Agenda Meeting Minutes Council Member Chris. Fowler made ai motion to approve the December 17,2019 Agenda. Meeting minutes. Council Member Curtis Capps seconded tbe motion. The motion was approved by a vote off five (5) inj favor and none opposed. 4. Citizens Comments - Scott Sexton presented his Cancer Services fundraising project to the Council where people would ride bikes thtough the gated community after getting sponsors. No money was requested from the Town. He said that the event would be held on August 29 and that a website, or a link via the Cancer Services website would be provided. Traffic control has been addressed, as well as insurance for the participants. The Country Club is also involved and plans to set up refreshments after the event. Resident interaction is encouraged and the Mayor also stated that this could be very meaningful in the efforts to build community. 5. Items for Consideration A. ZTA2020-01Usesi in Gateway Corridor Overlay Thej purpose oft this proposed text amendment is to clarify that the underlying zoning district shall dictate uses rather than an overlay district. The Planning Board unanimously agteed that the change needs to be made. The Town Council will need to vote to hold a public hearing on March 10, 2020 at 6:00pm to allow the opportunity for public comment on the proposed text amendment to the Council Member Mike. Ernst made a motion to bold a Public Hearing on tbe proposed text amendment at tbe March 10, 2020 Council. Meeting. Council Member. Ken. Peacock seconded. the motion. Agreement: Davie County Economic Development Proposed agreement allows the' Town of Bermuda Run to. have the' Town Manager and Mayor to each be members oft the Davie County Economic Development Board. Funding to the EDCis determined by the percentage oft tax base, based on audited financial statements as ofJune 30 for each applicable fiscal year. The calculation for the Town of Bermuda Run for fiscal year ending. June 30, 2019: is $43,688.46. The Council agreed that iti is in the' Town's best interest to have a seat at the table (the Town Manager and Mayor would have seats on the board oft the EDC). Council Member Curtis Capps made ai motion for Town Manager. Lee Rollins to include tbej fnding cost in tbe proposed. 2020-2021 Budget, and for the Town. Manager and Mayor to commumicate with Tery Bralley/l EDC on tbe Council's desire toj participate. Council Member Chris Fowler. seconded the motion. Appointment(s) Due to Ken Peacock's appointment to the' Town Council, his position on the Planning Board. is now vacant. Included for review are options for appointment the Town Council may consider. The motion was manimously approved. D. Review of] January Council Planning Session Mayor Rick Cross gave a review oft the Planning Session held: in February. He and the Town Manager have met with Boards at Bermuda Village, where ai major concern was the speed limit on Hwy 801 and the danger of pulling out from the 801 Gate; and Kinderton Village where ai main concern was people parking vehicles on the street. He also plans to coordinate with Caroline Moser at the Davie Chamber and develop ai new way to communicate with area businesses. E. Continuation of Brian Williams Serving as Town Attorney Attorney Brian Williams has represented the Town of Bermuda Run since 2005. He has worked with Martin & Van Hoy since 1999 and has decided to go out on his own with another Attorney, Tammy Fleming forming Fleming and Williams, Attorneys at. Law. He has asked the' Town to consider keeping him as their Attorney, with Hank Van Hoy as his Assistant. Council. Member Mike Emst made tbe motion for Brian Williams to continue to be tbe Town's Attorney with. Hank Van Hoy as tbe. Assistant. Council Member. Ken Peacock seconded the motion. Council/Mayor Comments Mike Erst - Thinks that the Council needs to take al look at existing Ordinances in regard to the appearance ofhouses in order to address four houses inj particular that he hears complaints about (that are: noti in an HOA). Note - The Town Manager has asked for theses addresses and the bullet points on what he feels is in violation. Then, he will have the Code Enforcement. Agency with which the Town has a contract to Ken. Peacock - Complimented the Town Manager on the trees that were planted along Hwy. 801, saying that Heather Coleman - The guys working on the East Davie Sewer Project have done a great job. They have Curtis Capps- - Questioned what kind ofi inquiry would cause the catch in the error causing the zoning text amendment. *Town Manager Lee Rollins shared that it was regatding the 5-acre tract: near Calvary West. Mayor Rick Cmoss- - Shared that he met with SheriffJ.D. Hartman and had a tour oft the Davie County Sheriffs Department (that will be moving to thel building formerly Boyle's Furniture on Farmington Rd.) He also reminded the Council that one-stop early voting will be going on at' Town Hall through Saturday, Feb. 29, and that voting for the Primaty Election on Tuesday, March 3 will be at the assigned polling place (ex. Hillsdale Baptist for Bermuda Run residents). He urged Council tol keep talking to folks regarding the upcoming Census and thei importance of participating 7. Town Manager Comments - Shared a situation along Lybrook where a resident (the HOA President) put upaf fence without getting a zoning permit that was noti made of approved materials, and was too high. He shared possible solutions to this problem, saying that there were several other residents that had planned to put up the same unapproved fence. 8. Adjourn With no firther business, Council.
