June 30, 2020 Demorest City Council Work Session and Special Called Meeting was held int the Demorest Municipal Building located at 125 Ivy Street, AGENDA ITEMIand Il: INVOCATION AND PLEDGE TO THE FLAG Mayor Austin led with thei invocation and pledge to thei flag. Mayor Austin called the meeting to order at 6:00 p.m. AGENDA ITEMI IV: APPROVAL OF THE AGENDA AGENDA ITEM HI: CALLT TOORDER Mayor Austin asked if there were amendments or changes to be made to the agenda as presented. When there were no changes, he called for a motion to approve the agenda. Sucha a motion was made by Councilman Moore and seconded by Councilman Davis. ACTION: The agenda was approved as presented (3-0). AGENDA ITEM V: APPEARANCE AND PUBLIC COMMENTS Mayor Austin called for public comments. No representative from the Concerned Citizens of Demorest was present as listed oni the agenda. Florence Wikle came forward to address the group and directed questions to Ms. Simonds regarding the termination of Chief Krockum and also the requested resignation of Attorney Homans. Councilman Davis objected to the questioning. AGENDAITEM VI: FINANCIALS - GEFAI LOAN MODIFICATION City Treasurer,. Joely Mixon, told the group that the loan modifications were directed by Governor Kemp through GEFA as part of the COVID relief effort. Demorest has five loans and the current loan payments would be placed in' Water Reserves for the next six months 527921x6-5167,529) and a substantial lump payment would be made. The City will save approximately $35,000 ini interest. Mayor Austin called for a motion to move forward with the loan modifications. Sucha a motion was made by Councilman Moore and was seconded by Councilman Davis. 1Page ACTION: The motion to move, forward with the GEFA loan modifications was unanimously approved (3-0). AGENDA ITEMVI!: DEPARTMENT HEAD REPORTS Ken Ranalli, Fire Chief: Nothing to report Robin Krockum, Chief of Police: Chief Krockum told everyone that the position of City Solicitor would Bryan Popham, Director ofF Public Works: Mr. Popham provided a drawing of the proposed design for the new restrooms in the park. This project wasi included on SPLOST 2021. Mr. Popham will work toward getting a cost estimate for the project. He also reported that the 365 Sewer Bore is progressing, The Water Department isi in need ofa a new UTV to navigate the manholes - over 200 of them. Prices have been obtained. Ms. Mixon asked if Council would postpone a decision on this item until the. July 7 Mark Caudell, Wastewater Plant Interim Manager: Fletcher Holliday with EMI was introduced to speak to Council regarding their management oft the sewer plant. He presented a handout (see attachment) and spoke about various challenges of running the system. He said that many landfills have discontinued the practice of accepting sludge. He suggested an exchange with the County - they would accept Demorest solids in exchange for the acceptance of leachate at $288 per load. An IGA with the County willl be drafted for review. Mayor Austin asked Mr. Holliday to compile a cost estimate for the not need to bet filled at this time. AGENDA ITEM IX(1): NEW BUSNESS-SWEETBREADS PROPERTY Attorney Homans forwarded correspondence to everyone which he received from the attorney for Sweetbreads (see attached). Sweetbreads intends to exercise their option to purchase the property. One oft thei issues of the purchase concerns the adjoining parking lot, which is noti included ini the purchase. They would like to purchase the parking lot also. The DDA will meet and address this topic on Monday, July 6 at 4:00 p.m. Mayor and Council are invited to attend. Leachate is a liquid that drains or leaches' from landfills. Its typically a result ofrainwater entering the landfill but is also due to the natural decomposition of organic material along with other liquids and chemicals that have been discarded. Its composition can vary widely depending on the age of the landfill and the type of waste that it contains. It usually contains both dissolved and On April 14, 2020 the Demorest WWTF: received 3200 gallons of leachate from Habersham County Landfill in order to conduct aj pilot test to determine ifthel leachate would impact the treatment process within the Orbal Treatment Unit. The leachate was discharged into the influent structure of the WWTF: at a flow rate of approximately 10 gpm over a six-hour span in order to prevent a "shock" effect within the treatment train. Pre and post treatment samples were collected during the discharge of leachate as well as after to determine treatability. The leachate itself was also sampled and analyzed. Influent samples were analyzed for BOD and TSS, effluent and the leachate samples were analyzed for BOD, TSS, NH3-N and P. All post samples exhibited no interference from the discharge of the leachate within the Demorest WWTF. Engineering Management, Inc. (EMI) see: no effects of the leachate within the treatment train and would recommend that the City accept the waste on a regular basis. As you know the County would like to dispose of one 3200-gallon load ofl leachate per week. We would: recommend charging the County $0.09 per gallon which would equate to $288 per load.. Anticipating they would discharge one load per week, that would generate approximately $1,152.00 of revenue per month. Assuming the City would want to move: forward with this, we would suggest a written suspended materials. agreement be drafted and signed between the City and County. Box 128 Demorest, GA 30535 RE: Sweet Breads, LLC Dear Chairman: Ihave been retained to assist Sweet Breads, LLC in the purchase of the property it now leases from Sub-Lessor Downtown Development Authority of City of Demorest (hereinafter DDA), said property located at 579 Georgia Street, Demorest, Georgia 30535. In accordance with the terms of the Sub-Lease Agreement between the DDA and Sweet Breads, LLC, 579 Georgia Street, dated May 4, 2015, but apparently signed April 17, 2015, Sweet Breads, LLC hereby provides written notice in accordance with paragraph 7 of the above-referenced agreement of its"...intent to purchase to exercise this option." The closing date shall be on or before July 16, 2020, unless otherwise agreed to between the parties... which I believe will need to happen since the buyer needs to have a new plat of the property prepared. In addition, paragraph 8 of the agreement indicates that "...the Tenant shall pay the DDA $5,000.00..." as consideration for the option to purchase and that this amount will be credited at the time of closing the transaction; however, it does not specify the manner in which the actual transmission of the payment is to be made to the DDA. In this regard, the purchaser will deposit $5,000.00 in my firm's trust account, which shall be held in trust on behalf of the DDA as it relates to this transaction. Ina accordance with the Agreement, the purchase price will be $130,000.00 and the purchaser shall receive credits of $21,087.00 which was the payment it made at the execution, or within days of the execution, of the above-referenced agreement as well as the $5,000.00 previously noted in this letter.
