The Carl. Junction City Council meti in regular session on Tuesday November 05, 2019 at 7:00 PM at City Hall. Mayor Mark Powers called the meeting to order with the following present: Rick Flinn, Don Marshall, Richard Zaccardelli, Roger Spencer, LaDonna Allen, Mike Burns, Mark Satterlee and Randy Hutcheson. None absent. Also present were City Administrator Steve Lawver, City Attorney Mike Talley, City Clerk Maribeth Matney and Deputy City Clerk Crystal Winkfield. AGENDA Roger Spencer motioned to approve the agenda as presented. Richard Zaccardelli seconded. All in favor. None opposed. Roger Spencer motioned to approve the consent agenda. Richard! Zaccardelli seconded. All in favor. No opposed. PUBLIC FORUM P&ZCASES Bachman, Joe opposed. There was no one present for public forum. Mayor Powers asked for discussion regarding Case #19-12 Purchase of city property (556 sq ft) adjoining 209 NI Steve Lawver said the measure was tabled by P&Z because some of the measurements needed to be corrected. Ladonna Allen motioned to table the discussion until P&Z had a recommendation. Mark Satterlee seconded. All in favor, no Mayor Powers then asked for discussion regarding Case #19-13 - Utility easement to Empire District Electric Company. Steve Lawver stated that P&Z recommended approving the measure. Ladonna Allen moved to accept the P&Z recommendation, Richard Zaccardelli seconded. Alli in favor, no opposed. Mike Talley said he would have an ordinance for review at thei next meeting. REVIEWOFI PROPOSED ORDINANCE AMENDING CHAPTER: 10,-1BI8-TORACCOA USAGE Rick Flinnstated! he received al letter to. Joplin's mayor from Dr. Paul Petry that he felt was pertinent and wanted the council to read. There was discussion about the feedback received from residents regarding the proposed amendment. Roger Spencer said everyone he spoke with was in approval of the measure and Richard Zaccardelli said Freeman Rehab was in favor also. Mayor Powers said he spoke with Dr. Cook and the school is in favor oft the ordinance as well. Rick Flinn said he received mixed responses, and Ladonna Allen said she had mostly negative reactions. There was discussion about residents voting on the measure. Mike Talley noted an ordinance could be written so that it only took affect if approved by voters, but reminded the council they were elected by the voters to make decisions in the best interest of the city and its residents. Steve Lawver said there would be an additional cost to the city to addi it to the ballot, but the cost would be minimal if done during a general election. Ladonna Allen questioned ifl MML or the state legislature should be contacted about the issue rather than making changes at the local level. Rick Flinn pointed out part of Dr. Petry's letter indicating that 18-21 year olds brains aren't fully developed yet and smoking and vaping can cause neurological changes, and Randy Hutcheson spoke about research indicating the military enlists young people because at that age they are still malleable and can be molded. Don Marshall stated the measure would be worth iti ife even one life were saved. Richard Zaccardelli motioned toj Roney ordinançe the FEE put amending chapter 210.2160 on the agenda for the next meeting, Randy Hutcheson seconded. Alli in favor, no opposed. REVIEW OF PROPOSED ORDINANCE AMENDING CHAPTER 600.250 -' TEMPORARY CATERER PERMIT Maribeth Matney pointed out the city ordinance for temporary caterers does not] have ai fee assigned. Mike Talley drafted an ordinance for review setting thei fee for $25.00 per event. There was discussion about the reasoning behind the fee being set at $25.00 Mayor Powers said the amendment willl be put up for discussion at the next meeting. REVIEW_AND/ APPROVALI OF FAIRWAYI DRIVE STORM WATER MATERIALBIDS Steve Lawver stated the city received bids for the plastic and parts from Joplin Supply for $16,793.55 and B&L Water for $19,148.04 and suggested Joplin Supply be used since theirs was the lowest bid. Steve also stated bids were: received for the concrete drop in from Stewart Concrete for $1,425.00 and Scurlock Industry for $1,687.00 and recommended Stewart Concrete be used for concrete drop in since it was the low bid. Ladonna Allen made a motion to accept the recommendations, Richard Zaccardelli seconded. Alli in favor, no opposed. REVIEW, AND APPROVAL OFTHE PROPOSED HEALTH INSURANCE RENEWALI RATES Steve Lawver reported there would be no increase to thel health insurance rates with the same coverage and carrier. Budget/Finance: Mike Burns discussed the recent meeting with the auditors. He said there were no red flags, and that debt Human Resources: Roger Spencer said there needs tol be a closed session: next meeting regarding personnel. Public Facilities & Planning: LaDonna Allen stated weather has delayed the veterans memorial, and thei formal dedication Senior Citizens- Richard! Zaccardelli gave the council notes over the month's menu and activities. Mike Talley asked ifthe demolition order was signed for 303 Briarbrook Drive. It was responded yes. obligations were improved byl halfar million dollars and the cash reserves have been increased. UNFINISHED BUSINESS NEW) BUSINESS Don Marshall mentioned questions from residents about the railroad crossing at 171 & Pennell being very rough. Steve Lawver told him that was an issue between MoDOT and Kansas City Southern. The resident at 1204 Scott Drive has problems with water standing constantly and wanted to know ifa anything can be done.
