NEWBUSINESS MINUTES OF THE EFFINGHAM COUNTY PLANNING BOARD WORKSHOP - May 15, 2024" Discussion of an amendment to the Code of Ordinances - Public Discussion (1): ORDINANCE REVISION: Part II-C Official Code: Appendix C-Article II -Section 3.17- 3.17A-Ponds oft the Effingham County Code of Ordinances. Ms. Samantha Easton presented this item explaining revisions made including: 1. Thej pond must be 50 feet from the house or any other dwelling on the property. 2. When aj pond should go before the Planning Board, Board of Commissioners, or staff level approval. 3. Ponds still must adhere to certain buffer ordinances. The board members asked for clarification on which ponds go before staff and which come Mr. Peter Higgins asked the county engineer if ponds really affect the water table and before the board. hydraulics ofa well. He suggested that the ordinance include the exclusion of Mr. Ryan Thompson and other members asked for clarification on the difference between the Ms. Samantha Easton stated that ift the pond is preexisting to the house the house will have to be 50: feet from the pond and ift the pond is constructed after the house, then it can't be within Mr. Ryan Thompson suggested that should read excavation for construction of a new pond shall not be closer than 100: feet to any existing dwelling or right of way. Then the location of the proposed dwelling should not be closer than 50: feet to any existing pond. Mr. Steve Candler presented this item and explained the revisions made: 1. Each zoning district will be minimal, and it will refer to the table of permitted uses. A 2. He agrees that PD shouldn't be used to get around minimum standards. Mr. Steve Candler discussed cluster development. The board discussed the PD and what is should or should not encompass. Mr. Alana Zipperer stated he thinks PD should be ai mix ofhousing types ift there is no Mr. Ryan Thompson feels there should be areas where mixed usei is allowed without a PD. Without a PD there would be a lot more variances for lot widths. He suggested possibly using Mr. Steve Candler asked the board to think about what they would like to see in a PD to proposed commercial.
