Z-21-09 City-initiated rezoning of properties north of Assembly from C-2 to T-5 (Second Read) Senior Planner Austin Shelton explained that the City of Doraville seeks to rezone properties on Motors Industrial Way and Peachtree Industrial Boulevard in order to support the zoning and land uses recommended in the 2017-2037 Doraville Comprehensive Plan. Properties are proposed to be rezoned from C-2 (General Business) to T-5 (Urban Center), a mixed-use zoning district that is part oft the City ofl Doraville's form-based code, the Livable Council Member Koontz made a motion to Approve Z-21-09 as presented. NAYS/NO: ABSTAIN: IX. NEW BUSINESS 1. Z-21-13 Request to rezone 3763 Longmire Way from T-5(Urban Core) to M-1 (Light Manufacturing) for Lawn Care Services. (First Read) (Public Hearing) The applicant, Brad Hamner, seeks to rezone the property located at 3763 Longmire Way from T-5(Urban Center) to M-1 (Light Manufacturing) for a lawn care services business. The applicant wishes to utilize the existing building and meet the specific use requirements listed below: Parking or storage oflawn care vehicles shall be located to the rear of thel lot and shall be contained within a secured, gated fence. The fence shall be ai maximum height of eight (8) feet high, bel black, be vinyl coated, chain link, contain fence slating on all fence elevations (black in color), and shall not bel barbed or razor wire unless as approved as a variance by the City Council. Z-21-10 City of] Doraville seeks to rezone properties on Clearview Place and Clearview Pkwy from M-1 (Light Manufacturing) to O-W (Oflice-Warehouse). (First Read) (Public Hearing) The Cityo ofDoraville seeks to rezone properties on Clearview Place and Clearview Parkway in order to support the zoning and land uses recommended in the 2017-2037 Doraville Comprehensive 4 Plan. A-21-18 City ofDoraville seeks to amend Chapter 6 and Chapter 23 ofthe City Code to create provisions for food trucks (First Read) (Public Hearing) Senior Planner Austin Shelton explained that this proposal is to permit and regulate food trucks in the CityofDoraville. The proposed text would create a definition for food trucks in the Code of Ordinances, and set parameters for their operation and location in the City. As aj point of clarity, the regulations outlined int this ordinance would govern food trucks operating independently during the normal course ofbusiness. This is not meant to govern food trucks that operate in Doraville as part of public and private events. Similarly, food service vendors that target places like construction sites during lunch, could also Council Member Henshaw would like to see two options for vending, one for long term and one for periodic visits. Council Member Evans would like to see the. A-frame signs as an option for food trucks. Council Member Koontz is concerned about the stationary restaurants in Doraville if this is approved. Council Member Cohen Morris thinks that. a permit for 90-days would be sufficient and that the fees should be less than our surrounding municipalities sO Doraville can be ai regional food destination. Council Member Yeoman doesn't want business competing with be covered via al Peddler's Permit, which is in a separate section oft the code. food trucks and suggests permits for either 30 or 60 days. Public Comment: 1.Mr. Lee Flier, Oakcliff, is excited about the food truck ordinance and thinks that food trucks should come once or twice a week. Mr. Flier stated that food trucks should be limited on the number oft times they can frequent the City. The First Read was held. 6. A-21-16 City of Doraville seeks to amend the Livable Community Form-Based Code to require ac conditional use permit for specific adaptive reuse projects (First Read) (Public Hearing) Planning and Community Development Director Naomi Siodmok explained that this proposal is to amend the Livable Community Form-Based Code to require a conditional use permit (CUP) when reusing or converting an existing commercial or industrial building for residential use or vice versa, in its entirety or partially. This only pertains to the mixed-use zoning districts T-4 (General Urban), T-5 (Urban Center), and T-6(Urban Core). 5 There were: no public comments. A-21-19 City ofDoraville seeks to amend Sec.13.5-21 ofthe City Code toi reflect the current fee charged for yard sales (First Read) Director of Planning and Community Development Naomi Siodmok explained that it was brought to the attention ofs staffb by City Council that though the fee schedule says that yard and garage sale signs cost $5 dollars, the Code of Ordinances still requires a $25 dollar fee. The proposed amendment will rectify the discrepancy. Council Member Cohen Morris would like the proposed ordinance to clearly define the penalty for having a yard or garage sale without aj permit. The First Read was held. 8. A-21-17 City ofDoraville to amend Sec. 6-9 ofthe City Code to add additional requirements for water recycling for car washes. (First Read) Director of Planning and Community Development Naomi Siodmok explained that this proposal is to amend Sec. 6-9 of the City Code to add additional requirements for water recycling for car washes. after completing the aforementioned research, staff recommends requiring water recycling not just for new conveyor washes, but also fori in bay automatic car washes. Further, any new or remodeled car washes utilizing more than five (5) gallons ofwater per minute shall also be subject to water recycling. Per the current Code, a minimum of fifty (50) percent ofwater utilized must bei recycled, which allows for fresh water to be used for rinsing. COUNCIL COMMENTS Council Member Cohen Morris explained that it is nice to see sO many zoning and new businesses coming to Doraville. Council Member Alexander is looking forward toi more food truck events. 6 Council Member Henshaw is excited about New Peachtree Road and invited everyone to the Sesquicentennial Committee's pool and movie party on Friday, August 13, 2021. Council Member Evans stated that he is happy with the progress ini the City and the repaving projects. Council Member Koontz made a motion to enter Executive Session to discuss Legal and Real Estate. Council Member Henshaw seconded the motion. The motion carried unanimously (6-0). Council Member Henshaw made a motion to adjourn from Executive Session.
