He states he has numerous calls and emails trying to get] help and Rich Albert helped him more than anybody. He states a lot of damage to landscaping and homes has been done already. He admits he originally refused an easement to replace the entire section ofj pipe. All he is asking is for someone to help him. Director Albert states this is a good project to do as the water has impacted Mr. Hebrank and neighbors property. However, going onto private property without an easement: is not] possible. Commissioner Gass thanks Director Albert for assisting on St. Clair Drive. Commissioner Atwood thanks the crews: for installing a sign requested by a resident and are very happy. PARKS REPORT Commissioner Atwood states that Director Miller has retired after fifteen years of service and thanks him. for his service. POLICE REPORT Chief Rizzo states the Junior Police Academy is going on right now and thanks Circleville, Larimer, Fairmont Hahntown VFD'sand: Rescue 8 forl helping to cool the kids down with spraying water on them. Commissioner Hempel thanks ChiefRizzo: for providing activities like this for the kids in the community. EMERGENCY MANAGEMENT REPORT There are no Board comments. ENGINEERING REPORT Commissioner Gray asks what the violation on Williams Lane was. Mr. Grabiak states the resident brought in fill without aj permit and also put stone down. Commissioner Haigis states he would be in favor ofr more acreage, but ift this gets it done, he will support it. Apex Energy for parcel ID#54-11-00-0-113. Motion: Commissioner Haigis Second: Commissioner Zona Motion to approve. Commissioner Hempel states he was hoping to look at this a little further. He states he is on the Board with the Municipal Authority, and it was approved based on the recommendation of the solicitor, but after further investigation this sounds to him that Apex Energy is pushing this on the Board to approve by the end of. June. He feels further negotiations should be had and to wait: for another month. Commissioner Zona states he feels. there should be no waiting for another month and the Board should either vote yes or no. Marcellus Shale fracking is not new and has been around for a long time and. he would vote yes for this. Commissioner Gray states his biggest reservation with this is a process error and was notified two days before the Work Session about this gas lease that the Board had not seen and had no idea where the property was, how big and not enough information to even consider.it. He feels the Board should have met in Executive Session to discuss further and get professional advice on the terms of the lease and not at aj public meeting. He knows that six acres is not a big deal, but also asked about the two leases at Oak Hollow Park and Braddocks Trail Park but got no response. Commissioner Gray fully supports Commissioner Hempel's request to table thel lease and do a furtherin-depthi investigation. He asks Solicitor. Alexander what would happenifthel Board does not sin thel lease and Apex Energy drills anyway because the wells are already drilled. Solicitor Alexander states he does not know ifitis an artificial deadline ori ifit is aj possibility the lease could be lost. Commissioner Gray states due diligence and following processes that have already been established should be done before the vote.
