HOPEWELL TOWNSHIP YORK COUNTY PA BOARD OF SUPERVISORS MINUTES FOR FOR REGULAR MEETING MUNICIPAL BUILDING THURSDAY, DECEMBER 6, 2018 @7PM Chairman Manifold called the December 6, 2018, Board of Supervisors meeting to order at 7:05 p.m. In attendance were Chairman: Aaron R. Manifold, Vice-Chairman: David T. Wisnom, Board Member: John. J. O'Neill, III, Solicitor: Andrew. J. Miller and Treasurer: Katie Miller. The Board of Supervisors held an Executive Session at approximately 6:55 pm to discuss Approval of Minutes: Board Member O'Neill motioned to approve the November 1, 2018, Board of Supervisors minutes. Vice-Chairman Wisnom seconded the motion. Motion carried. Treasurer's Report/Invoices: Vice-Chairman Wisnom motioned to approve the November 30, 2018, Treasurer's Report and previously reviewed invoices listed in the report. seconded the motion. Motion carried. Chairman Manifold motioned to establish the amount of the Treasurer's Bond for 2019, at $2.5 million. Board Member O'Neill seconded the motion. potential litigation with Solicitor Miller O'Neill Motion carried. Roads: Road crew had their first snow of the season and took care of the roads in an exceptional way. State Road Projects for 2019 = See Exhibit "A" for details. Chairman Manifold motioned to accept 2019 State Road Projects as presented in Exhibit "A". Vice-Chairman Wisnom seconded Approval of bid for 1983 John Deere Grader- Chairman Manifold read the bids as listed on Exhibit "B". He noted that Caterpillar also offered $10,000.00 as a trade in. Vice-Chairman Wisnom made the motion to accept the bid from Carlton B. Geesaman Building & Remodeling Inc. for $12,000.00. Board Member O'Neill seconded the motion. Motion carried. It was noted that part of 2019 budget a new grader will be purchased to replace this grader. They also have been trimming trees and preparing for winter. the motion. Motion carried. Page 1 of4 Hopewell Township, / Board of Supervisors December 6, 2018 Solicitor's Report: Tax Rate Resolution; Resolution 11-2018- Chairman Manifold motioned to adopt Resolution 11-2018. Board member O'Neill seconded the motion. Motion carried. It was noted that tax Bond Lane paving - Solicitor Miller drafted a letter to go to parties listed as developers on the subdivision plan for that project regarding the paving the first 30 feet of Bond Lane. Giving them until June 30, 2019 to complete paving or township may pursue action against the developers under Section 22615 of the Subdivision Land Development Ordinance. The letter also demands they post bond for paving within 30 days and that no permits will be issued on the lots until this is taken care of. Solicitor is also going to copy other property owners on the private lane sO they are aware that the township sent letter out. Solicitor Miller warned that the only thing to be careful about is that expectations are not set too high with regards to what the township is going to do moving forward with this. However, Solicitor Miller is hopeful that this will get their attention. Some discussion in past months about Paul Miller and Paul Miller's involvement in this issues. Solicitor Miller did research and noted that Paul Miller posted a bond for paving at a different part of that subdivision. Paul Miller was not involved with the part that Mr. Young was complaining about. Solicitor Miller wanted to confirm that the Board was fine with him sending the proposed letter out. Board Members are fine with the drafted Steve Milchling - Donnie went out to look at what Mr. Milchling wants to do. The Solicitor was asked to prepare an Easement Agreement for pipe along Hrebik Road. Donnie has sent Solicitor Miller an Ariel shot of the location and drew on where pipe is to go. Because there is not a whole lot of room there anyway, Solicitor Miller thought this would be ok. It is typical to have the land owner provide a sketch plan and/or survey plan showing where the pipe is going to be exactly. However in this case Solicitor Miller is ok with the overhead shot and the description of where the pipe is going to be located. Solicitor Miller want to know if the Board was going to require the landowner to get a draftsman or surveyor. Chairman Manifold is fine with the Ariel shot with drawn on location as long as their signatures are on it, accepting the Ariel shot. The easement agreement does reflect that it is a non-exclusive, which basically shows that the township is giving the the right to lay pipe in the public right of way and that the township can do whatever the township wants in that public right-of-way as long as they don't interfere with the pipe. Solicitor included in the agreement an indemnity and release of township to protect Upset tax sale of al lot in Bailey springs. Quite title action now being filed against that land. The solicitor has indicated to the Plaintiffs in the case that the solicitor will accept service on behalf of township. The township is being named because of any outstanding taxes or liens. However the county tax claim bureau has all of the tax money sitting in escrow. Either the sale will be set aside and the former owner will pay that tax money or the tax money will get distributed to township. So the township will get paid for its tax liens on property. Report from the solicitor was that they will accept service and at some point the township will need to respond to agree rates have stayed the same. No increase. letter. the township. Other Business: ACT537-Vice-Chairman Wisnom motioned to have MPL Law Firm send ACT 537 enforcement notices to the outstanding properties in quadrant 1. Board Member O'Neill seconded the 2019 Budget - Chairman Manifold motioned to ratify advertising for proposed 2019 budget. Board member O'Neill seconded the motion. Motion carried. Board member O'Neill motioned to approve the special meeting to be held December 19, 2018 at 7pm for the budget adoption. 2019 Office Holiday -See attached Exhibit "C" for list. Motion carried. Animal control contract for 2019- Two proposals were received. 1. Klugh Animal Control - $400 retainer fee, $18.50 per hour and .70 per mile will be charged for each call and weekend and holiday calls will be charged at $28.00 per hour; 2. Drebushenko Animal Control Services $300 retainer fee; $30 per hour Itwas noted that Klugh has been used in the past with no complaints. Vice-Chairman Wisnom motioned to approve the use of Klugh Animal Control for 2019. Chairman Manifold seconded Public Comment. Ralph Kile of Scarecrow Farm was present to request approval to grow HEMP on his farm. He presented al bag of items that he purchased at the grocery store that is made from HEMP as an example of what can be done with the HEMP. Mr. Kile is looking for ways to expand his business to more than corn and tomatoes. Mr. Kile would also like to negotiate with Naylor Wines to sell wine at his farm. Mr. Kile reflects that an Amish person would assist him in setting this up and provided a name and The board suggested that Manager Smallwood could contract eh PA Dept. of Agriculture first to help determine where Mr. Kile would start. Solicitor Miller provided the number for the Bureau off Plant Ina addition Mr. Kile expressed concern over only having 12 square feet of signage allowed at the end of the road.
