CLARKS SUMMIT BOROUGH ORDINANCE NO. 2020-06  AN ORDINANCE OF THE BOROUGH OF CLARKS SUMMIT AMENDING ORDINANCE 82-41 DATED JANUARY 6, 1982, AS CODIFIED IN THE CODE OF ORDINANCES, BOROUGH OF CLARKS SUMMIT, CHAPTER 1, PART5. THIS AMENDMENT PROVIDES FOR A SERVICE INCREMENT BENEFIT FOR ELIGIBLE PARTICIPANTS IN THE BOROUGH OF CLARKS SUMMIT POLICE PENSION FUND.  The Clarks Summit Borough Council hereby ordains as follows:  SECTIONI- Service Increment Benefit. Each participant who has attained age 65 and completed 30 or more) years of service and who retires on or before December 31, 2022, shall receive a service increment benefit of $100 per month for each completed year of service in excess of 25 years, up toa a maximum service increment benefit of $500 a month. This service increment benefit shall be payable  inaddition to the monthly benefit payable under the pension benefit formula.  SECTION Il- - All other provisions of the Borough of Clarks Summit Police Pension Fund remain in SECTION III - Repealer. Any Resolution, Ordinance or part of any Ordinance or Resolution inconsistent herewith and any amendments thereof are hereby expressly repealed insofar as they affect  fulli force and effect.  this Ordinance.  SECTION IV- - Severability. If any section, clause, provision or portion of this Ordinance shall be held invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion oft this Ordinance sO long as it remains legally enforceable minus the invalid portion. The Borough reserves the right to amend this Ordinance or any portion thereof from time to time as it shall deem advisable in the best interest of the promotion of the purposes and  intent of this Resolution and the effective administration thereof.  SECTIONV-E Effective Date. This Ordinance shall become effective immediately upon passage. SECTION VI - Authority. This Ordinance is enacted by the Council of the Borough of Clarks Summit under the authority of the Act of Legislature, February 1, 1966, P.L (1965) No. 581 Section 1005, as amended 1979, November 2, P.L. 458 No. 94, 53P.S. Section 46005, et seq., known as the Borough Code and any other applicable law arising under the laws of the Commonwealth of Pennsylvania.  Approved the 4th day of November, 2020.
