The Carl Junction City Council met ini regular session on Tuesday July 18, 2017 at 7:00 PM at City Hall. Mayor Mark Powers called the meeting to order with the following present: Bob Cook, Don Marshall, Richard Zaccardelli, Roger Spencer, LaDonna Allen, Jeff Hammons and Randy Hutcheson. Alderman Mike Burs was absent. Also present were City Administrator Steve Lawver, City Clerk Maribeth! Matney and City Attorney Mike Talley. AGENDA Roger Spencer motioned to approve the agenda as presented. Richard Zaccardelli seconded. Alli in favor. No opposed. Bob Cook: motioned to approve the consent agenda. Richard Zaccardelli seconded. Alli in favor. No opposed. PUBLICFORUM Joyce Dunn, 1207 Scott Drive, addressed the council about a neighbor's house. She has been at her residence for 47: years. She doesn't understand why we can't get her neighbors to clean up their yard. (She passed around pictures) She doesn't understand why iti is taking so long to geti it cleaned it up. Shel has been working on this for 3 years. They have junk cars, tires, high weeds and a pool that is a mosquito haven. Chief Haase reported that it is in thej process but it takes time. Ift they plead not guiltyi it takes it even longer. Don Marshall asked if we needed to change our ordinance. Mike Talley stated that it follows state statutes. Joyce Dunn stated they are chronic abusers. Chief Haase said that they can abate it one time and then we. have to start the process all over again. Chief Haase said he would check into it personally. Mike Talley said that our ordinance follows state statues but the state is hand tying municipal courts, especially nuisances. Joyce Dunn asked what a resident could do. LaDonna asked if thel health department could get involved since there is a mosquito issue. ChiefHaase will check intoi it. P&ZCASES Case #17-03 - Site Plan Review - 702 E Pennell. Jeff Hammons stepped down from the dais due to a conflict with this project. Jeffi is the contractor on this project. Steve: reported that the P&Z met 7/17/17 and is recommending approval of this project. Jeffreported that Cindy McNally couldn't be here but nothing has changed: from thej preliminary site plan. There was no one tos speak against this project. Bob Cook motioned to approve the site plan. Donl Marshall seconded. 6i in favor. 1 (Hammons) abstained. Jeff Case #17-04 - Final Plat Briar Rock Estates (formerly Thomas Subdivision). Richard Zaccardelli stepped down from the dais due to a conflict with the project. Itis his son-in-law's subdivision. Steve Lawver reported that] P&Z met on 7/17/17 and they are recommending approval. Steve Lewis, engineer, was present to answer any questions. Bob Cook asked where this was at. It was responded that it is in Briarbrook by the golf course. Bob Cook motioned to approve the subdivision. COMMITTEE REPORTS Police Dept. - Chief Haase reported that the new dispatcher is on full time rotation. They also have a new part time dispatcher that is local. The bridge is coming along at a good pace. Bob Cook asked about some kids going around late at night Budget/Finance Mike Burns was not in attendance. Code/Nuisance - Don Marshall had nothing toi report. Human Resources - Roger Spencer hadi nothing to report Public Facilities & Planning - LaDonna Allen] had nothing to report. Senior Citizens- Richard Zaccardelli had nothing to report. UNFINISHED BUSINESS look att the proposal and get back with the City. Mayor Powers reported that hel had talked to the Briarbrook CID Board about exchanging land for aj parking lot. They are to Mike Tally stated that he had not looked at the sidewalk situation but the problem may be solved. He also reported that the pretrial hearing on the fence lawsuit is not set yet but he wants Steve Lawver to be there. It was stated that there are concerns about the fencing around the pool. 1 Bob Cook asked what size of pipe will be installed under Center Creek for the sewer line. Steve said it was going to be 10" Steve reported that after thel last meeting he talked tol Mike Burns about hiring ai full time person in PW. Steve said that Mike Burns had no problem with it and we would budget for it. We may need to add a little extra due to the benefits. Don Marshall motioned to hire a full time person in the PW Department. Richard Zaccardelli seconded. Bob Cook asked ifit could be a CJ resident. Steve said we did not] have a residence requirement. All in favor. No opposed. Dom Marshall said he would volunteer to help mow until we could get on top of ouri mowing. ChiefHaase said that Mike Talley reported that he attended his annual attorney's meeting and one session dealt with public forum. He stated that the City has the right to control thet time aj person can speak but we can't controli the content. The speech we say at the beginning of thej public forum will have tol ber rewritten. They can say anything they want as long as they are not disruptive. The councill has ai right Steve said that we had aj problem withl barns harboring rodents and the owner came: in and talked to Steve. Hel has been out Mayor Powers1 brought upi the robo calls that can be utilized with the new software package we are going to get. It was stated thati ito could come in handy when wel have emergencies and we: need to get the word out on them.
