Duluth MINUTES SPECIAL CALLED MEETING MAYOR AND COUNCIL CITY OF DULUTH, GA JUNE - 17, 2024 Present: Mayor Whitlock, Councilmembers Harkness, Thomas, Graeder, and Holloway, City Manager, Assistant City Managers, City Attorney Absent: Councilmember Doss Mayor Whitlock called the meeting to order at 5:30pm. I. PUBLIC HEARING 1. UPDATED FEE SCHEDULE FOR PERMITS [AJ Mayor Whitlock announced that this public hearing was being continued from the June 10, 2024, council meeting and called forward Aron Hall, Community Development and Engineering Deputy Director to present. Mr. Hall reported that House Bill (HB) 461 passed on May 6, 2024, requiring among other things, that local governments cap certain regulatory fees for renovation and other construction projects. This change in Georgia law is set to take effect on July1,2024. Mr. Hall presented the remaining revisions and the adjusted fee schedule to include changes required by HB 461. Mayor Whitlock called for discussion from Council. Mr. Hall responded to questions concerning comparison of the old and new rates as well as how the electrical re-connection fees would be charged. Mayor Whitlock called for questions/comments from the public. Being no comments, Mayor Whitlock closed the public hearing and called for a motion. A motion was made by Councilmember Thomas, seconded by Councilmember Graeder, to approve ordinance 02024-31 for the revision of the permit fee schedule as presented. Motion carried. APPROVAL OF ARPA SEWER CONTRACTS (B,C,D) In2 2021, the City entered into an Intergovernmental Agreement (IGA) with Gwinnett County fori mplementation of two sewer projects within the City of Duluth. Accordingly, the County asked the City to approve the construction bids for the two projects. Community Development and Engineering Director Margie Pozin presented the locations of the projects and addressed numerous questions Ar motion was made by Councilmember Graeder, seconded by Councilmember Harkness, to approve Pinecrest Sewer Project, Part 1, Part 2 Engineer Directed work items, and Part 3 Alternatelas well as the Hill Sewer Project Parts-1,2, by Council. and3 as presented. ORDINANCE TO AMEND FY24 BUDGET-913791926-ARPASEWER Assistant City Manager/Finance Redevelopment Director Ken Sakmar presented the budget amendment to fund the construction of the Pinecrest and Hill Community sewer projects. Overall project cost is $13,791,926, funded froma a variety of sources, including American Rescue Plan Act (ARPA), 20095PLOST Sewer Funds, 2023 SPLOST Sewer Funds, 2023 SPLOSTTransportaton 11 funds, and The Intergovernmental Agreement (IGA) calls for Gwinnett County to award and administer the construction contract. The IGA: stipulates Duluth will pay 50% of the construction cost, less Gwinnett County's contribution of $1,100,000 within thirty days of awarding the construction contract and the remaining 50% upon project Staff requested approval of a budget amendment for CD-62, to add $13,791,926to Water/Sewer Improvements - New Sewer Services - ntergovernmenta. Mayor Whitlock thanked the Public Works staff, City staff and Councilmembers who volunteered Saturday, June 15th at the Annual Cleanup Day. He stated that approximately 600 cars came through filling one 40-yard and nine 30-yard dumpsters, along with over 27 paint crates. 2. Councilmember Graeder reported that he was accepted to 2024/2025 3. Economic Development will be the focus of discussion for the Strategic Planning Conference scheduled for Thursday, June 20, 2024.
