MINUTES REGULAR COUNCIL MEETING NOVEMBER 19, 2012 6:30 P.M. PAGE 1 100204 ASSEMBLY Council of the Borough of Tarentum met in regular session on Monday, November 19, 2012, with Councilman President Tim Rapp; Councilman Vice- President Hugh Fox; Councilman Tim Firko; Councilman Eric Carter; Raymond Kerr; Councilman Pete Varos; and Councilman Mike Gutonski. Also present were Mayor Carl Magnetta; Borough Manager William Rossey; Solicitor David Strellec; and Upon motion by Councilman Varos, seconded by Councilman Fox, RESOLVED, this Council approves the Minutes of the Regular Council Meeting of October 15, 2012. All Council members present were in favor and the resolution was adopted. At this point in the meeting, Council invites Chief William Vakulick. RESOLUTION APPROVE MINUTES AUDIENCE PARTICIPATION questions and comments from members of the audience. REMARKS: MS. LANDA Ms. Landa, East 6th Avenue, stated the building in which the public library is housed is being sold and she is concerned that the library may not have a place to go to in the area. She asked if a committee could be formed to help the library find another place to move to in the Borough Manager Rossey stated everyone is concerned about the library and he has spoken to a some business owners who may be interested in buying the building that the library is housed in to try to keep the library in the area. Mr. Cieslinski, First Avenue, stated he is concerned about the power grid and asked when the Borough is going to upgrade it for the lower area. REMARKS: BOROUGH MANAGER ROSSEY REMARKS: MR. CIESLINSKI Borough Manager Rossey stated improvements have been made to the power grid. Mr. Cieslinski stated he is concerned about the rearranging and eliminating of the island on 6th Avenue and narrowing of the streets that emergency vehicles, trucks and buses will have a hard time getting through and making turns. He stated traffic is going to be backed up if Councilman Gutonski stated he wasn't on council when this was discussed and passed. He stated he looked at some of the work being done and he doesn't think it's the greatest idea. He stated he would like to have seen better plans made, but, at this point, it's already been contracted Councilman Rapp stated the Borough was concerned about public safety and that's one of the reasons the work is being done there. It was advertised one to two years ago. There were committees to study the project. He stated meetings were held and very few people showed up and after a while, no one showed up at the meetings. He stated this is what the committee A discussion was held regarding the project, the safety factor and the traffic concerns. Councilman Rapp stated, under President's Comments, on October 23, he attended a parade meeting at Brackenridge with the Recreation Board. PAGE 3 He commended the fire departments and emergency committee for their preparation regarding the storm. He stated on November 6, he attended another Christmas parade meeting. On November 9, attended Tarentum Business Advisory Committee meeting, with Councilman Fox and Mr. Rossey. He stated on November 15, Councilman Fox, Mayor Magnetta, Mr. Rossey and he attended a meeting in Harmar with county representatives. He stated the county representatives indicated the communities who attend the meetings and show an interest will be given priority over the communities who don't attend. He stated on November 17, the Christmas parade was held. Councilman Rapp asked for a report from the Mayor Magnetta stated, for the month of October 2012, there were 322 calls for service which is a minus one from 2011; 41 arrests which is a plus of 12 from 2011; 126 citations issued which is a minus 20 from 2011; 16 total accidents which is a plus of 11 from 2011, nonreportable accidents 13 which is a plus of 6 from 2011 and reportable accidents 3 which is a plus of 3 from 2011, with one injury which is a plus of 1 from 2011; fines collection $4,658.91 which is a minus $442.42 from 2011; fines collected for the year $71,750.60 which is a minus $5,282.40 from 2011; parking tickets issued 14 which is a minus 103 from 2011. He stated due to the PennDOT project, officers are not on the streets issuing traffic tickets and the accidents are up. The project is soon coming to an end. He stated he attended most of the meetings Councilman Rapp mentioned. He stated November 10 he spoke at the Tarentum VFW Brackenridge for the Veteran's Day Program. He stated on November 14, Chief Vakulick and he Mayor. REMARKS: MAYOR MAGNETTA MINUTES REGULAR COUNCIL MEETING NOVEMBER 19, 2012 6:30 P.M. PAGE 4 100207 attended a meeting for the contract regarding the moving of heavy equipment that will be starting the beginning the middle of December for Allegheny Ludlum. The equipment will be moving through from East Deer through Tarentum, Brackenridge and into Harrison. The route will be closed from New Kensington Bridge to Tarentum Bridge. The moving of the equipment will be done from midnight to 7:00 a.m. He stated the Christmas parade was very successful and nearly two hours long. He stated the Borough workers did a great job with the decorations in the park Councilman Rapp asked for a report from the Chief and around town. of Police. REMARKS: COUNCILMAN RAPP REMARKS: CHIEF VAKULICK Chief Vakulick stated the PennDOT project on 366, on Wednesday, traffic will be moved over to the proper lanes. There still will be one lane shut down on each side, but the open lane will be on the proper sides. The project won't be finished for another two weeks at least. He stated the moving of the heavy equipment will begin the second week of December, between midnight and 7:00 a.m. and then about 11:00 a.m., the empty part will be taken down to the docking area at East Deer. It will take about four hours to move it, sO it will affect traffic during the day also. He stated he agrees with Mr. Cieslinski regarding 6th Avenue. He stated the traific is stop and go and there will be problems there. Councilman Rapp asked for a report from the REMARKS: COUNCILMAN RAPP Borough Manager. MINUTES REGULAR COUNCIL MEETING NOVEMBER 19, 2012 6:30 P.M. PAGE 5 100208 REMARKS: BOROUGH MANAGER Borough Manager Rossey stated a copy of the proposed budget has been given to Council for review. The budget includes the increase for healthcare and waiting for quotes from UPMC and Health America. He stated the budget doesn't include a raise in taxes and it worked out well. He stated the Borough is still waiting for the new assessments. He stated if Council has any questions regarding the budget, to call him. He stated the Borough Association membership dinner is on December 13. He stated if anyone is interested in attending, to let him know. He stated the COG dinner is on December 7 and if anyone is interested in attending that dinner, to let him know. The Allegheny League of Municipalities reception will be held January 10, 2013. He stated one of the issues facing the Borough now is the repairing of the Fourth Avenue Bridge in which the cost will be close to a million dollars. He stated with the new gaming funds that was set up for major municipal projects, the Borough can apply for a grant in the amount of half a million dollars and maybe get a match from the state to help with the costs of repairs. He stated the Borough can apply for the grant in the spring. He stated tomorrow night he will be attending a meeting in Monroeville, at 6:30 p.m., for Allegheny County Storm Water Management Program. He stated if anyone is interested in attending, to let him Mayor Magnetta stated the Fourth Avenue Bridge will need. to be closed down to one lane after the first of the year. He stated a lot of companies use that bridge everyday. He stated he contacted Senator Dermody and Representative Doyle regarding the bridge. REMARKS: COUNCILMAN RAPP REMARKS: SOLICITOR STRELLEC Solicitor Strellec stated in January, Council passed a zoning ordinance that attempted to make a provision to allow billboards specifically on Mr. Grim's property, but didn't satisfy the requirements of PennDOT. A Planning Commission was held in the summer and the parts of the ordinance were addressed, the location of a permitted billboard use and to remove the rural resources overlay over the Tarentum Borough property east of Bakerstown Road north of 28 and just keep it on the west side which would encompass the KOZ property. That information was sent to the Allegheny County Planning Division which is part of the Allegheny County Economic Development for review. It was reviewed and in addressing their responses, Mr. Grim's attorney wrote a proposed section of the ordinance. He stated the rectangular shape on the map would be the area zoned Roadway Commercial District and it permits many different things, but basically, it's for billboards. There is no roadway access to the property. In the ordinance, No. 12 of Section B is billboards and basically, that's what this whole section is. A public hearing will be held regarding the ordinance to add a section on billboards and to remove the rural resource overlay. Upon motion by Councilman Kerr, seconded by Councilman Carter, RESOLVED, this Council awards the Riverview Park Decorative Lighting Project to Sternberg Lighting for the purchase of 20 decorative light poles with LED light fixtures, for the bid amount of $30,000.00. Councilman Firko stated the report from Highland Hose Company for the period of October 15 to this date, there were 8 total alarms which consisted of one motor vehicle crash, one odor investigation, 3 automatic fire alarms, 3 structural fires and one mutual aid call to Harrison Township for total man hours of 114. Councilman Carter stated a discussion to give the Upper Allegheny Joint Sewer Authority permission to construct a road at the end of Conwell Street towards the PennDOT culverts to access their Councilman Gutonski stated he spoke with Tim Kuhns who is in charge of this project and the Authority doesn't want a road. The Authority needs to clean out a sewer. PAGE 10 100213 A further discussion was held regarding the sewage bill sent to the Borough, the placing of a meter to monitor the use of water for the spray park and sending representatives of Council to the Sewage Authority meeting to discuss the bill. He thanked all the volunteers who helped make the parade a success. He stated the senior bingo at Dalton's Edge will be held on December 5. Ms. Collins, Main Street, stated she had a neighbor move in a couple years ago which has been an unpleasant situation. She stated charges were filed April 17, 2012 of harassment and disorderly conduct and a hearing was held in which she and her mother attended July 12, 2012. The neighbor did not show up. She stated the officer asked if they would come back another time to a second hearing. A second hearing was 100215 MINUTES REGULAR COUNCIL MEETING NOVEMBER 19, 2012 6:30 P.M. PAGE 12 never scheduled. She stated she's asked numerous times why the hearing was never scheduled and had Chief Vakulick stated that Ms. Collins had been called numerous times, by the arresting officer, and never returned the calls. He stated he received e-mails from Ms. Collins indicating that she and her mother would not attend any further hearings. He stated a hearing was held and the neighbor was found guilty for one of the counts and since Ms. Collins did not appear, those charges were dismissed. The neighbor went to jail and her children were taken off of her. He stated the neighbor has been back about two months and the police have not heard from her. Ms. Collins stated the neighbor is throwing stuff in the yard again and sent an e-mail about it. Chief Vakulick stated Ms. Collins needs to call 911 when it is happening sO an officer can respond at that time. The e-mails are not received until a day or two after it happens. A discussion was held regarding the problems Ms. Collins is having with the neighbor and her Ms. Landa stated the decorative lighting project with LED light fixtures is $30,000 with a $10,000 grant and asked where the $20,000 left will be Borough Manager Rossey stated from the electric no reply.
