APPROVAL OF MEETING, AGENDA Council Member Alexander made a motion to approve the meeting agenda swapping New Business Item #3 and Item #4. Council Member Henshaw seconded the motion. UNFINISHED BUSINESS 1.V-21-17+18 - Request for variance to reduce the amount of required parking on-site and to allow parking in the first layer at 5072 Buford Highway. (Second Read) (Deferred from March) Director of Planning and Community Development Naomi Siodmok he subject property is 5072 Buford Highway, located at the edge of the city in the wedge formed by Buford Highway and Shallowford Road. The applicant, Dipakkumar Pathak, represented by. Joe Eddings, seeks variances from Sec. 23-1203 and 23-2049(e)(1) of the Zoning Ordinance, which covers parking and parking location requirements. Council Member Yeoman stated that there is not enough parking to support this development. Council Member Alexander stated that the proposed building isn'tADA compliant. Council Member Yeoman made a motion to deny V-21-17+18. Council Member Evans seconded the motion. The motion carried by unanimous vote (6-0). AYES/S YES: Evans, Yeoman, Cohen Morris, Alexander, Henshaw and Koontz NAYS/NO: ABSTAIN: 2.CUP-22-02- Conditional Use Permit for a place of worship at 2584/2600 Chestnut Drive + 4461 Director of Planning and Community Development Naomi Siodmok explained that the applicant, Saint Mark Coptic Orthodox Church, represented by Fr. Nathanael Guirguis, seeks a Conditional Use Permit (CUP) to operate a place of worship in the O-W (Office-Warehouse) and O-I (Office-Instiutional) zoning districts. Director Siodmok stated that the applicant is proposing aj place of worship at the former collision center located at 2584/2600 Chestnut! Drive. Thej primary place ofworship would bet the existing building at 2584/2600 Chestnut Drive, which is the former location of an automotive collision center. The applicant is attempting to purchase both properties, and their desire was for the CUP to cover both Council Member Koontz: made a motion to approve CUP-22-02 with conditions that excludes the parcel that fronts Tilly Mill Road, removing rooftop, and all chain link fencing. Director of Planning and Community Development Naomi Siodmok explained staff brought the idea before Council at the. January and February work sessions and were tasked with exploring ifit would be possible to permit some installation in zoning districts like T-5. Staffinitially recommended that retail and installation of auto parts remain separate. However, it was the desire oft the Council to allow some ancillary installation of auto retail, sO long as it was limited to thei interior oft the car and done either indoors or otherwise out ofs sight. This includes services like audio equipment, upholstery, and other items not related to the engine or other mechanical functions of the car. Planning Commission recommended that the interior installation use be made a CUP, and the number ofl licenses tied to the population, like massage and spa licenses. So, the total number permitted would be four (4) per ten thousand residents. Per Council comments at the first read, car wrapping was added to the list ofi items permitted by the new use. Council also discussed thei idea ofa allowing auto service centers to be 2 permitted provided that the property was completely redeveloped and adhered to the site and design requirements ofT-5. This is much larger text amendment and will be introduced separately by staff. Staffrecommended denial of A-22-02 after having conversations with Code Enforcement that this ordinance will be challenging to enforce. The Second Read was heard with no actions taken by Council. 4. A-22-03- Text-amendments to amend regulations for required electric vehicles (EV) charging Director of Planning and Community Development Naomi Siodmok explained that his amendment would require minimal infrastructure for at least one (1)EV charging station in all new construction single-family homes. This would be applicable regardless ofzoning district. It would: not be Council Member Henshaw made a motion to approve A-22-03 with the addition that ifs substantial remodeling occurs that the electric panel is replaçed with at least a 50-amp minimum breaker. Council Member Koontz seconded the motion. The motion was approved by unanimous vote (6-0). AYES/ YES:- Yeoman, Cohen Morris, Evans, Alexander, Henshaw and Koontz stations. NAYS/NO: ABSTAIN: City of Doraville. 5.1 Resolution of Doraville Mayor and Council establish Electric Transportation goals for the Council Member Yeoman explained that the Resolution establishes Electrified Municipal Fleet Goals: the City will strive to purchase electric vehicles for its internal fleet, while also considering total cost of ownership, to ensure progress towards its goal ofr reducing greenhouse gas emissions. The City sets the following policy for purchases within its fleet: a. All city vehicles will be evaluated for electric or hybrid options prior to purchase, with options presented to the Council; b. The City will financially support the charging infrastructure necessary to own and operate plug-in vehicles within its fleet. Council Member Yeoman made ai motion to approve the Resolution of] Doraville Mayor and Council that established Electric Transportation goals for the City ofDoraville. A-21-20- - Text-amendments to the requirements for accessory structures. (Second Read) Director of Planning and Community Development Naomi Siodmok explained that this is an amendment to Sec. 23-601, which is the primary code section that deals with accessory structures in most zoning districts and areas oft the City. The proposed amendment is a complete rewrite of the sections. It changes a great number of things, but the most significant are below: - Reduces the required distance from the main structure from 20ft to 10ft. Permits manufactured structures (pre-fabricated sheds, etc.). 4 Allows more types of foundations to be used. Reworks the: size limitations. Explicitly permits them to be used for non-habitation purposes such as home occupations and home offices. 3 A Allows for shipping containers in R-1 via a variance and accessory to other residential uses with Council Member Koontz made ai motion to approve. A-21-20 striking exceptions item #1 and item #5 adding the language that structures under 30 inches would be exempt from counting as an accessory structure. Council Member Cohen Morris seconded the motion. CUP-22-03- - Conditional Use Permit for a place of worship at 3695 Stewart Road Director of Planning and Community Development Naomi Siodmok stated that the applicant, Center of Worship for thel Nations, represented by Elida Covarrubias Haro, seeks a Conditional Use Permit (CUP) to operate aj place ofv worship in the O-I(Office- Institutional) zoning district. Director Siodmok explained that the applicant is] proposing a place ofworship at 3695 Stewart Road, which is located just south of the Kuolin Center The Public Hearing was opened for comments in favor or against CUP-22-03. A-22-04- - Update the Official Zoning Map (First Read) (Public Hearing) Director of Planning and Community Development Naomi Siodmok explained that this proposal is to update and adopt the Official Zoning Map ofthe City of Doraville. Thisi is an action we would likely to take regularly, to ensure that our official map matches the most recent zoning amendments adopted by the Mayor and City Council. Director Siodmok went over the following changes: - Z-21-17 - Rezoning of various properties on Peachtree Industrial Boulevard and Winters Chapel Road from C-1, C-2, and O-Ito T-5 and' T-S-C.-2-21-18-1 Rezoning of various properties on Peachtree Square and Peachtree Industrial Boulevard from C1, C-2, and M-1 to O-I and O-W.-Z Z-21-19- Rezoning of various properties on Tilly Mill Road and Peachtree Industrial Boulevard from C-1 and C-2to' T-5.-Z-22-01 - Rezoning of various properties on Chamblee- Tucker Road and Bagley Drive from R-1 to T-4.-Z-22-02- - Rezoning of3763 Longmire The Public Hearing was opened for comments in favor or against A-22-04. (First Read) (Public Hearing) Director ofPlanning and Community Development Naomi Siodmok explained that this amendment was suggested by Council as part of an earlier City-initiated rezoning. Though T-5 and' T-6 are mixed-use zoning districts, there is not a requirement for any particular distribution or percentage ofu uses within al larger development, including multifamily. Though they are both classified as "commercial" construction, there are different construction standards and needs for multifamily and commercia/retallofice. The intent of this amendment is to make it possible to convert the ground floor ofa multifamily building to commercial in the future, should the need arise. The First Read was held for A-22-06. (First Read) (Public Hearing) 4. A-22-05 - Amend the Zoning Ordinance pertaining to criteria for variances. Director of Planning and Community Development Naomi Siodmok explained that this text amendments alters two sections of the code pertaining to variances. The first adds a variance for shipping containers used as accessory structures in R-1. During the first read ofA A-21-20, Council requested that they would prefer it require a variance should anyone want to use a shipping container as an accessory structure in R-1. Shipping containers would still need to meet architectural design standards. The second section amended would allow residential unit density to receive a variance subject to the text approved by Council earlier this year in amendment A-22-01. As currently written, unit density cannot receive a variance from Council. Planning Commission and Staff recommends approval Director Siodmok that shipping containers will be removed completely. Recently, there have been a few renovations for businesses where the permit for the renovation was pulled prior to the business or property owner applying for al business license. This change will provide reviewers with more context for why ai renovation is taking place, and allow staff to flag businesses that are either prohibited or would require a CUP from Council prior to are performing the work for.
