Z-22-03 - City-initiated rezoning for various parcels with no zoning and parcels zoned C-1 Naomi Siodmok, Director of Planning and Community Development, explained that this is a zoning and C-2. (First Read)(Public Hearing) 2 action that is both a rezoning of currently zoned parcels, and assigning zoning where none previously existed. (First Naomi Siodmok, Director of Planning and Community Development, explained that the proposed Read) (Public Hearing) text amendment is to modify regulation for auto parts retail and installation. The Public Hearing was opened for comments in favor or opposition of A-22-02. There were no comments in favor or against A-22-02. The Public Hearing and First Read was held for A-22-02. 4. A-22-08 -4 Amendment to Zoning Ordinance pertaining to Home Occupations. (First Read) Naomi Siodmok, Director or Planning and Community Development, stated that a recent text amendment (A-21-20) adopted by Council clarifies that accessory structures may be conditioned space, and it was determined by Council that home occupations should be able to be located within (Public Hearing) conforming and permitted accessory structures. There were no comments in favor or against A-22-08. The Public Hearing and Fist Read was held for A-22-08. 5. Ordinance to Amend Appeals Procedures. (First Read) The Public Hearing was opened for comments in favor or opposition of A-22-08. Assistant City Attorney Scott Hastey explained that this ordinançe is to amend Chapter 1- General Provision, Section 1-15. Hearing Procedures to clarify the appeal process for administrative decisions. The First Read was held. 6. Ordinance to Amend Chapter 110 Code: Sections re. Loitering (First Read)- Removedj from agenda 7. Ordinance to Amend Section 11-9 of the Code Section for Disorderly Conduct (First Read)- 8. Discussion on Wholesale/Non-Conforming uses and Narrowing those by Unit (verses parcel). Assistant City Attorney Scott Hastey explained that the proposed ordinance is to amend Section 504 of Chapter 23 (Zoning) of the Code of Ordinances to modify provisions governing nonconforming Removed, from agenda 3 uses ofs structures. This item will go before Planning Commission for recommendation. 9. Resolution to Establish the Millage Rate: for the Special Service District City Manager Chris Eldridge explained that the proposed Resolution is to set ad valorem tax rate for Council Member Yeoman made ai motion to approve the Resolution to Establish the Millage Rate for the Special Service District. Council Member Alexander seconded the motion. The motion passed Assembly Special Service District. with a unanimous vote (5-0). NAYS/NO: ABSTAIN: AYES/ YES: Evans, Yeoman, Alexander, Henshaw and Koontz 10. Resolution for Amicus Briefin Support of Case 303 Creative V. Elenis. Council Member Stephe Koontz explained that this Resolution will authorize the City Attorney's Office is hereby authorized to execute and deliver any and all documents and take such further action as necessary or appropriate to join in the amicus brief to the United States Supreme Court in 303 Council Member Koontz made a motion to approve the Resolution for Amicus Brief in Support of Case 303 Creative V. Elenis. Council Member Alexander seconded the motion. The motion passed Creative V. Elenis, as authored by the San Francisco City Attomey's Office. with a unanimous vote (5-0).
