The Carl. Junction City Council met in regular session on' Tuesday March 07, 2017 at 7:001 PM at City Hall. Mayor Michael Moss called the meeting to order with the following present: Bob Cook, Don Marshall, Richard Zaccardelli, Mark Powers, Roger Spencer, Wayne Smith, LaDonna Allen and Mike Burns. Also present were City Administrator Steve Lawver, City Clerk Maribeth Matney and City Attorney Mike Talley. AGENDA Mark Powers motioned to approve the agenda as presented. Roger Spencer seconded. P&ZCASES Sara Miller introduced herself to the council. She stated she was the new director for the BYAA. She stated she was looking Mayor Moss opened the public hearing on Case #17-01 - rezoning 713 S Roney from R-1 to R-2 at' 7:06 PM. Steve Lawver stated that P&Z met and is recommending approval. Mr. Alford said that hel has 3 % acres on that side of Roney. They have put a duplex on the West side ofl Roney and they want toj put one at 713 S Roney. They may develop morel later. He. has done al lot of clean up on South Roney. He said that although he lives in Diamond his family came from up here. Don Marshall asked about the sewer. He said that it will be gravity fed because thel line is at the bottom of the hill. There was no one against the rezoning. CHAMBER REPORT Gary Stubblefield reported that last weekend they held their 6" annual Business Expo. He said they received al lot of praise for our facility. The tail gate mixer on Friday night was a great success. He said that thel Lions's breakfast will be held 3/11/17. Also the Education Awards are set for 4/20/17 and they are accepting nominations for awards. The City Wide garage sale is 4/29/17 and their next meeting is 4/6/17. LaDonna Allen stated that she felt Gary was doing a wonderful jobj promoting not only the Çhamber but the City as well. APPROVE EARLY PAYOFF OF 2002A SRF BOND Steve stated that we had inquired about an early payoff on our SRF 2002A Bond on the WWTP. There is enough surplus funds toj payi it off. Ifv we pay it out it would be $297,550 but the early payoffi is $282,120. We are getting into thel highi interest part of the bond and if the council authorizes the prepayment Gilmore & Bell will prepare the ordinance. It will be a June payoff. Mark Powers motioned to authorize the early payoff of our 2002A Bond. Don Marshall seconded. Alli in favor. No opposed. PRESENT PROPOSED BUDGET FOR 2017-2018 FISCALYEAR This is the proposed budget that the council needs to review. We will pass the ordinance approving the final budget the 1st meeting in April. Steve said that he did ani interview with the media about iti today. Hei reported that the outcome was good duet to the fact we have paid off some loans and we had the accrual fund toj purchase new equipment without borrowing additional funds. It was not as painful as expected. Mark Powers stated that before we started the budget talks we were not sure we would be able to give a raise to our employees this year. Mark said that] he was pleased to find that we could givea a 2%C COLA raise. REPORTS The council reviewed the Administration report. Richard Zaccardelli asked about an emergency evaluation oft the City. We need to be prepared if we have ai train wreck or something. He said it was something to think about. Chief Haase said we. have an PW report - there was nothing. to add. Richard said he had received a phone call about not getting his bill and his water being shut off. He said that we knew we had reçeived his bill back from the post office. The City Clerk explained that we did have several come back and we had to remail them this month, but on the other hand the residents know they are to receive a bill each month and if they don't receive it they can look it up on the website or call City Hall. There was al lot of discussion about problems Police report - Chief Haase stated that his repeater coax cable broke on tower #8 and we have to get it repaired. He is estimating it to run about $4000. We have tol have it. We had to reprogram to be able to be ready to sound off thet tornado sirens. He emergency operation plan inj place. with thel Post Office lately. It was suggested we go down andi talk to thel Postmaster, 1 will try to see if LEST will pay for it but they usually don't pay ifit is already done. Mayor Moss stated that he will write an Building Inspector report - there was nothing to add. Mayor Moss stated Bud retires the end ofl March and hel hopes the new Budget/Finance - Mark Powers said that we presented the proposed budget tonight and would like for the council to review Code/Nuisance -Don Marshall stated that they needed to schedule a meeting. Steve said that thel P&ZI needs to meet oni it emergency order to geti iti repaired. inspector's reports are as thorough. COMMITTEE REPORTS it. first. Human Resources - Roger Spencer had nothing to report Public Facilities & Planning Wayne Smith had nothing to report. Senior Citizens Richard Zaccardelli had nothing to report. UNFINISHED BUSINESS Mike Talley reported that Bob Cook had asked him to look to see if we could collect our PP taxes with our utility bills. After researching the statutes we are only authorized to file a suit on delinquent taxes up to 3 years but not after 3 years. It does not give us the authority to collect with our utility bills. We also do notl have the authority to take them to our municipal court but he has provided the statues tol Bob Cook and the City Clerk. The City Clerk would liket to see thes state statutes changed. Mr. Talley then stated that he had filed aj pretrial conference on our fence litigation. Our judge, Dean Dankelson has recused himself from the case. Judge Martin was disqualified and Mike Talley requested a change from Judge Crane. That leaves us 2 judges, One oft the 2 judges was suçcessful in a suit against the city on a sewer claim and the other judge was his partner at that time. There was more discussion about delinquent taxes and our options. It was stated that Personal Property taxes are the only ones that we have trouble with. issues. NEW BUSINESS Bob Cook stated that] he appreciates Jimmy keeping our parks looking so nice. He also thanked the PW regarding his water It was requested that Steve find out how much the solar panels are saving per building. Junction to al bill that would allow us to go to the vote of the people for aj public safety tax. Ifit passes the council can decide ift they want to put that proposal in front of our voters. We can pass up to a! % cent sales tax. We can put this to the vote at any time. There is no time restriction on it.
