Kirkner, Chair Members Absent: Tom Gordon III, Ex-officio Present with the Commission were the following persons: Hannah Weber, Bureau of Comprehensive Planning; David Becraft Jr., Amy Barcroft, Bear O'Dwyer and Laura Matyas, Bureau ofl Development Review; Christopher Heyn, Department ofLand and Planning Management; Daphne Daly, Planning Commission Secretary; and, Denise Mathias, Clerk. CALLIOORPERPTICONE PLEDGE OF ALLEGIANCE ESTABLISHMENT OF QUORUM Madam Chair Kirkner called the meeting to order at approximately 9:00. AM. Ms. Mathias took attendance and noted that seven members were present, and a quorum was established. REVIEW AND APPROVAL OF AGENDA REVIEW AND APPROVAL OF MINUTES On motion ofMr. Lester, seconded by Mr. Kane and carried, the Agenda was approved. On motion ofMr. Kane, seconded by Mr. Smith and carried, the Minutes from April 16, 2024, were approved. COMMISSION MEMBER REPORTS A. COMMISSION CHAIR Chair Kirkner reported that three subdivisions were approved on April 16, 2024: Vice Chair, Michael Kane, approved 2103 Sykesville Rd Minor Subdivision (M-23-0042) since Chair Kirkner is a member ofthe Realtor. Association. Chair Kirkner approved Brico Welding Major property (S-21-0024), and Clayton Woods (M-22-0080). Plamning and Zoning Commission Official Minutes B. ADMINISTRATIVE MATTERS Secretary Daly reported the Board ofCounty Commissioners was having a budget hearing that was being live streamed SO the Planning & Zoning Commission meeting was being Some staffing updates were shared. Janice Bond has decided to move to another position and Denise Mathias will be the temporary Clerk until a replacement is hired. Price Wagoner, Comprehensive Planner, is also moving on but may attend future meetings representing CLSI. Ana Yemelyanova has been appointed Zoning Administrator. Also, the Department of Planning and Land Management will have several summer interns and they will be encouraged to sit in on some of the Planning and Zoning Commission An update on the Master Plan was shared. A consultant is helping conduct outreach events for the Housing Study including a survey. A tent will be set up at some upcoming events around the County, including the New Windsor Carnival and the Westminster Farmers Market on May 25th, at the Gamber Carnival and the Food' Truck Rally inl Mt. Airy on June 10th. Members were encouraged to stop by and take thel Housing Survey. This information also is on the Carroll County Government website; searching "Housing Study" will connect to the webpage for all the information including a list of events. BZACASES Randolph Mitchell reported two BZA cases for May. Case No. 6501 is requesting a variance for a reduction of the required 300' distance requirement from the principle dwelling to a proposed ADU on the property located at 7417 Old Washington Rd. in the Woodbine area. Case No. 6502 is requesting conditional use for a retirement village on the property located on 1701 Bennet Rd in the Sykesville area. Both cases are set to be heard on May 28, 2024. There were no other reports. D. OTHER 2 Planning and Zoning Commission Official Minutes May 21, 2024 EDUCATIONAL FACILITIES MASTER PLAN Mr. William Caine reviewed and answered questions for the Commission on the Education Facilities Master Plan. On motion of Mr. Kane, seconded by Mr. Lester and carried, the Commission approved the Education Facilities Master Plan and approved the certification letter TEXT AMENDMENT: DEVELOPER'S RIGHTS AND RESPONSIBILITIES AGREEMENTS The Board of County Commissioners are considering legislation that would allow for the County toe enter into al DRRA with a developer and have asked for the Planning and Zoning Commission's recommendations for the related amendments to the Carroll County Code ofOrdinances. Secretary Daly presented a PowerPoint introducing what a DRRA is and what other jurisdictions are doing currently. The Commission members asked to get additional information on extensions, enhanced benefits, history and who negotiates, at the work session scheduled for June 5,2024. TEXT AMENDMENT: FOOD PROCESSING RESIDUALS AND/OR DISSOLVED AIR The Board of County Commissions enacted a moratorium on the storage of] DAF residuals and have asked for the Planning and Zoning Commission's recommendations for amendments to the Hannah Weber presented al PowerPoint on DAF residuals and current State and County codes. Ms. Weber also went over options for storage, including the option to prohibit storage altogether and the option to make it a conditional use with specific distance requirements. The Commission members discussed current issues, types of storage structures, the Right to Farm Ordinance, the new food residuals permitting process from the State, how violations are handled, and best with regard to the plan, finding it consistent with the County Master Plan. Decision: The Commission, on motion ofMr. Robertson, seconded by Mr. Hoffand carried, voted to forward to the Board of County Commissioners a favorable recommendation for the Conditional Use option presented by staff, with additional language to specify storage be in an NRCS-approved storage facility and that a setback of 800 feet be used as distance requirements in Ch. 158.040 of the County Code.
