BOROUGH OF MEYERSDALE Somerset County, Pennsylvania ORDINANCE NUMBER H43 AN ORDINANCE OF THE BOROUGH OF MEYERSDALE, SOMERSET COUNTY, PENNSYLVANIA, VACATING AND ABANDONING A PORTION OF THE RIGHT OF WAY OF A PUBLIC ROAD KNOWN AS 7th AVENUE WEST OF THE INTERSECTION OF 7th AVENUE AND THOMAS STREET, WEST1 TOTHE INTERSECTION OF 7th AVENUE TO THE CASSELMAN RIVER IN THE BOROUGH OF MEYERSDALE, SOMERSET BE IT ORDAINED AND ENACTED, and it is hereby ordained and enacted by the Council of WHEREAS, the Borough of Meyersdale has laid out 7th Avenue as a 20 foot wide: right-of-way WHEREAS, the Borough ofl Meyersdale desires to vacate this portion of7th Avenue from the intersection of 7th Avenue and Thomas Street, West to the intersection of 7th Avenue and the COUNTY, PENNSYLVANIA the Borough of Meyersdale, Somerset County, Pennsylvania as follows: int the DiPasquale Plan ofLots. Casselman River. WHEREAS, this portion of 7th Avenue was never opened. WHEREAS, the Borough of Meyersdale has received a request from the Meyersdale Municipal Authority and the Meyersdale Little League to donate aj portion of 7th Avenue to the Meyersdale WHEREAS, the Meyersdale Little League field has occupied the portion of 7th Avenue from the intersection of 7th Avenue and South. Alley, West to the intersection of Alaska Street and' 7th WHEREAS, the Borough ofl Meyersdale has the authority to vacate by Ordinance the portion of WHEREAS, the portion of 7th Avenue to be closed is not currently accessible by any neighboring property nor: is it the only means for ingress and egress for any abutting landowner. WHEREAS, the Borough ofl Meyersdale has advertised this Ordinance in the newspaper and all Little League. Avenue. Alaska Street under 8 PS section 1731. adjoining landowners were given personal service of the ordinance. WHEREAS, the Borough of Meyersdale Ordains and! Enacts the following: The portion of7 7th. Avenue from the intersection of 7th Avenue and' Thomas Street, West to the intersection of 7th Avenue and the Casselman River is hereby VACATED.
