CUP-23-09 - Conditional Use Permit (CUP) application submitted by 2nd5Seven, LLC for a podcasting studio located at 5878 Buford Highway, Suite 14 and zoned T-5. On November 21, 2023, City Staff received a written withdrawal request from the applicant. Per Sec. 23-1607, a request for withdrawal that is received in writing from an applicant prior to the publishing of the agenda for first City Council public hearing meets the criteria of the ordinance. Therefore, the  request is withdrawn without prejudice. Presented By Community Development  U. Ratification of MOU Agreement with Latin American Association Presented by Crystal Dawson, Director of Parks and Recreation  Council Meeting Minutes December 18, 2023    A.  Public Defender Services Agreement  Council Member Evans inquired about the whether or not the contract is being removed and replaced, and asked if court is not in session are the Council Member Alexander made a motion to pass the new renewal of the Public Defender Services Agreement, Council Member Evans  vendors still paid.  seconded the motion.  The motion was carried by unanimous vote (4-0). AYES/ YES: Evans, Alexander, Henshaw, Yeoman  NAYS/ NO: None ABSTAIN: None P. Musco Light Purchase for about 12 years.  Council Member Yeoman recused himself due to litigation with company Council Member Alexander made a motion to approve the purchase agreement from Musco Light purchases for Honeysuckle Park.  The motion passed vote (3-0). AYES/ YES: Evans, Alexander, Henshaw  NAYS/ NO: Yeoman ABSTAIN: None  V. REPORTS AND PRESENTATIONS-None W. UNFINISHED BUSINESS-None  X. NEW BUSINESS  a. Purchase of Surveillance Vehicle  Chuck Atkinson, Police Chief presented the item.  Council discussed the following concerns: with recent break-ins, whether the surveillance vehicle be able to fit into a parking garage. Council member Maria Alexander made a motion to purchase the surveillance vehicle as suggested by the Police Chief, Council Member  Evans seconded the motion. Adoption of Urban Redevelopment Plan Tank Farms Special Service District Project (Public Hearing) Chris Eldridge, City Manager presented the item. There was no public comment for this item.  Council Member Yeoman inquired on ift the city should wait until the rates are lowered in upcoming months. Council Member Evans was glad to see ifg going through, Council Member Henshaw asked if signage will be used Council Member Alexander motioned to adopt the Urban Redevelopment Plan Tank Farms Special District Project, seconded by Council Member  for road closures during the project?  Evans seconded. The motion passed (3-1). NAYS/ NO: Yeoman ABSTAIN: None  AYES/ YES: Evans, Alexander and Henshaw  C. - An Ordinance to revise Chapter 2 ("Administration") to revise Section 2-31 related to the Council Meeting Schedule (First Read) Cecil McLendon presented the item and asked you to bring the item before the next Council Meeting to change the language. Council Member Yeoman asked if changing the Charter if Council by  Resolution could change the meeting schedule annually? No other Council Comments made on this item.  The item will come back before Council at the January meeting. d. A Resolution declaring the results of an election determining the issuance of General Obligation bonds by the City of Doraville and for Chris Eldridge, City Manager and Cecil McLendon, City Attorney Council discussed the item and inquired about the status of the Feasibility study, time frame of when the project will commence, and whether or not the resolution is part of the process. e. (First Read) (Public Hearing) Presented by Community Development  Austin Shelton, Director presented the item to Council.  The applicant addressed Council.  Council had the following concerns: plan for business growth, storage of precious metals, parking, option for  walk in customers.  There was no public comment for this item.  Council Member Yeoman made a motion to waive first read, Council Member Alexander seconded the motion. AYES/ YES: Evans, Alexander, Yeoman and Henshaw  The motion passed unanimously (4-0).  NAYS/ NO: None ABSTAIN: None  Council Member Alexander made a motion to approve CUP-23-08 for a Conditional Use Permit for precious metals dealer/repair facility. Parcel ID 18356-06-005 on Peachtree Blvd, Council  Member Evans seconded the motion. The motion passed unanimously (4-0). A-23-12 - Consideration to approve an ordinance for a text amendment to amend Chapter 5 (Buildings and Regulations), Article V (Efficient Plumbing Fixtures) and Article XII (Landscaping and Planting Standards)  to add language requested by the State (Metro Water  Council Meeting Minutes December 18, 2023    District) in regard to water efficiency for plumbing and water fixtures. Amendments are required to go into effective before January 1, 2024.  (First Read)  Austin Shelton presented the item. Member Alexander seconded the motion. The motion passed unanimously (4-0).  Council Member made a motion to waive first read of the A-23-12. Motion passed unanimously 4-0 NAYS/ NO: None ABSTAIN: None  AYES/ YES: Evans, Alexander, Yeoman and Henshaw  - A-23-14- - Consideration to approve an ordinance for a text amendment to amend Chapter 10 (Nuisances), Article I (In General), Section 10-3 (Noise), Subsection (b) (6) Construction and demolition submitted by  the City of Doraville. (First Read) Austin Shelton presented the item.  Council Member Yeoman requested the timeframe be 7pm, Council Member asked about ending hours with Dekalb County, and additional language for Council Member Alexander made a motion to waive first read, Council  holidays.  Member Evans seconded.
