from liability. The representative from Casey's Landscaping stated that he would provide his insurance policy for review. Code Enforcement: Mike Shows deferred to the staff report and Daniel Odom's items for discussion pertaining to code enforcement. Planning Board: No report. ARP New Business: Republic Services MRF Recycle Summit: Bob Floyd introduced the Republic Services MRF Recycle Summit to Counci and suggested that it would be an event for Daniel Odom to attend. Request for Speed Control: The Village received a request for speed control from the residents of 2814 Lakeview Drive. Mr. Floyd noted that this was a recurring issue and: requested that Council revisit the possibility of purchasing a speed radar camera. Mr. Floyd asked that Daniel Odom present an exhaustive traffic Old Business: Village Emergency Notification System: Staff from Caldwell County presented CivicPlus, the county's new Emergency Management notification software, to the Village Council. The new notification system is called CivicReady, andi it replaces CodeRed. Caldwell Emergency Management Staff informed the Council that the software allows sub accounts tol be originated, allowing the Village to send official emergency notifications to Village Citizens, at no cost to the Village. However, Caldwell County Staff did encourage the use of discretion in sending notifications. Thej primary barrier to the effectiveness of the system is citizen enrollment. Citizens must sign themselves up to receive notifications. Caldwell County Staff encouraged the Village to assign two administrators. Mayor Floyd proposed thei idea of Mrs. McClinton serving as an administrator. Mr. McClinton stated that a kickoff party may help with citizen Staff Report: Daniel Odom distributed his report for the months of May and April. Mr. Odom shared that aj prior zoning complaint on Rockwood Circle had been investigated and resolved with both property owners understanding the zoning ordinance and agreeing to abide by it. Mr. Odom presented. a report on right-of-way ownership in the Village. Mr. Odom shared that, in typical cases, a municipality does motion: agenda adopted. motion; minutes approved. Report: Howard Edwards forwarded the. ARP: report to Council prior to thei meeting. camera option list at the next Council meeting. enrollment. not own the right-of-way area in fee simple, they instead own a right-of-way easement, which allows access, but does not render the municipality responsible for the maintenance of underlying property. However, the Village of Cedar Rock owns the rights-of-way drawn in the development plans by Hibriten Development in fee simple. Mr. Odom shared that he had been in discussions with Ben Mount, an Attorney with the North Carolina League of Municipalities, and presented the recommendations made by Mr. Mount, including the liability associated with outright ownership of this property. Mr. Odom recommended that the Village seek legal counsel regarding thei issue. Mr. Floyd stated that while thei issue did require attention, the Village had owned these rights-of-way for some time and thei issue should be handled with caution and discretion. Mr. Shows stated that further complaints received on the issue should bel handled with discretion as well. Public Comment: Noj public comments.
