Eligible offenders are defined in 42 Pa. C.S. 9802. County Intermediate Punishment Programs are restrictive conditions of probation, 42 Pa. C.S. 9804. GOALS AND OBJECTIVES The following are the goals and objectives oft the Fayette County IP Program: 1. Protect society and promote efficiency and economy in the delivery of 2. RESPONSIBILITY The Fayette County Prison Board, through the IPP coordinator (chief fadult probation officer or designee), is responsible for maintaining the IPP plan and for Page2of31 establishing policy governing the direction of IPP in the county, in accordance with 42 Pa. C.S. 9806. The supervisor of the IPP unit, under the direction of the chief adult probation officer, is responsible for administering the IP programs, for supervising employees responsible for delivery of the IPP services, for coordinating IP programs with the criminal justice advisory board (CJAB) and other judicial and criminal justice organizations, and for reporting results of the IP program monthly and quarterly to the prison board. The chief adult probation officer or designee and the Fayette County Controller's Office are responsible for supervision of all fiscal affairs associated with the program. PUBLICINPORMATION AND EDUCATION PROGRAMS The IPP coordinator (chief adult probation officer) and the IPP supervisor will coordinate all public information and education programs. These individuals are responsible for providing information through the criminal justice advisory board, prison board, news releases and presentations to civic groups and colleges, seminars with the Fayette County Bar Association, the Fayette County Re-Entry Coalition, and other criminal justice agencies, and television or other news presentations. TRAINING PROGRAMS The adult probation and parole department, through the IPP coordinator (chief adult probation Officer) and the IPP supervisor, is responsible for coordinating all training programs for the criminal justice advisory board, prison board, the court and staff. These individuals will keep the court advised of the extent and availability of services and programs provided under the IPP plan. The IPP coordinator (chief adult probation officer) and the IPP supervisor will consult with the Pennsylvania Commission on Crime and Delinquency (PCCD), Fayette County Criminal Justice Advisory Board and all participants in the local criminal justice system to determine which areas require training and which personnel are proficient enough to conduct that training. In addition, probation and parole staff will be trained through vendors (E.G. BI Incorporated), PCCD, the Commonwealth of Pennsylvania Commission on Sentencing, the Pennsylvania Board of Probation and Parole, the Pennsylvania Association of Probation, Parole and Corrections, and other available sources. Page 3 of31 ADVISING THE COURT OF SERVICES The court is advised of IP programs through dissemination of information at judges' criminal justice advisory board meetings, monthly prison board meetings, and other individual meetings, memoranda, written communication, periodic training and an annual court report. SENTENCING 1. Court Sentencing Procedures/Programs The Fayette County Court of Common Pleas is authorized by statue and through approval of existing IP programs to sentence offenders to the following and use the following sentencing alternatives: A. Accelerated Rehabilitative Disposition (ARD) ARD is a pretrial divisionary program for first time offenders before going to trial for the pending offense. The offender is not convicted. Criminal charges are deferred until completion of ARD. IfARD is successfully completed, charges can be expunged (unless the case involved one of the ineligible offenses to be expunged). The maximum time to participate in ARD is up to two (2) years. B. Probation Without Verdict (PWV) PWV is available for a first-time nonviolent drug offender. The court may, without entering a judgement, place the offender on probation fora a specific period of time not to exceed the maximum for the offense. Ifthe offender fulfills the terms and conditions imposed, the court will discharge the offender and dismiss the proceedings. Page 40 of31 C.P Probation Probation is a court imposed sanction that releases a convicted offender in the community under a conditional suspended sentence. Probation is a conditional release. Itcan be revoked if the conditions are not met or if a new crime is committed during the probationary period. If probation is revoked, one of the court's options ist to re-sentence the individual to the intermediate punishment program with the sentencing option of probation with restrictive conditions for a period of time on electronic monitoring with house arrest. D. Fines/Restitution Fines and restitution (when applicable) are generally ordered as a condition of probation, parole, IPP/PRC, ARD, and PWV. However, fines can also be ordered as a stand-alone sentence. E. Total Confinement This sentencing option will impact heavily on county correctional resources by placing the offender in the prison. Such programs as earned time and parole reduce the amount of time served thus reducing the need to expand correctional resources. F. Partial Confinement This sentencing alternative lessens the impact on correctional resources by reducing the time for which the offender must be supervised. These persons are usually placed in the minimum-security section of the prison. Finally, those who work pay a daily fee to the prison depending upon their hourly rate of compensation. NOTE: Parole is the conditional early release from prison, under supervision, after a portion of the sentence has been served and the offender successfully demonstrated conformity to the rules and regulation of the prison environment. Page 5 of31 G. Probation with Restrictive Conditions (PRC) PRCisan alternative to incarceration for nonviolent offenders thus freeing correctional resources for other responsibilities. Fayette County has sentencing authority for several programs of probation with restrictive conditions and restorative sanctions to include house arrest/electronic monitoring. EXISTING PROBATION with RESTRICTIVE CONDITIONS & SERVICES The Fayette County Court of Common Pleas has received authority to sentence qualified offenders to the following IP programs, all of which have metthe guidelines promulgated by the appropriate authority: House Arrest Intensive Supervision Community Service Electronic Monitoring Outpatient Treatment Drug Testing Individual Services Fines HOUSE ARREST/ELECTRONIC MONITORING PROGRAM The Fayette County Prison Board's goal is to efficiently manage the jail population. This PRC sentencing alternative provides judges with a sentence option between probation, which may not adequately sanction the offender, and incarceration which may be too severe under the circumstances. The PRC option of house arrest/electronic monitoring is especially suited for driving under the influence (DUI) offenders who are ordered to mandatory minimum sentences of incarceration, house arrest/electronic monitoring or inpatient treatment. The court may sentence some offenders on extended county sentences to a spilt sentence which includes incarceration at the county. jail followed by a period of court-supervised electronic monitoring. In any PRC sanction, the court should consider public safety, the well-being of the population at large, the degree of supervision of the offender and the cost to the citizens of Fayette County. Page 6of31 Eligibility Eligibility shall be based upon offender's risk to the community, criminal history and amenability to the program model. The district attorney's approval is required. An offender must meet the requirements for an eligible offender as per 42 Pa. C.S. 9802 and 9804. The offender must not have a current conviction or prior conviction in the past ten years for any offense listed as ineligible in that section. An offender should be screened for general eligibility and must undergo a drug and alcohol assessment prior to sentencing. Referrals for PRC will be made by either the counsel for the defendant, the offender (if not represented by counsel), or the district attorney. Upon receiving a tentative plea agreement or trial conviction that shows a person is eligible and will probably be sentenced to PRC staff will verify the proposed residence, criminal history, drug and alcohol history, mental health history, relations, employment information, and financial condition. The investigating officer will notify the court and the district attorney's office if an offender is not eligible for the program and a resentencing hearing will be scheduled. Prior to being placed on probation, with restrictive conditions, the defendant will agree to program conditions by signing the appropriate paperwork. SENTENCING The court sentences an eligible offender to PRCand indicates on the order the length of time on supervision. Sentencing shall be in accordance with 42 Pa. C.S. 9763 and 2154.1. All DUI offenders ordered to PRCV will be placed on house arrest with electronic monitoring or an inpatient treatment program licensed by the Commonwealth of Pennsylvania. All other offenders ordered to PRC will be placed on house arrest/electronic monitoring or a program deemed appropriate by the IPP unit unless otherwise specified by the court. The court may also specify conditions of the PRC sentence on the court order (for example, follow all CRN recommendations). PRC may be ordered in conjunction with other programs such as partial confinement, community service, treatment, fines, Page7of31 restitution, treatment courts, and other individualized services. The court may specifically order a sentence which begins with incarceration and which directs Fayette County Adult Probation and Parole to transfer the offender to electronic monitoring/house arrest after a specified period of time. The split sentence will be specified on the court order. Any offender ordered to a split sentence will serve the remainder of the minimum sentence on house arrest. In order to effectively supervise PRC offenders, the court authorizes the IPP unit to establish general program conditions. These general conditions will be imposed in addition to any specific condition, which the. Judge imposes at the time of sentencing. SUPERVISION Offenders on house arrest/electronic monitoring will be monitored by a twenty- four (24) hour computer monitoring service. Fayette County Adult Probation and Parole will maintain a contract with BI Incorporated for monitoring services for daily coverage of offenders. These services utilize tracking equipment that included the LOC8XT, LOC8, Transdermal Alcohol Detector (TAD) and the Soberlink (SL2). BI, Inc. products and monitoring services are priced in accordance with PA COSTARS. Additional vendor of electronic monitoring services is SCRAM Systems for both GPS equipment and monitoring. The supervising officer establishes a daily schedule for the offender which includes hours of authorized leaves for work, school, treatment, or religious worship which will be given to the monitoring center. The schedule is updated and changed to conform to any changes in the offender's schedule. An alert system has been established with the monitoring center to inform officers of any violations of house arrest. One officer is scheduled after hours and on the weekends to deal with any on call issues that may occur. A second officer may be called, with supervisor approval, if necessary. The Pennsylvania State Police or local police department may be utilized to help out with any apprehension, arrest and commitment of an offender that violates the PRC/house arrest conditions. Direct and collateral contacts will be made to assure compliance and to promote accountability. Page 8 of31 DEFENDANT TARGET POPULATION Any person who is convicted of an offense who otherwise would be sentenced to a county correctional facility, who does not have a present or past pattern of violent behavior and who would otherwise be sentenced to partial or total confinement may be eligible for PRC: sentencing option. The offender must have an approved residence, be employed or actively seeking employment, be enrolled ine duationa/vocational training, receiving treatment and must agree to the conditions of house arrest. The district attorney must approve and the victim, if applicable, must be advised of the situation. VIOLATION PROCEDURES In the case of a minor or technical violation, the IPP unit supervisor will conduct an administrative review and determine whether additional sanctions should be imposed. All major violations will result in a violation procedure with the person eventually having to appear before the sentencingjuage. COST All offenders sentenced to PRC will be charged an initial hookup fee and a daily fee for the length of time that they are on house arrest/electronic monitoring. Also, offenders are required to pay monthly offender supervision fees. Offenders are assessed for their financial means and placed in the appropriate daily rates. The Court can approve indigency from the bench. An indigent fund has been established by the Fayette County Commissioners for qualified individuals who cannot afford the costs and fees. Page 9of31 ADDITIONAL PROGRAMS Sex Offender Supervision and Registration Since December 2012, Fayette County Adult Probation and Parole coordinates efforts to register sex offenders with the Fayette County Booking Center and the Pennsylvania State Police. A number of staff is trained on how to register offenders using the sex offender registration system/equipment including the Livescan Fingerprint System. Since early 2013, there have been specialized sex offender caseloads. Officers who supervise those cases have received and will continue to receive specialized training on how to better supervise sex offenders. These officers work closely with the offenders, their family, treatment providers, office of district attorney, and other law enforcement agencies. Alcohol Highway Safety School The Fayette County Drug and Alcohol Commission, Inc. an independent single county authority, as designated by the Commonwealth of Pennsylvania, administers the Alcohol Highway Safety School. Fayette County Treatment Courts Fayette County has three Treatment Courts: Behavioral Health Treatment Court; Drug Treatment Court; and Veteran's Treatment Court. The goal of these specific treatment courts are to assist participants in staying out of the criminal justice system by addressing underlying causes of the criminal behavior. Participants receive intense supervision, frequent and random drug and alcohol testing, appropriate drug and alcohol treatment and attend monthly court sessions. Fayette County Reentry Coalition COUNTYWIDE CORRECTIONAL SERVICES Fayette County Prison The new/current Fayette County Jail located at 254 McClellandtown Road, Uniontown, PA became fully operational on Wednesday, February 21, 2024, with the transfer of all inmates. The capacity is three hundred thirty (330) inmates with adequate space for special housing needs and inmate programs. This correctional facility replaced the original one located at 12 Court Street, Uniontown, PA which had an inmate capacity of two hundred forty (240). This Fayette County uses Pre-Trial Services, Probation with Restrictive Conditions, Treatment Courts, and onsite Institutional Parole Officer(s) for population control. historical facility was built in 1892. Pre-Trial Services Probation Officer This officer's goal is to supervise non-violent offenders released pending future court proceedings. This includes electronic monitoring pre-trial offenders that are supervised by the adult probation office. The pre-trial officer will also supervise offenders on appeal bond. Pre-Trial Services works closely with both the Fayette County Magisterial District Justice Courts and Court of Common Pleas. 2. Institutional Parole Officer Adult probation officers are assigned to work in the county prison for inmate population control. Institutional parole officers review inmate files, both upon initial intake and during commitment, identifies inmates for bond reduction eligibility, coordination of treatment services, conducts court Ordered Pre-Sentence Interviews, and prepares parole/re-parole plans. Page 12of31 3. Good Time Policy The goal of this program is to assist corrections staff in the maintenance of internal control, to encourage rehabilitation and to prepare inmates for release. Services provided include early release and parole, incentive for good inmate conduct and jail population management. 4.
