The Carl Junction City Council met in regular session on Tuesday December 17,2019 at 7:00. PM at City] Hall. Mayor Mark Powers called thei meeting to order with thei followingi present: Rick Flinn, Don] Marshall, Richard! Zaccardelli, Roger Spencer, LaDonna Allen, Mike Burns, Randy Hutcheson and Mark Satterlee. Also present were City Administrator Steve Lawver, City Attorney Mike Talley, City Clerk Maribeth Matney, Deputy City Clerk. Alaina Wright and City Administrator Assistant Crystal Winkfield AGENDA Mayor Powers stated he would like to amend the agenda to remove the closed session. JOE] HARRIS-I REQUESTING TO CONNECTTOCITY SEWER Stevel Lawver informed the council the Joel Harris is requesting permission to connect to the city sewer from his land that sits between the Briarbrook area and Joplin Street. He stated lot 34 will be used for the driveway and to connect to the sewer. Mayor Powers asked ifthere needed tol be ar motion made for the council toi make a decision. Stevel Lawver said the decision was ini the hands ofthe council. Mike Talley asked ift there are standards or policies inj place for who can connect tot the city's sewer. lines. Mike Burns asked ifthe city could ensurei no other properties could uset the sewer: services without the city's knowledge. Maribeth Matney asked how the city will bill him to know how much flow there is. Steve Lawver stated he doesn't know how Mr. Harris will get water. Mayor Powers suggested ifl Mr. Harris doesn't connect to city water, a stipulation would be to require a flow meter to bill for sewer costs. Mike Talley asked ift the city was prevented from making them connect to city water. Mark Satterlee asked ift there'sas standard ifhe's required tol have ai flow meter. Stevel Lawver recommended first hel hooks to city water, andi ifnot then he musti install a flow meter. Mike Talley questioned ift the council wanted the stipulation to be, he must either hook to city water or install ai flow meter, ori ift they wanted toi require him to use city water. Richard Zaccardelli motioned to allow) Mr. Harris tol hook tot the city sewer only ifhe also hooks to the city water system and that is his only water system. Ladonna Allen seconded. Steve Lawver stated the bids were opened Friday December 13. He stated that at $3,107.48 BD Yard Builders was thel low bid. The other bids werel Nelson) Enterprises at $5,300.00, Lee Sandtorf Excavating at $11,500.00, andl Randy Vilela' Trucking, Hauling andl Demolition at $6,200.00. Mike' Talley questioned what thel bidi required because the low bid didi noti include some details thel higher bids did. Steve Lawver stated the low bid included all the requirements listed. Steve Lawver said he got a call: from a lawyer in St. Louis representing US Bank inquiring about the city's intentions for thej property because US bank wants to demolish thej property also. Steve Lawver said he gave the attorney the information from thel bids the city received but never heard back from him. Mike Talley stated when the city demolishes al building iti isal high-risk liability situation, andi it would be in the city's besti interest to allow US Bank to demolish the structure. Richard Zaccardelli questioned ifit was al reverse mortgage situation. Stevel Lawver stated he did not! know the answer to that, but the city notified everyone they werei required to. Mike Talley suggested a motion to tentatively approve the bid, contingent upon being unablet to get US Bank to take care ofthey problem, and also contingent upon approving ac contract with BD Yard Builders. Mike Burns so motioned, Ladonna Allen seconded. Steve Lawver stated it would likely be in May Public Works report - Richard Zaccardelli said there were piles of mud on the streets in Briarbrook where Schuber Mitchell are building the new homes. Allen said the committee: met at 6:30 to discuss ongoing projects, but theyl had to discuss thei information reçeived from the city engineer about curbing erosion and rerouting Center Creek. Shes stated the cost would be $90,000 fort the first phase, andi it would require aj permit from the Army Corps of Engineers. Kurt from Allgeier Martin recommended the city apply for a permit because they are good for two years and there isi no penalty ift the city doesn't do the work. Ladonna Allen recommended following the engineer's recommendation. She stated the only other option is to take whole sewer line north buti it wouldi mean the city would walk away from work already done. The consensus of the council was to apply for thej permit.
