CALL TOORDER Mayor Joseph Geierman called the meeting to order. II. ROLL CALL Council Members Gerald Evans, Andy Yeoman, Rebekah Cohen Morris, Christopher Henshaw, Maria T.. Alexander and Stephe Koontz were present. III. PLEDGE OF ALLEGIANCE IV. APPROVAL OF MEETING AGENDA Council Member Henshaw made a motion to approve the meeting agenda deferring the Doraville Difference Maker Award presentation to Wednesday, October 20, 2021 to accommodate the honoree, remove. Item #1 from New Business completely, and move Item #2: from New Business tot the Consent Agenda. Council Member Koontz seconded AYES/ YES: Evans, Yeoman, Cohen Morris, Alexander, Henshaw and the motion. The motion carried by unanimous vote (6-0). Koontz NAYS/NO: - ABSTAIN: V. PROCLAMAMATIONS AND RECOGNITIONS 1. Proclamation Recognizing Taiwan Day Economic and Cultural Office (TECO) in Atlanta. 2. Council Member Alexander seconded thei motion. Thei motion failed because the vote was not unanimous. NAYS/NO: ABSTAIN: AYES/ YES: Evans, Alexander, Henshaw and Koontz Yeoman and Cohen Morris Council Member Yeoman made a motion to approve Consent Agenda Items #1,2,4, and 5; moving Item #3 and Item #6 to New Business. Assembly and stated that the crushing ofthe concrete has begun. Mr. Gipson thanked Mayor and Council and stated that the project would not be Chris Eldridge, City Manager, provided an update on day-to-day operations throughout all IX. UNFINISHED BUSINESS- None X. NEWI BUSINESS 1. Moratorium on Medical Cannabis City Attorney Cecil McLendon explained that Governor Nathan Deal signed HB-1 into law on the 16th of April 16, 2015. This legalized medicinal marijuana in the state of Georgia for approved medical conditions. This legalization was further expanded by Governor Brian Kemp on 16th of April, 20191 by signing into law HB-324--the Georgia's Hope Act. This law allows for the manufacturing and dispensing ofl low-level THC oils ofno greater than 5% THC. The bill also enacted the GA. Access to Medical Cannabis Commission. This commission is charged with selecting and approving medical marijuana companies the appropriate state. licensures to operate and dispense within the 2 state. Medical cannabis is ai relatively new phenomena in the state of Georgia. As such, reasonable time should be given for the Mayor and Council to come up with appropriate planning, rules, and regulations to ensure that any dispensing of medical marijuana is done in as safe and legal manner consistent with the O.C.G.A. $ 16-12-207. As such, the Mayor and Council are ordained with the ability toi issue a 90-day moratorium on cannabis-oriented businesses. At which time, if9 90-days come to pass and the Mayor and Council feel as though conditions necessitate an extension ofai further 90-day Council Member Koontz made ai motion to approve the Moratorium on Medical Cannabis. Council Member Alexander seconded the motion. The motion was approved AYES/ YES: Evans, Yeoman, Cohen Morris, Alexander, Henshaw and Koontz moratorium they have this right. by unanimous vote (6-0). NAYS/NO: ABSTAIN: 2. Resolution Authorizing Expenditures of the American Rescue Plan Act Funds City Attorney Cecil McLendon explained the four categories of eligible uses and address Council Member Koontz made a motion to. Approve the Authorized Expenditures on the allowable section oft the list in the packet minus the Chamber of Commerce $50,000. COUNCIL COMMENTS Council Member Yeoman thanked staff for putting together Georgia Cities Week. Council Member Cohen Morris thanked Council for approving the ARPA Funds Allocation Council Member Alexander stated that she hated toi miss some oft the Georgia Cities Week Council Member Henshaw detailed the Sesquicentennial Committee upcoming events. Council Member Evans offered condolences to the victims ofthe plane crash in Chamblee, GA earlier today. Council Member Evans stated that early voting starts tomorrow. Council Member Koontz explained that today is National Coming Out Day and 25-years item to get the funds to support people in the community. activities due to aj planned vacation on the same week. 3 ago she came out as a transgender woman and it was the best thing that happened in her life. Mayor Geierman encouraged everyone to take advantage early voting that begins tomorrow. XIII. EXECUTIVE SESSION- None XIV.
