March 3, 2016-) pg. 1 HOPEWELL TOWNSHIP YORK COUNTY PA BOARD OF SUPERVISORS MINUTES FOR MARCH 3, 2016 MUNICIPAL BUILDING 7:00 PM Chairman Aaron Manifold called the March 2016 Board of Supervisors meeting to order at 7:00 p.m. Also in attendance were Supervisor David Wisnom, Supervisor Shannon Wolf, Solicitor Andrew Miller, and Secretary Kristy Spevak. Chairman Manifold stated that an executive session was held March 3, 2016 at 6:15 p.m. to discuss pending litigation No one but the scribe was recording the meeting. Approval of Minutes unanimously. Supervisor Wisnom motioned to approve the February 2016 Board of Supervisors minutes. Chairman Manifold seconded the motion. Motion carried Treasurer's Report/Invoices Supervisor Wolf motioned to approve the February 29, 2016 Treasurer's Report and Invoices. Supervisor Wisnom seconded the motion. Motion carried. Roads Report Chairman Manifold gave an update on the Road Crew. They are continuing to work on cleanup as needed, plowing when necessary, patching potholes, and keeping maintenance up to date on the equipment. The new small dump truck is to arrive in the first week of March. The Road Crew has been trimming trees on Shaw Road in preparation of the widening of the road. They are looking for approval for the state projects. In 2016, it will be West Liberty Road, Hollow Road, Shaw Road & the culvert project on Gemmill Road. Supervisor Wisnom motioned to approve the list of projects. Supervisor Wolf seconded the motion. Motion carried unanimously. Subdivision/Land Development TwoTon Incorporated Joe Gurney from First Capital Engineering and Peter Secklinger from Omni Consulting were present. They are proposing putting a Burger King at the intersection of Wolfe Road and Renaissance Drive. The sketch plan has been submitted. TwoTon previously recorded a plan in 2008. Previously, a bank office building was proposed, and now they are proposing a Burger King. The parking and underground storm water management systems were already built for this area. Everything has been completed except for the building. The NPDES permit was applied for and active back when the project was initially started for the bank. TwoTon is requesting a waiver of the land development process because the project was substantially completed for the 2008 project. Chairman Manifold stated that since the plan was originally sent through the March 3, 2016 - pg. 2 stormwater management has changed drastically. The stormwater in place on the lot now has to do with volume control, not quality control, which was one of the major changes in the stormwater update. Mr. Gurney discussed that there is a stormwater infiltration with a water quality unit in place. Chairman Manifold is not a fan of waiving land development plans especially because they are going from a bankloffice to a restaurant. Supervisor Wolf was also hesitant to waive the land development plan. Chairman Manifold motioned to deny the request of waving the land development plan. Supervisor Wisnom seconded the motion. Motion carried unanimously. Solicitor's Report: Ordinance 2-2016 Solicitor Miller discussed Ordinance 2-2016. These are minor amendments to the Floodplain Ordinance 5-2015 that was adopted in December 2015. Supervisor Wolf motioned to adopt the Ordinance. Supervisor Wisnom seconded the motion. Motion carried unanimously. Codification Project: There is no update at this time. The Township was still waiting on file copies of the Code from Keystone Publishers. Act 537 Enforcement: Five enforcement actions were filed. One had since been settled and pumping notice was received. Lacy Roberts was present from 3703 Cherry Court. She had. recently purchased the property. The previous owners had been deceased for 5 years. The Board decided that Ms. Roberts would have to have her septic system pumped by September 1, 2016, then she will fall back into the previous 4 year schedule. After this year, she will need her septic system pumped in 3 years. Supervisor Wisnom motioned, for this time only, that she be bumped into the current cycle getting her system pumped by September 1, 2016 and to withdraw the magistrate Complaint. Chairman Manifold seconded the motion. Motion carried. Additionally, the Green/Carr property, 15328 Leib School Road, requested that the fees be waived and the Complaint withdrawn as they did have their system pumped in December. Chairman Manifold motioned to withdraw the Complaint for 15328 Leib School Road. Supervisor Wolf seconded the motion. Motion carried. Resolution 4-2016: Resolution 4-2016 is to add Charlotte Onion's property, 20082 Grove Mill Road into Ag Security. Chairman Manifold motioned to adopt the resolution. Supervisor Wolf seconded the motion. Motion carried unanimously. Johnson Controls TIF Calculations: Dan Thornton was present for TRG. TRG requested that the Township provide 3 letters to PennDOT to begin the work on Wolfe Road. One letter was for the reimbursement agreement, one that it will assume control of the bidding process for the project, and one to notify PennDOT that the right of way has been obtained and the utility coordination has been done. Supervisor Wolf motioned March 3, 2016- pg.3 for Chairman Manifold to sign the three letters. Supervisor Wisnom seconded the motion. Motion carried unanimously. Solicitor Miller also stated that the A payment of $16.21 is to be paid over to JCI for Tax Increment Finance (TIF) collected by the Township. Supervisor Wolf motioned to approve payment of$16.21. Chairman Manifold seconded the motion. Motion carried Deeds of Dedication have been recorded. unanimously. 2015 Financial Audit Chairman Manifold received a letter from the auditors regarding some changes to the process of monthly bank reconciliations. The letter also stated certain reports in 2015 were not signed that were supposed to be. The Board stated as a whole that they know they sign the reports monthly, so this is something they need to investigate. No motion. Lions Annual 5k Race The Stewartstown Lion Club requested to close Vineyard, Rinely, Plank and Althouse School Roads using the Eureka Fire Department as needed for their race. Supervisor Wolf motioned to approve the road closing. Supervisor Wisnom seconded the motion. Motion carried unanimously. Public Comment: William Street of 16572 N. Barrens Road asked about Shrewsbury Borough's meeting last month. Chairman Manifold stated that he received the pamphlet and this is the 3rd time that Mr. Buchanan has held Sewer 101. He believes it is to explain his justifications for what Shrewsbury Township does or doesn't do. He believes it is to get rid of rumors and hearsay, but nothing is going to change at this time. William Street also asked if the Township has any plans to rezone anymore ground since the industrial commercial is used up. Chairman Manifold said that they do not have any immediate plans to do SO. Joe Shanabrough of 17895 Pond View Lane mentioned potholes in front of Blevins Fruit Farm at the intersection of Webb and Dolf Roads. Chairman Manifold stated he would look into that.
