Chairman Luth called the meeting to order at 9:01 a.m. II. Pledge of Allegiance III. Executive Session (Quarterly Legal Update) Vice Chairman Natt with a second from Secretary Radzikinas made a motion to enter into Executive Session at 9:03 a.m. Motion carried unanimously. Attorney Jaugstetter presented a legal update to the Board. Vice Chairman Natt with a second from Member Thalimer made a motion to come out of Executive Session at 9:13 a.m. Motion carried unanimously. Vice Chairman stated no decisions were made or votes taken. V. Adoption of Minutes A. Regular meeting of May 7, 2024 Vice Chairman Natt with a second from Assistant Secretary Tucker made a motion to approve the minutes as prepared by staff. Motion carried unanimously. B. Called meeting of May 21, 2024 Vice Chairman Natt with a second from Member Thalimer made a motion to approve the minutes as prepared by staff. Motion carried unanimously. C. Called meeting of May 28, 2024 Vice Chairman Natt with a second from Assistant Secretary Tucker made a motion to approve the minutes as prepared by staff. Motion carried unanimously. VI. Public Comments Director Smith read the rules regarding public comment. Vice Chairman Natt asked whether the Board of Commissioners (BOC) starts the clock when the individual states their name or after they state their name. Chairman Luth said the BOC does start the clock when the individual starts speaking. Old Business A. 2024 budget update due to legislative changes Director Smith said included in the Director's Report is the amount of unused ballot paper we have which is approximately 200,000 sheets. She said ballot Assistant Secretary Tucker said there will be a cost to destroy the ballot paper. Director Smith said we are waiting on instruction from the Secretary of State's paper is $.13 per sheet sO the value is $25,000. Office regarding the unused ballot paper. Vice Chairman Natt asked Director Smith if the required dots per inch on images included in HB 974 will have an impact on this year's budget. Director Smith said Vice Chairman Natt asked if the recent changes in legislation will impact the 2024 budget. Director Smith said since we do not have a runoff we are okay with Vice Chairman Natt asked Director Smith to keep the board apprised each month the state has not provided direction on that issue. our budget. of any information regarding the ballot paper. B. 2025 budget Director Smith reported she met with the Finance Committee on May 22 and no changes were made to the preliminary budget. She said the preliminary budget includes two full time positions that will be traded for 2 part time positions. Director Smith stated the budget does include two statewide elections. C.F Recap of May 21, 2024 General Primary and Nonpartisan General Election Director Smith reported that we are completing the remaining paperwork for the Vice Chairman Natt stated there was a lower percentage of people that voted in Chairman Luth stated there is always a higher number of people who vote in a D. Qualifying for the office will be held at the Elections Office July 1a and 2 from 9 a.m.to 4:30 p.m. and July 3 from 9 a.m. to 12 p.m. Director Smith said candidates qualifying for this position are required to submit a nominating petition at the time of qualifying with signatures of at least 25 qualified electors from the county. Director Smith stated the Board will need to call the election. Assistant Secretary Tucker asked Director Smith if there will be a vote review panel since it is a nonpartisan race. Director Smith said there will be a vote Vice Chairman Natt with a second from Secretary Radzikinas made a motion to call the special election on November 5, 2024 to fill the vacancy of the Upper Chattahoochee River Soil and Water District Supervisor. Motion carried review panel. unanimously. Attorney Pachuta said there is a code section in the Agricultural Code that states the candidate with a majority of the votes cast wins the election unless there is a tie. VIII. New Business A. Discussion of November 5, 2024 General Election and Special Elections 1. SPLOST IX Director Smith stated the Board will be calling the special election for SPLOST IX. There will be a special called meeting on or before July 23 Attorney Pachuta said Ken Jarrard and the County Manager will be meeting with the City of Cumming. She said she would send a timeline Vice Chairman Natt with a second from Member Thalimer made a motion to request the county manager's presence during the meeting to call the SPLOST IX election. B. Legislative review Vice Chairman Natt stated there are five bills that affect the election code. Most of the bills take effect on July 1. Attorney Pachuta said she would prepare a Vice Chairman Natt asked Attorney Pachuta about lines 70-75 in HB 974 regarding the risk-limiting audit. Attorney Pachuta stated currently the law allows for a 10% risk that an incorrect outcome is not detected in the risk-limiting audit. The bill would change it to 5% by 2028. Per the change outlined in HB 974, all ballot paper used after July 1, 2024 is required to have a visible watermark security feature. As of today, the Secretary of State (SOS) has not indicated there will be any sort of buyback or trade option. The current and expected cost of the ballot paper is $0.13 per page.
