ORDINANCE NO.21-4 AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE TOWNSHIP OF HANOVER, COUNTY OF NORTHAMPTON, COMMONWEALTHE OF PENNSYLVANIA TO. AMEND THE CODE OF ORDINANCES BY AMENDING CHAPTER 172 VEHICLES AND' TRAFFIC; ARTICLE. II SPEED LIMITS TO ALLOW FOR CERTAIN SPEED LIMITS ON ROADWAYS WITHINTHETOWNSHIP. WHEREAS, The Supervisors of] Hanover' Township, Northampton County, Pennsylvania, under the powers vested in them by the Second Class Township Code" of Pennsylvania as well as other laws ofthe Commonwealth of Pennsylvania, do hereby enact and ordain the following amendment to the text ofthe Hanover Township Code ofCodified Ordinances; WHEREAS, the Board of Supervisors of Hanover Township desire to amend its Code of Codified Ordinances by providing for speed limits on roadways within the Township. NOW, THEREFORE, be it enacted and ordained by the Board of Supervisors of Hanover Township, Northampton County, Pennsylvania, and the same is hereby ordained and enacted as follows, to wit: SECTION1: Chaptèr 172 Vehicles and Traffic; Article II Speed Limits; Section 172-32 Establishment of Speed Limit is deleted in its entirety and replaced as follows: "The maximum. speed limits ini this ordinance have been established according to 75 Pa.C.S.A Sections 3362 and 3363 based upon Statutory Speed Limits for urban districts and residential districts or Engineering Studies in accordance with Pennsylvania Department of Transportation Publication 212, Official Traffic Control Devices. NOW, THEREFORE, bei it enacted and ordained by the Board of Supervisors of Hanover Township, Northampton: County, Pennsylvania, and the same is hereby ordained and enacted as follows, to wit: SECTION1. Chapter 82 Fireworks; Section 82-11 Consumer fireworks; conditions of use Subsection B. Dates and times of use is deleted in its entirety and replaced as follows: "B. Dates and times of use. (1) Consumer Fireworks cannot be ignited or discharged in the Township, except during the following dates and times: (a) Memorial Day, 6:00 P.M. to 10:00 P.M. (b) July 3, 6:00 P.M. to 10:00 P.M. (c). July 4, 6:00 P.M. to 10:00 P.M. (d). July 5, 6:00. P.M. to 10:00 P.M. (e)Labor] Day, 6:00 P.M. to 10:00 P.M. (f). December 31, 6:00. P.M. to 11:59 P.M. (g). January 1, 12:00 AM to 12:30 AM (h). January 1, 6:001 P.M. to 10:00 P.M. (2) The use of Consumer Fireworks is strictly prohibited at all other times." SECTION: 2. Chapter 82 Fireworks; Section 82-12, Enforcement; violations and penalties, Subsection B is deleted in its entirety and replaced as follows: "B. Any person, partnership, association, corporation, or any other legal entity established under the laws ofthe Commonwealth ofPennsylvania who violates this Chapter or any property owner who allows any person, partnership, association, corporation, or any other legal entity established under the laws of the Commonwealth of Pennsylvania to violate the provisions ofthis Chapter on their property shall, upon conviction thereof, be sentenced to pay a fine of $500 for ai first offense, $750 for a second offense, and $1,000 for a third and all subsequent offenses, plus the costs of prosecution." SECTION3. SEVERABILITY Ifany section, clause, provision, or portion oft this Ordinance shall be held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect any other section, clause, provision, or portion of this Ordinance. SECTION3. REPEALER All Ordinances and parts of Ordinances inconsistent herewith be and the same arel hereby repealed. SECTION 4.
