CLARKS GREENEOROUGH May 24, 2019 The special meeting of Clarks Green Borough was called to order by President Barrasse and opened with the Pledge of Allegiance. The meeting took place in the Council Chambers at the Clarks Green Borough Building on May 24, 2019 at 4:02 p.m. Present: Mr. Williams Mr. Hughes Ms. Igo Mr. Barrasse Mr. Rinaldi Mayor Lawler Soliciator Weinschank Mr. Dougherty Mr. Toms Absent: Zoning Officer Position Purpose oft the meeting was to fill the vacant position of Zoning Officer. The personal committee met Mr. Williams (Personnel Committee) discussed key points ofthe Personnel Committee Meeting with Mr. George Parker, including his residency, the logistics ofthe position, hourly salary. Mr. Williams forwarded Mr. Parkers resume to the council prior to the meeting for review. Mr. Williams reported that Mr. Parker discussed he would like $25 hours an hour and would work Tuesday and Thursday afternoons (2:00PM to 4:00PM). Mr. Parker also offered that in the event there were no hours during the winter, the borough could tell him they don't need his services during those times and would be available as needed. Mr. Barrasse stated that this could potentially save the borough money. Mr. Barrasse also stated Mr. Parker was in charge of permits for Penn Dot for six (6) counties. Question was brought up about the increase in pay. The previous zoning officer was getting approximately $17.50 and hour for four (4) hours aweek. It was discussed that the increase is appropriate as Mr. Parkeri is a professional engineer and certified surveyor. Question was asked ift they also drive the neighborhoods to see ifthere were any issues. Mr. Barrasse discussed that the job descriptions willl be identical. Mr. Toms asked ifthere were any other applicants, Mr. Hughes stated that in the past they have reviewed previous applicants and Mr. Williams made the motion on behalf of the Personnel committee that Clarks Green Borough appoint Mr. Parker as their zoning officer at the rate of $25/hr. for 4 hours a week, seconded by with the previous applicant, Mr. George Parker. decided to do this again. Mr.I Dougherty, motion carried. Mr. Williams-yes Mr. Toms-No Ms. Igoe-No Mr. Dougherty-Yes Mr. Hughes- Yes Mr. Barrasse- Yes Zoning issues at 304 South Abington Road/Vernard Road. Mr. Barrasse discussed that an estimate was received in the amount of$7,850 by email from the property owner and was forwarded to Mr. Barrasse and Mr. Weinschank. Mr. Toms had questions on the current pad. I Solicitor Weinschank stated set back requirement are for any portion ofa building to be within a required setback. So, the fact that there is a concrete pad or asphalt driveway does not make it not compliant, as Mr. Toms asked if everyone was happy with the estimate and Mr. Barrasse discussed that no one is happy with the figure, but she needed more materials to fix the issue. Mr. Barrasse also discussed that the borough needs to pay to correct the issue, to avoid the lawsuit. Mr. Barrasse mentioned that Borough could potentially get the money back through the insurance carrier. Ms. Lawler asked how the borough would go about filing a claim with no lawsuit Pending. Mr. Barrasse stated it would be an Errors and Omissions claim and possibly still be subjected to a deductible. Ms. Lawler asked who owns the house and it was Sara Cremer, but the house is owned by Dung V.D. Cremer Irrevocable Trust. Mr. Barrasse made a motion to Pay the payment to the permit applicant and the Dung V.D Cremer Irrevocable Trust in the amount of no more than the estimate of$7,859 to fix the zoning issue, payment contingent upon tie property owner signing a release in favor of the borough from any On the question, Mr. Tom' 's discussed the event that the property owner doesn't complete the project and suggested maybe writing the check to the property owner and the construction company. Ms. Igoe stated she doesn't understand the situation. Mr. Barrasse discussed how she would be adding on the slab, long as no portion oft the building or roof don't over hang into the setback its ok. liability and connection to the original permit, seconded by Mr. Hughes. because the slab wasn't the issue, but the garage on it would be. Mr. Williams-Yes Ms. Igoe-Yes Mr. Hughes- Yes Mr. Toms-Yes Mr. Dougherty-Yes Mr. Barrasse- Yes Independent Contractor for the Minutes Mr. Barrasse discussed that he would like to temporarily, in the absence of Joanne and Reenee havinga family emergency, hire an independent contractor to do the minutes ofthe meeting, as needed. Mr. Barrasse discussed that his Assistant Amy Waters, who has previous experience with typing minutes for various organizations such as ARWA offered to help the borough. Mr. Barrasse suggested paying her the Mr. Dougherty made a motion to hire Amy Waters as an Independent Contractor to do Mceting minutes for May and June, as needed at the rate ofs17.50/ryseconded by Mr. Hughes, motion same rate as the others who have filled in. carried. She discussed she doesn'twant the issue on Abington Road to cost the Borough any more than it should, Council Comments: Mr. Tom's discussed the St. Gregory's Church Expansion and in the plans was retention pond. While walking, he noticed a small indentation in the ground. *Note, this small indentation is not the retention 2 pond. * Isi it possible to have our engineers to make sure the pond is constructed appropriately? Mayor Lawler briefly discussed the Parchinski property and if there will be a report by the engineers. President Barrasse would like to have the engineers come to the meeting to discuss their findings. Discussion took place that the actual retention pond will be underground. Public Comment No Public Comment. Old Business County Waste List- Mr. Barrasse stated Ms. Igoe requested a list from County Waste oft the list ofr residents that didn't have accounts. The contact from County Waste couldn't give that list, but did compose al list of active customers. The person who Mr. Early complained about is on the list and Solicitor Weinschank can move forward to respond to Mr. Early accordingly. When the Borough went out to bid there were 626 properties according to the Borough calculation and the County Waste list has 585 accounts. This shows a shortfall of about 40 properties. Some of these can be explained by vacant houses. It was discussed that there are some residents not using the service, but it will take time to identify these residents. Gas Station- On Market for $45,000. The deed to the property is very complicated and restricted. Discussion took place what to do with the property. Mr. Barrasse stated not going to take by eminent domain. Would like to work on getting it into the land bank and obtain the property through a Charitable Organization, Needs a shell company. There are severe restrictions on this property. Mr. Hughes made motion to adjourn, seconded by Mr. Williams, motion unanimously passed at 4:55PM.
