The City Council shall convene into executive session pursuant tot the Texas Government Code, $551.071 (Consultation with Attorney) to seek legal advice from the City Attorney and to deliberate and discuss pending or contemplated litigation relating to the Comfort Suites Ray Hubbard hotel and Prayosha Enterprises. (15 minutes) THIS ITEM WILL BE DISCUSSED AT THE END OF THE REGULAR SESSION. In Executive Session at 6:51 p.m. Out at 7:04 p.m. 2B. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney) and $551.087 (Economic Development) to seek legal advice from the City Attorney and to discuss commercial or financial information that the City has received from a business prospect that the Council seeks to have locate, stay, or expand in the City and with which the City is conducting economic development negotiations, regarding a new restaurant to be located at 3410 Main Street. (15 minutes) THIS ITEM WILL BE DISCUSSED AT THE END OF THE REGULAR SESSION. In Executive Session at 7:04 p.m. Out at 7:29 p.m. City of Rowlett 11188 2C. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.074 (Personnel) to hear and discuss a charge of violations of the City's Code of Ethics by Councimember Place 1.( (451 minutes) THIS ITEM WILLI BE DISCUSSED ATTHE END OF THE REGULAR SESSION. In Executive Session at 8:29 p.m. Out at 9:19 p.m. 3. WORK SESSION (5:15P.M.)* City Council may receive public input on the following items: 3A. Hear a presentation from Garver Engineering on a traffic study for two existing horizontal curves on Dalrock Road between Briarcrest Drive and Champion Drive. (45 minutes) Angie Smith, Deputy City Manager, and Quinn Span with Garver, provided the recommendations going forward and an update on what has been done thus far. Council discussion regarding timeline for implementation, steps for installation, how the drain pipe functions and the "crash" rating for the metal beam guard fence. It was the consensus of Council top proceed with the recommended updates. 3B. Discuss the long-term use of the City owned facility (formerly Fire Station #2) and surrounding property located at 5100 Dalrock Road. (45 minutes) Public comment received from Erik Ernst, Rowlett. Ms. Smith provided background on the building and reviewed the requests from the Rowlett Citizen Corps Council (RCCC). Mr. Ernst provided additional information. Discussion regarding the costs, funding issues and possible increased City funding to RCCC to cover the additional annual costs. Staff will confer with RCCC and iron out more details to bring back to Council at a future date. 3C. Hear a presentation from staff regarding the costs to remove and replace a fence and concrete parking at Kayak Instruction & Kayak Crossing Outpost located at 6917 Miller Road to allow for the installation of a storm pipe and relocation of utility power poles as part of the Miller Road Public comments received from: 1) Dave Holl, Rowlett; 2) Deb Shinder, Rowlett; 3) Brian Jeff Cohen, Interim Director of Engineering, provided a review of the project background and estimated costs for the work. Brian Funderburk, City Manager, provided additional information. Discussion regarding the process, future work and access and the inclusion of verbiage that this isa one-time process for the City and any future tear out and replacement is the responsibility of the property owner. Conduct a public hearing and take action on a request by the City of Rowlett to: 1) Rezone the subject property from Planned Development (PD) District for Limited Commercial (C-1) Uses to Single-Family Residential (SF-8) District; 2) Amend the Comprehensive Plan; and 3) Amend the Zoning Map of the City of Rowlett. The approximately 2.32-acre property is located approximately 140 feet west of the intersection of Navigation Drive and Miller Road, situated in the Charles D. Merrell Survey, Abstract Number 957, in the City of Rowlett, Dallas County, Alex Koenig, Planning Manager, presented the information for this item.
