Consideration ofar motion to approve a conciliation agreement with the U.S. Department ofHousing and Urban Development. Mr. Moder read the summary and motioned to enter into the Conciliation Agreement with the U. S. Department of Housing and Urban Development. The agreement was based on a complaint made by a group home operator that the Pennsylvania Uniform Construction Code (UCC) requires sprinkler systems to be placed in all group homes in order to obtain a certificate of occupancy. The agreement stipulates that int the event that the state UCC requirements change to no longer require the sprinkler systems the City will honor such changes when they are made. PUBLIC DISCUSSION PatI Lewis, 12 Canal Street, stated that when she was appointed to the Wheatland Borough Council no one came to the meetings SO when the City and Borough merged, she was going to try to attend the meetings. Last month the first few items on the agenda were about Wheatland and that was really a good feeling. As ifall the work they did turned into something wonderful. She said there were sO many people who worked sol hard and SO well together- it was a nice relationship and she wanted to thank everyone involved. Before the merger was complete she only had one complaint about the sewer bill and no complaints about property taxes. Mr. Piccirilli responded that the transition would not have been as smooth without the Wheatland leadership. They played a big part in making (the merger) happen. Regular Meeting Minutes March 27, 2024 Page 5 David Martin, 90 Fairmont Drive, thanked the City for the doing the sewer work last year on Meadowbrook Road. He owns commercial property there and he thought they did al beautiful job. No additional comments were made by the public. Penn State Shenango (PSS) officials approached the City of Hermitage and Hermitage Little League (HLL) to explore a collaboration to retrofit the HLLS Senior Field to accommodate a college- Collaborative level baseball program. PSS launched a men's baseball program attracting 34 new: students with an initial season in 2024. PSS reached an agreement to use Eastwood Field in Niles, Ohio, ini the immediate term, but desires al long-term solution for ai field in Pennsylvania and within proximity toi their campus. An RFP was issued to three engineering firms, with experience in designing college athletic fields, to provide proposals for developing conceptual drawings and an improvement plan with estimated costs for the Senior Field retrofit, and for ar multipurpose building with adequate restroom, concessions, meeting room and storage space. On November 28, the city submitted a grant application through the very competitive LSA - Statewide program to seek funds for the multipurpose building at a cost of approximately $800,000. On February 7. PSS and city officials held a virtual meeting with K8 &WE Engineers, which submitted a proposal in response to the RFP at al low-bid price of $14.900. On March 8, the City applied for a state grant ini the amount of $35.000 to cover engineering and surveying costs. On March 28th ai fully executed Grant Agreement for $35,000 was received and an Invoice for upfront payment of the grant proceeds was submitted. On Aprilg an Agreement with K & W Engineering for planning services was signed, to be paid from grant funds. Mr. Slovesko stated hel had visited the site and asked Mr. Mazzant how many units were planned. Mr. Mazzant replied, ten buildings - twenty units. Mr. Slovesko asked how they would be situated on1 the property. Mr. Mazzant replied, they are tentatively proposing twenty units. The unit parking lot and road will be maintained privately. Mr. Slovesko asked if this will have a buffer on Butterfly Lane. Mr. Mazzant replied, yes. Mr. Stedman stated the Board of Commissioners is not obligated toi follow the recommendations of the Planning Commission but takes the recommendation under advisement. The final vote lies with the Board of Commissioners. Mr. Nogay informed the Planning Commission that a group of residents had tried to handle their concerns by approaching Mr. Mazzant to purchase the property before hel built his home After discussion, there were several points raised by members of the Planning Commission: on Trumpet Terrace and he refused their offer. -Mr. Liburdi stated he understands where they are coming from and their concerns are valid. -Mr. Slovesko stated he feels that a required Land Development Plan could alleviate some of -Ms. Thomas explained that stormwater issues have to be addressed by the Land Development -Mr. Liburdi stated that currently as it stands with the SR1 district, they are already allowed to potentially build ten or more single family homes on this site, with no Land Development Plan -Mr. Steele questioned ift this property abuts Esther Lane. Mr. Mazzant answered, yes, it does -Mr. Scholl stated the change to SR2 would give us more supervision oft the project, not just the issuance ofa building permit and inspections, ifal land development plan is required for concerns of residents and have a positive effect. As per the bid tabulations, the apparent low bidder was! Protech Asphalt Maintenance, Inc. ("Protech"), with a base bid amount of $285,260.66, along with an Alternate #1 bid of $34,408.16. Second was the bid of Youngblood Paving, Inc., in the amount of $293,429.37, along with an Alternate #1 bid of$38,740.61. As Ic completed my final review of the bid documents submitted by Protech, including the bid bond, I noticed that the form Section 00431 14-1 Bid Security, included a bid bond document titled "Bid Surety". The Bid Security form, on page 1 of the Section, was properly executed with an appropriate power of attorney granted by the surety. Unfortunately, the document did not include the amount insured by the document, which was required under the Contract Specifications to be at least ten percent (10%) of the bidder's maximum bid price. See SECTION 002000, page 6 ofthe Specifications. There also was not a separate bid bond form provided by the applicant. Accordingly, upon: my review oft the specifications and the Bid Security form provided by Protech Asphalt Maintenance, Inc., Imust conclude that the bid bond granted by that document does not provide any security to insure that Protech will enter into the contract. Itis well established that failure to conform with ai material requirement of a public competitive bid results in the bid being deemed to be nonresponsive. This is despite the fact I have little doubt the applicant's omission was completely unintentional in this situation. Iam also aware that Protech has been successfully awarded contracts with the City oni numerous occasions in thej past with no issues concerning its bid bonds. The case of Veon V. City of Hermitage, Mercer County No. 2010-2014 (citing R & B Builders, Inc. V. School District of Philadelphia, 202 A.2d 82 (Pa. 1964), appears to be directly on point. As in the Veon matter, there was no alternative basis to conclude that the appropriate amount ofs security had' been posted under the documents submitted by Protech, even though such omission was inadvertent. Accordingly, Pennsylvania law leaves me with no alternative than to conclude that the bid of Protech Asphalt The Section contained a number ofinstructions and requirements oft the bond. Public Hearing and Final Vote on an ordinance amending the structure and duties of the Hermitage Community and Economic Development Commission. It adds four members Motion to appoint those four additional members oft the. ABCs. Two are individuals who participated ini the process to fill a vacancy on the Board of Commissioners. Others are Consideration ofa a motion to adopt the City ofl Hermitage Sexual Harassment and Consideration ofai motion to adopt a Business Integrity Policy. This is required by the State due to our involvement with the Commonwealth and the administration of grants. Consideration ofai motion to approve a conciliation agreement with the U. S. Department ofHousing and Urban Development. This stems from a complaint made by a group home. The agreement states that ift the law should change in the future the City agrees to and additional duties. individuals who have expressed interest for multiple years. Discrimination Policies. allow the change. Mr. Coxe explained that the current solid waste and recycling contract was for services from August 2019 through July 2024. In 2009 the City changed the contract to its existing form with mandated service. Over the past 15 years little tweaks have been made to the program. Residents in Hermitage receive al bill every three months from Tri-County with a base fee of$61.00 for service that includes recycling and yard waste. The average resident has a 95-gallon cart. Tags for additional waste are 95 cents as they have been for the past 15 years. With this upcoming contract they are looking at keeping everything pretty much the same, however, we will probably increase the cost of all the tags. The current $5 tag for bulk items will increase to $10, the white goods tag will increase from $10 to $20 and the volume tag for up to 161 bags will increase. Other neighboring communities have seen a large increase with their recent contracts. The city has reached out to other haulers to encourage them to bid in the hope that there are multiple bidders. Mr. Hinkson commented that they could have an alternate bidj just to see ift there is a significant cost savings to everyone ifb bags are eliminated. Ift this could be out to bid soon the Commissioners could consider awarding the contract at the. April meeting which would give the vendor until August 1St to gear up to provide service. Mr. Coxe added that there are probably not more than 5-10% ofresidents thatj just use bags. Cart prices are $4.50 for a 35-gallon cart and $5.00 for a 95-gallon cart. The largest cost isi in how it is collected, not in how much is being thrown away. Four bags a month would pay for the small cart. Haulers suggested eliminating the bags to keep the process 100% automated - that helps with their workers comp costs. They would have to be on or adjacent to the primary use building; 2.) the fueling stations building footprint could not exceed 5% oft the primary use structure; 3) the canopy for fueling stations could not exceed 5% oft the footprint of the primary structure; and 4.) fueling stations would be limited to 6 dispensers, which would allow for 12 fueling pumps. The second text amendment, in Section 310.20, would be to add multi-family use in the B-2 Zoning District to expand the mixed-use opportunities there. The third amendment, to Section 406.40, would be to add setbacks to Mercer Avenue, Council Avenue, Church Street and Ohio Street in Wheatland and require a 40-foot setback from the street centerline. The fourth amendment, to Section 408.20(A) would be to remove the curbing requirement in zoning districts B1 and RR. This would not remove their responsibility to manage stormwater.
