FEBRUARY 9, 2010 The February 2010 Council Meeting was held on 02/09/10 in the Penn Lake Community House. The meeting was called to order by President Jill Rosenstock at 7:30 p.m.with the Pledge of Allegiance to the Flag. present. Also present was Mayor Warner. Roll Call: Jill Rosenstock, Barbara Sudimak, Ned McGuire and Jack Kile all The January 2010 were presented and placed on display. A motion to accept the minutes as presented was made by Sudimak and 2nd by Kile, roll call all in favor, none TREASURERS REPORT was presented and accepted by a motion made by Sudimak, 2nd by! McGuire, roll call all in favor none opposed, motion carried. CORRESPONDENCE WAS READ A representative from Pasonick Inc was present to answer questions regarding the UCC ordinance that has been on the table. In general. the UCC will require inspections for construction. As explained this will mostly effect new construction. There are eight pages of exceptions. There is a 180 day waiting period. The general cost for the inspections runs approximately 1% of the total cost of construction. As it stands now individual borough residents are responsible for their own inspections. This practice is difficult to police and ultimately the Borough could be responsible for any construction errors. With enactment of the UCC any construction problems will be the liability oft the contractor not the borough and policed by at third party. Several borough residents were/are opposed to the enactment oft this ordinance and had requested a show ofhands. There was much discussion about the collecting of the fees and how much the Borough would receive which will be approximately: 25% oft total fee. President Rosenstock asked foran motion to Opt In to the UCC which was made by Sudimak, and 2nd by McGuire. All ayes, none opposed motion carried. An motion was made to adopt by Sudimak and 2nd by McGuire to adopt ORDINANCE #1 of2010UCC for the Borough of Penn Lake Park the entire ordinance was read by President Rosenstock All ayes, none opposed, motion carried to adopt Amotion was made to appoint Pasonick, Inc as the Boroughs third party inspector by Ordinance #1 McGuire, 2nd by Kile, all Ayes, none opposed, motion carried. RESOLUTION #11 of2010 was made byl Kile and 2nd by Sudimak to appoint Frank Frank Fritz was swom in by Mayor Bill Wamer and assumed his council seat. RESOLUTION #12 of2010 was made by Sudimak and 2nd by Fritz to fill vacant Zoning Hearing Board seats. Augie Ciulla term to end 12/31/2014 and Rocco Casarella Fritz to the vacant council seat. All ayes, motion carried. (alternate) term to end 12/31/2012. All ayes, motion carried Amotion was made by Fritz and 2nd by Kilei to adopt ORDINANCE #22010 to set Speed Limit at 301 mph from Dennison Twp to Terrace Drive, the Speed Limit in all other areas to be 20 mph. All ayes, none opposed motion carried to adopt Ordinance # 2. UNFINISHED BUSINESS: Attorney Karpovich was unable to attend tonight's meeting SO his response to Jack Glass concerns regarding his sewer hook up has been tabled until March's meeting. The representative from DGK was unable to attend the meeting do to inclement weather. He willl be available at a later date. COMMITTEE REPORTS: Jack Kile-hel has scheduled a meeting with Geo Science about the Dam and attended a Barbara Sudimak- - -met with Chris Huebner regarding water in Boro resident driveway. Will have Borough engineer look into. Regarding ice jam on stream on Lakeview near Ned McGuire-Looking into seeing if Borough can get any grants for the Rails to Trail Storm water meeting with B. Sudimak at LCCC. Perch's will looki into correcting problem when weather permits Jill Rosenstock-will look into why the rates went up with Aqua. project. Frank Fritz-nothing to report Keith Wheeler-zoning officer-not; present Bill Warner- police report will be meeting with White Haven to see ifit will be feasible for the borough toj join with them and is working on the FEMA plan. NEW. BUSINESS: Residents ofTerrace Drive will be receiving a survey via the mail. This is an income survey for grant money. We have received a conditional approval from Community Development for $30,000 towards a comprehensive plan and $57,000 for paving of Requesting the planning commission to rework code ordinances. Borton Lawson will finish out the work recommended by Geo Science in conjunction with DEP Terrace Drive. A motion was madel by Sudimak and 2nd by Kile to appoint Pasonick Engineers, as the Borough Engineer for future work. All ayes, none opposed, motion carried. A motion was made by Fritz and 2nd by McGuire to have the White Haven Journal as the Boroughs paper ofrecord. All Ayes, none opposed, motion carried.
