CLARKS GREEN BOROUGH SPECIAL MEETING COUNCIL MINUTES DECEMBER 4,2019 CALL TO ORDER: President Barrasse called the special meeting of the Clarks Green Council to ROLL CALL: President Barrasse conducted roll call. The following were present: Mr. Rinaldi, Mr. Dougherty, Mr. Hughes, Mr. Williams, Mayor Lawler and Solicitor Weinschenk. Mr. Toms joined the order at 6:30 p.m. with the Pledge of Allegiance. meeting at 6:35 P.M. ABSENT: Ms. Igoe. VISITORS: Judy and Ted Parchinski, 228 Fairview Road. PUBLIC COMMENT: Judy Parchinski, 228 Fairview Road offered her thanks to Council and the Mayor for their help in their drainage issue stating the storm drain the Borough installed is working and she then noted how it is difficult dealing with PennDot to get the necessary work needed done. RESOLUTION: NO.30F: 2019: RESOLUTION No.3 of 2019 Borough of Clarks Green Lackawanna County, Pennsylvania A RESOLUTION APPROVING THE SALE OF BOROUGH TRUCK BE IT RESOLVED, that the Borough Council of the Borough of Clarks Green, Lackawanna County, Pennsylvania hereby approves the sale and transfer of the Borough's 1981 International dump truck for $ 3,299.00 which is the highest BE IT FURTHER RESOLVED, that the Borough does hereby designate Joseph Barrasse, President of the Clarks Green Borough Council, as the official authorized to execute all documents and agreements for the sale and transfer THIS RESOLUTION is adopted by the Clarks Green Borough Council this 4th day bid received on munibid.com, a municipal online auction. of the 1981 International dump truck. of December, 2019. RESOLUTION NO. 40F2 2019: RESOLUTION No.4 OF 2019 BOROUGH OF CLARKS GREEN LACKAWANNA COUNTY, PENNSYLVANIA Whereas, the Commonwealth of Pennsylvania, acting through the Pennsylvania Department of Transportation ("PennDOT"), has agreed to install an eighteen inch (18") plastic drainage pipe parallel to Fairview Road (SR 4028) on the left side from the outlet near Vassar Avenue (Segment 0010, Offset 1393) to the inlet near Vassar Avenue (Segment 0010, Offset 1203) in the Borough of Clarks Green (the "Borough") to connect to the Borough's storm water sewer Whereas, the Project is intended to alleviate storm water drainage problems including, but not limited to, flooding, erosion and icing on said segment Whereas, PennDOT requires that the Borough enter into a Drainage Facilities Maintenance Agreement (the "Agreement"), a copy of which is attached hereto as Exhibit "A", which provides that the Borough will be responsible for the maintenance and repair of the drainage facilities installed as part of the Project in accordance with design standards provided by PennDOT; and Whereas, the Borough believes that the Project will benefit residents of the Borough and desires to accept the Agreement and authorize the execution and delivery of the Agreement by the appropriate Officers of the Borough. NOW THEREFORE BE IT RESOLVED, that the Borough of Clarks Green hereby accepts the maintenance Agreement and the maintenance responsibilities associated with the drainage system as outlined in the Agreement. BE IT FURTHER RESOLVED, that the President of the Clarks Green Borough Council and the Borough Secretary or Assistant Secretary are hereby authorized and directed on behalf of the Borough to execute and deliver the THIS RESOLUTION is duly adopted by the affirmative vote of the Clarks Green system (the "Project"); and abutting segments; Agreement. Fairview Road. Solicitor Weinschenk stated the responsibility of cleaning, blockage and the clearing of those drains will be the responsibility of Borough. President Barrasse entertained ai motion toa adopt Resolution No. 4 of2019 Drainage Facilities Maintenance Agreement. Mr. Hughes motioned, seconded by Mr. Dougherty. RESOLUTION NO.50F2 2019: RESOLUTION No.5 OF 2019 BOROUGH OF CLARKS GREEN LACKAWANNA COUNTY, PENNSYLVANIA A RESOLUTION APPROVING COMMONWEALTH FINANCING AUTHORITY GRANT REQUEST WHEREAS, the Borough of Clarks Green (the "Borough"), desires to submit a grant request for funds to repair and replace stormwater drainage within the NOW THEREFORE, BE IT RESOLVED, that the Borough of Clarks Green, Lackawanna County, Pennsylvania hereby requests a Pennsylvania Small Water and Sewer Program grant in the amount of $434,947.50 from the Commonwealth Financing Authority to be used for repair and replacement of Borough owned stormwater drainage facilities in the right-of-way of Pennsylvania State Route 407 in BE IT FURTHER RESOLVED, that the Borough does hereby designate Joseph Barrasse, President of the Clarks Green Borough Council, as the official authorized to execute all documents and agreements between the Borough and the Commonwealth Financing Authority to facilitate and assist in obtaining THIS RESOLUTION is adopted by the Clarks Green Borough Council this 4th day right-of-way of Pennsylvania State Route 407 in the Borough. the Borough. the requested grant. of December, 2019. President Barrasse entertained a motion to adopt Resolution No. 5 of2019 approving Commonwealth Financing Authority Grant Request. Mr. Dougherty motioned, seconded by Mr. Williams. Mr. Rinaldi, Mr. Hughes, Mr. Williams, Mr. Toms, Mr. Dougherty and Mr. Barrasse voted in RATIFYTHE COMMITMENT FOR THE PURCHASE OF TWO (2) TRUCKS UNDER THE 2019 COSTARS CONTRACT: Mr. Barrasse told Council 2019 COSTARS Program ended 11/30/2019 and the 2020 COSTARS Program will start on 12/1/2019 making the cost of the two (2) trucks increase approximately $3,600 total. Mr. Barrasse stated because of the increase he had made a verbal commitment to Gibbons Ford to enter into the COSTARS Contract for 11/30/2019 noting all specifications are the same. Mr. Hughes motioned to ratify the commitment for the purchase of two (2) trucks under the 2019 COSTARS Contract with Gibbons Fords ending November 30, 2019, seconded Mr. Dougherty. On the question, Mr. Rinaldi asked "what are the costs of the two (2) trucks". Mr. Barrasse stated the cost of the two (2) trucks are $49,980.40 for F550 and $44,080.90 for the F350. Mr Barrasse went on to state that outfitting the vehicles with snowplow and other accessory kits will be favor. additional and those additional items and will be purchased separately through Powell's Sales and Service stating Powell's Sales and Service is also a COSTARS vendor. Mr. Rinaldi asked what are the additional costs? Mr. Barrasse stated the accessories for the F550 will cost $38,198 while the F350 accessories will cost $16,559. Mr. Rinaldi asked "how much is the amount of the grant and do we have anything in writing from Lackawanna County the Borough will receive those funds?" Mr. Barrasse stated the grant was for $35,000 and Mr. Barrasse and Mr. Dougherty stated the Borough has received a commitment letter from Lackawanna County. Mr. Barrasse stated after a discussion with Finance Chair Hughes, "total cost using rough numbers approximately $160,000 minus the $35,000 grant the value will go down about $125,000". Mr. Barrasse stated it was Dave Kohinsky's idea if we got rid ofboth current trucks and sold them, the Borough would receive in excess of $25,000 from the sales making his estimate of the cost to the Borough $100,000 or less. Mr. Barrasse stated this Council or the new Council will need to decide if they would want to keep one (1)oft the older trucks as ai reserve. just in case we need it during the winter season. Mr. Rinaldi stated he does not understand if the trucks are not available currently for sale, Council certainly cannot vote to purchase them. Mr. Barrasse stated the Borough needs to submit a commitment letter stating the Borough will be purchasing trucks under the expired 2019 program. Solicitor Weinschenk stated this commitment can also be cancelled. Mr. Barrasse stated hel believes the Borough has thirty (30) days to cancel the commitment. Mr. Rinaldi asked if we have a date when the trucks will be delivered. Mr. Barrasse stated the F350 delivery is possible by mid-January and the F550 possibly February or March noting "we do not pay until delivered". Mr. Hughes stated the Borough has the money to pay for the trucks stating, ift the cost without the grant is $160,000 for the purchase the Borough can take $80,000 from the Capital fund, $40,000 from the Sewer fund and $40,000 from the General fund to finance the purchases. Should the Borough eventually receive the grant, those funds will deposited into the Capital fund. Mr. Barrasse stated if we ratify the 2019 COSTARS Contract, he believes the Borough will be saving a total of $3,600. Mr. Barrasse continued the roll call for the motion. Mr. Williams, Mr. Dougherty, Mr. Rinaldi, Mr. Toms, Mr. Hughes and Mr. Barrasse voted in favor. Solicitor Weinschenk told Council aftera discussion with Dave Kohinsky concerning the Short Hill and Gordon Pa American Waterline Replacement Project and the complaints concerning the inadequate compaction by the contractor, TSE that has damaged residents' sewer. Solicitor Weinschenk would like Council to consider videoing the sewer lines and laterals before the paving begins and maybe the Borough can get someone else to pay or contribute for the video. Mayor Lawler stated she will need Pa DOT agreement number on the Fairview Road Drainage Agreement for possible assistance from Marty Flynn's 's office to get this moved up to the MOTION FOR ADJOURNMENT: President Barrasse entertained the motion to adjourn the meeting.
