RESOLUTION NO. 2021-12 BOROUGH OF CLARKS SUMMIT  Al RESOLUTION OF THE BOROUGH OF CLARKS SUMMIT AUTHORIZING ANI INTERGOVERNMENTAL AGREEMENT WITH BOROUGH OF CLARKS GREEN FOR POLICE PROTECTION  WHEREAS, the Borough of Clarks Summit (the "Clarks Summit") is a borough and municipality in the Commonwealth of Pennsylvania organized and governed according to 8  Pa.C.S.A. $ 1101, et seq. known as "the Borough Code"; and  WHEREAS, Section 1203 of the Borough Code authorizes Clarks Summit to make and adopt all ordinances, bylaws, rules and regulations as may be necessary for the maintenance of  peace, good government, safety and welfare oft the Borough; and  WHEREAS, Section 1202(24)ofthe Borough Code empowers Clarks Summit to enterinto agreements with municipal corporations or government entities for the furnishing of police protection to municipal corporations or governmental entities without advertising for bids or  receiving bonds; and  WHEREAS, the Clarks Summit entered an Agreement to Provide Police Protection with the Borough of Clarks Green, Lackawanna County, Pennsylvania ("Clarks Green") on or about November 30, 2016 which requires Clarks Summit's Police Department to provide police  protection to Clarks Green through December 31, 2021; and  WHEREAS, Clarks Green's Borough Council submitted a proposal to Clarks Summit's Borough Council to enter a new Agreement for Police Protection which would commence on January 1, 2022 and expire on December 31, 2026 (A true and correct copy of the Agreement  proposed by Clarks Green is attached hereto as Exhibit"*A"); and  WHEREAS, at aj public meeting held on. June 17,2021, Clarks Summit's Borough Council voted unanimously to accept the terms oft the. Agreement: for Police Protection proposed by Clarks  Green's Council and memorialized in Exhibit "A"; and  WHEREAS, Clarks Summit's Borough Council has determined that iti isi int thel best interest ofClarks Summit to enter into an Agreement for Police Protection with the Clarks Green pursuant  to 8Pa.C.S.A. $ 1202(24).  1    NOW, THEREFORE BE IT RESOLVED, by Clarks Summit's Borough Council as 1. Clarks Summit hereby agrees to enter into the contact attached hereto as Exhibit"A" with Clarks Green which will require the Clarks Summit's Police Department to provide police protection to Clarks Green for a five (5) year period of time, commencing on January 1, 2022 and ending on December 31, 2026. 2. The appropriate officers of Clarks Summit are hereby authorized to executed the agreement attached hereto as Exhibit"*A" on behalfo of Clarks Summit.  follows:  RESOLVED by the Council of the Borough of Clarks Summit this 30th day of June,  2021.
