The Board of Supervisors oft the Township shall establish, by Resolution, the annual criteria that must be met to qualify for credits under the (1) Thei number of] Emergency Response Calls to which a Volunteer responds; (2) Thel level oftraining and participation in formal training and drills fora (3) Thei total amount oftime expended by a Volunteer on administrative and B. C. Eligible Entities. The Volunteer Service Credit Program is available toi residents of the Township who are Volunteers oft the Hanover' Township Volunteer Fire Company #1 of] Northampton County (the "Volunteer Fire Company"). Eligibility Period. A Volunteer must meet the minimum criteria, set by Resolution under this Section, during the eligibility period to qualify for the tax credits D. established under $$163-82 and 163-83. (1) For 2023, the eligibility period under the Volunteer Service Credit Program shall runi from the effective date of Ordinance No. 23- until December31, 2023; and (2) Fore each subsequent year thereafter, the eligibility period shall run Recordkeeping. The chiefoft the Volunteer Fire Company shalll keep specific records of each Volunteer's activities in a: service log to establish credits under the Volunteer Service Credit Program. Service logs shall be subject to review by the Board of Supervisors oft the Township, the State Fire Commissioners and the State Auditor General. The chief, or supervisor, shall annually transmit tot the Township a notarized eligibility list ofall Volunteers that have met thei minimum criteria for the Volunteer Service Credit Program. The notarized eligibility list shall bet transmitted tot the Township no later than forty-five (45) days prior to the date the tax notices are sent each year. The chief or supervisor shall post thei notarized eligibility list in an Application. Volunteers that have: met the minimum criteria oft the Volunteer Service Credit Program shall sign and submit an application for certification to their chief or supervisor. The chief or supervisors shall sign the application ift the Volunteer) has met the minimum criteria oft the Volunteer Service Credit Program, and forward it to the Township Manager oft the Township. Applications shall not be from January 1st until December 31s!. E. accessible area ofthe Volunteer Fire Company's facilities. F. accepted by the Township after April 1st ofeachy year. G. Municipal Review. The Township Manager oft the Township shall review the application for credit under the Volunteer Service Credit Program and shall cross reference them with the notarized eligibility list. The Board of Supervisors ofthe Township shall approve all applicants that are ont the notarized eligibility list. All applicants approved by the Board of Supervisors oft the Township shall bei issued a tax credit certificate by the' Township Manager ofthe Township. H. Official' Tax Credit Register. The Township shall keep an official Tax Credit Register ofa all Active Volunteers that were: issued tax credit certificates. The Township Manager shall issue updates, as needed, ofthe official Tax Credit Register to the following: (1) Board of Supervisors oft the Township; (2) Chiefoft the Volunteer Fire Company; and (3) Tax Collector for the Township. I. Injured Volunteers. (1) An Active Volunteer thati isi injured during an emergency response call may be eligible for future tax credits. Thei injury must have occurred while responding to, participating in, or returning from an emergency response call with the entity listed under $163-81.C. (2) An injured Active Volunteer shall provide documentation from al licensed physician with the application required under $163-81.E., along with updated documentation from a licensed physician stating that the injury still exists and prevents them from qualifying as an. Active Volunteer. The injured Active Volunteer shall again be deemed an. Active Volunteer fort that tax year. An injured Active Volunteer shall only be deemed an Active Volunteer for ai maximum of five (5) consecutive tax years. (3) An injured Active Volunteer shall annually submit the application required under $163-81.F., along with updated documentation from al licensed physician stating that thei injury still exists and prevents them from qualifying as an. Active Volunteer. Thei injured Active Volunteer shall again be deemed an Active Volunteer for that tax year. An injured. Each Active Volunteer who has been certified under the Township Volunteer Service Credit Program shall be eligible to receive a real property tax credit of % ofthe Township tax liability on qualified real property (the "Tax Credit"). Ift the tax is paid in the penalty period, the tax credit shall only apply to the base tax year liability. B. Claim. (1). An Active Volunteer with a Tax Credit certificate may file a claim for the Tax Credit on their qualified real property tax liability fort the Township's s real estate tax levy. The Tax Credit shall be administered as a refund by the Township treasurer. An Active Volunteer shall file the following with the Township Manager (a) A true and correct receipt from the Township real estate tax collector ofthe paid township real property taxes for the tax year which the claim is being filed. (b) The Tax credit Certificate. (c) Photo identification. this ordinance. (d) Documentation that the tax paid was for qualified real property as defined in (2) Ift the Active Volunteer provides all documents required under this subsection, the Township treasurer shall issue the tax refund to the active volunteer. C.Rejection of the' Tax Credit Claim. (1) The Township Manager shall reject the claim for a township real property Tax Credit ifthe taxpayer fails to provide the documents required under subsection (B)(1). (2) Ift the Township Manager rejects the claim, the taxpayer shall be notified in writing of the decision. B. This exclusive license shall have an initial term of five (5) years ("Initial Term") and shall automatically renew for successive periods of one (1) year (the "Extended Term(s)") unless either party notifies the other, in writing, at least sixty (60) days prior to the end oft the then Initial Term or Extended Term(s). C. CRPC agrees to indemnify and hold harmless the Township against any claims, actions, judgments or losses due to the CRPC use of the Vehicles pursuant to the terms oft this Agreement. 3. Miscellaneous. A. Binding on Successors and Assigns. This Agreement shall be binding upon and inure to the benefit of the parties, their respective heirs, executors, administrators, successors and assigns. B. Choice of Law. This Agreement shall be governed and construed pursuant to Pennsylvania law without regard to conflicts of law principles. Jurisdiction of any dispute hereunder shall lie in Northampton County Court of Common Pleas. C. D. Captions and Headings. The captions and headings herein are for Severability. If any provision of this Agreement is held to be ineffective, convenience and reference only and have no legal force. unenforceable or illegal for any reason, any or all of the remaining provisions hereof shall remain in full force and effect. writing signed by the parties.
