BOROUGH OF CLARKS SUMMIT COUNTY OF LACKAWANNA COMMONWEALTH OF PENNSYLVANIA ORDINANCE NO.2 2017-11  AN ORDINANCE TO AMIEND ORDINANCE OFTHE  BOROUGH OF CLARKS SUMMIT PROVIDING FOR THE ESTABLISHMENT AND REGULATION OF A PENSION PLAN FOR. FULL-TIME NON-UNIFORMED EMPLOYEES OFTHE BOROUGH PURSUANTTO THE PROVISIONS OFTHE BOROUGH CODE, ACT OF FEBRUARY1, 1966 (1965 P.L. 1656, NO. 581), ET SEQ. BE. IT HEREBY ORDAINED AND ENACTED by the Borough Council of the Borough of Clarks Summit, Lackawanna County, Pennsylvania by the authority of and pursuant to the. Act of Legislature, February 1, 1966, P.L. (1965) No. 581 Section 1005, as amended 1979, November 2, P.L. 458 No. 94, 53 P.S. Section 46005, et seq., known as the Borough Code and any other applicable law arising under the laws oft the Commonwealth ofl Pennsylvania; that Ordinance No.  AND ACT205 (ORDINANCE: NO. 2001-01)  2001-01 is hereby amended as follows:  Section 6.1 CONTRIBUTIONS OF THE: BOROUGH/EMPLOYER,  The Borough/Employer shall match active Participant's payroll withholding contributions to the Plan at a 1:1 ratio up to and including six percent (6%) of each active Participant's  compensation as defined in section 2.5, effective January 1,2015. Section 6.2 CONTRIBUTIONS OFTHE PARTICIPANTS. An individual active Participant may contribute up to ten percent (10%)of compensation, as defined in section 2.5, into thej plan, through payroll withholding (deduction) election; however, the Employer/Borough shall match only up to and  including six percent (6%) as indicated in Section 6.1.  Repealer. Any Resolution, Ordinance or part ofany Ordinance or Resolution inconsistent herewith and any amendments thereof arel hereby expresslyrepealed insofar as they affect this  Ordinance.    Severability, Ifany section, clause, provision or portion of this Ordinance shall be held invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion oft this Ordinance so long as it remains legally enforceable minus the invalid portion. The Borough of Clarks Summit reserves the right to amend this Ordinance or any portion thereof from time to time as it shall deem advisable in the best interests ofthe promotion oft the purposes and intent of this Ordinance and the effective administration Effective Date.
