RESOLUTION21-22 WHEREAS, Ordinance 11-02, Section 172-75.B ofthe' Township of] Hanover, Northampton County allows for the establishment ofa a schedule of fees for towing and/or storage ofvehicles pursuant to the provisions of Article VIIT Towing of the Township ofHanover Code ofOrdinances, as from time to time may be amended by resolution of the Board of Supervisors of the Township ofHanover, Northampton County; and WHEREAS, in keeping with good practice, the Board of Supervisors oft the Township of Hanover, Northampton County periodically receives the schedule off fèes fori towing and/or storage and makes appropriate revisions and/or modifications. NOW, THEREFORE, BE. RESOLVED, and it is resolved and enacted that the Schedule as set forth on. Exhibit "A"attached hereto is established for fees for towing and/or storage shall become effective January 1, 2022. That any resolution, or part ofi resolution, inconsistent with the Resolution be and the same is hereby repealed' insofar as the same affects the matters contained in this Resolution. Ini the absence ofa development on Lot 11,Jaind! Land Company has undertaken the installation of those improvements. However, due toj passage oftime, an additional stormwater management facility is required to meet new Jaindl Land Company recently applied tol Hanover' Township for a Grading Permit to complete the previously approved frontage improvements and a newi infiltration basin to manage stormwater: runoff volume. During their review oft the Grading Permit application, Hanover Engineering Associates, Inc. identified a potential conflict between PADEP design requirements and the Hanover Township Stormwater Management Ordinance. Since the NPDES Permit has already been issued, we coordinated with Hanover Engineering Associates, Inc. and determined PADEP requirements for an NPDES Permit (only). that a waiver was an appropriate course ofaction. Finnigan, Jr. October 20, 2021 Therefore, on behalf of our client, Jaindl Land Company, we: respectfully request that the Board of Supervisors consider granting relief from the following section oft the Stormwater Management Ordinance: 1. SMO 152-10.I(4) and (9) requires the proposed infiltration basin to be lined witha a synthetic impervious liner. The applicant requests a Waiver from this requirement because al BMP oft this nature must rely on infiltration into the soils below to meet PADEP regulations. Due to the limited scope oft these roadway widening improvements and because no development is proposed at this time, alternative BMPs are not considered feasible (such as a spray irrigation system). Additionally, we. note that ifLot 11 is developed, the infiltration facility willl likely be removed, and runoff will be managed onsite by the overall Lot 11 stormwater management facilities. However, the project Geotechnical Engineer has provided adequate soil testing information required by the Township ordinance as ift thel basin were to remain permanent and to confirm that all DEP guidelines are met for loading rates to ensure long-term geotechnical stability. We understand that waivers from the Stormwater Management Ordinance may be approved directly by the Board of Supervisors. We anticipate that this request could be on the Board of Supervisors agenda as early as Tuesday, November 9th. Please let us know if an appearance at a Planning Commission meeting is required.
