Citizen Comments  Mary Dixon of120: Kilbourne Drive - Spoke in opposition oft the conditional rezoning request by Homes Lennie Ring of 125. Kilbourne Drive - Opposed to rezoning request. Would rather have patio homes, Mark Pfundstein of155 Brookstone Drive - Asked that the Council respect what the people of] Kinderton  Urban saying that the "legacy of the' Town" is up to the Council.  condos = not high-density apartments.  Village are saying - the rezoning request is not in line with the Town.  6. Closed Session  PerNNC General. Statute 143-318.11(40) Council Member Mike Brannon moved that the Council go into closed. session to consult with the Town Attorney to preserve the attorney-ckient privilege betveen the attorney and public body, which privilege is bereby acknowledged. Council Member Melinda Szeliga seconded the motion. The motion was approved by a vote offuve (in  favor and none opposed.  7. Call to Order-] Re-Open Meeting  Council Member Mike Brannon made a motion to come out ofClosed Session with Coumcil Member Curtis Cqpps. seconding  the motion. The motion was qpproved by a vote offve (5) inj favor and mone opposed. 8. Resolution of Intent to close Peachtree Lane Ext. (Winmock Road)  The Town of Bermuda Run received a request from Ariston Place LLC to permanently close Peachtree Lane Ext. (Winmock Road) as part oft the. Ariston development project. The Davie County Enterprise failed to publish the notice in the August 17,2022 edition, thereby nullifying the 4-week consecutive publishing requirements set by NC GS 160A-299. The Town Council should re-adopt the Resolution as presented to declare its intent to close the street (Peachtree Lane Ext. (Winmock Road), and call for a Public  Hearing on the question of September 27.    Council Member Mike Brannon made a motion tos set aj public bearing on tbe matter on. September 27. Homes Urban Zoning Map Amendment 2022-04  RLM Development, LLC (Homes Urban) has applied to rezone: a 19-acre portion ofa tract of] land totaling approximately 64.7: acres from Commercial Mixed (CM), Yadkin River Watershed (WS-IV) to Village Mixed Conditional District, WS-IV Yadkin River Watershed (VM, WS-IV). The subject property is behind 196 and 1901 NC Hwy 801 N and is further described as a portion of parcel of the Davie County Tax map The Planning Board at its August 17: meeting voted 5-1 for a recommendation to deny the request. The first available date for the public hearing to bel held is at the Tuesday, September 13 Town Council Meeting. Council Member Melinda. Sgeliga made a motion to. set the Public. Curtis Capps-T Thanked everyone in attendance. with speeding and underage drivers of golf carts.  Mike Ernst-1 New Manager of Bermuda Run Country Club wants to: meet with Counci/Town Staff. Spoke of issues ofl landscaping vehicles and blind spots for drivers on town streets. Brought up issues Mayor Rick Cross- Thanked all for attendance. Spoke of signs around town and at intersections/zoning:  policies regarding signs. Reminded all of the concert Saturday night.    12.
