OLD BUSINESS Mr. Fonzi advised the board that Leader Properties Plaza, the one next to the Dentistry at the corner of Carpenter and State Route 30, submitted a second time waiver today that would be valid through the end of April. There are certain things with this site that will change with the intersection improvement with Penn DOT. There have been some sketches that have been seen and Mr. Leader is going to call a scoping meeting with Penn DOT to get more details before going 143 February 5,2 2024 further with his project. Mr. Fonzi stated it has not gone away; it has just been extended for the second time. He anticipates seeing it within the next two months, but if another extension needs to be made, we will do that. Mr. Kerber asked if there was a limit on how many extensions can be granted. Mr. Fonzi stated there are: no. hard rules, they are. just granted for 90-day periods, one at a time per the MPC. We try to work with developers. We have had plans extended for years. NEW BUSINESS S-01-2024: Marks Consolidation 2 This is al lot consolidation located at the end of Moore Drive where it turns into Johnson Avenue in Sheridan Terrace. Anthony and Sue Marks currently own vacant lots 11&12. They would like to consolidate these two lots in order to construct a metal pole building. After the consolidation, the lot will be 0.424 acres in size. There is no minimum size requirement for Industrial lots. There are a couple labeling errors on the plan, but once the surveyor corrects these issues, Ican recommend the plan for approval with no conditions. Mr. Fonzi spoke to the surveyor, Richard Bourg, who made all of the corrections right away. Mr. Fonzi stated he has consolidated on a neighboring lot previously, and this will be his third building in this area. These lots are unique because they are surrounded on all 4 sides by right of ways, which pushes his setbacks in, essentially making it unbuildable. In the past Mr. Marks has gone to the ZHB to get the variance in order to build on this property. This is his first step to consolidate these lots. Motion Carried: 7 - 0-0. 144 February 5,2024 S-02-2024: Itle Subdivision 2 This is a subdivision located on Center Highway near the border with Irwin Borough. Wendell H. Stone Company Inc. out of Connellsville, PA currently owns Lot 2 from the first Itle subdivision which was recorded in December of 2018. This lot is 2.046 acres in size and contains two The building located at 10320 is a contracting company and the larger building at 10316 is the showroom for Stoney's Kitchen and Bath. The owner would like to subdivide SO that each building isoni its own lot. No new development is proposed andi NHTMAI has verified that each building has its own sewer tap. However, an easement must be provided on Lot 2A to accommodate the After the subdivision, Lot 2A with the showroom will be 1.733 acres while Lot 2B with the contracting office will be 0.174 acres in size. Therei is no minimum lot size in the C-1 district. The only concern, Mr. Fonzi and the Sewage Authority had, was providing the easement for the lateral. There are no additional sewage Mr. McHugh asked if they have enough room to get around the building, if the Mr. Fonzi stated that was one of they changes they had to make. They weren't providing the required 20 foot rear yard set back. They were only providing thirteen feet. There is actually an access easement on the other side of the building. In the C-1 district there are no side setbacks. The property line could Mr. Cross asked if the owners of the showroom would have the right to use that access easement, because right now the driveway runs between the two Mr. Fonzi stated that would have to be a separate issue they would have to work out with a private easement. Mr. Fonzi stated he owns the lot now, sO he is not going to short himself of access with the other lot through the driveway, even though he would have access through the (shown) frontage here.
