Municipal Building - 4000 Main Present: Mayor Margolis, Mayor Pro Tem Winget, Deputy Mayor Pro Tem Shinder, Councilmember Galuardi, Councilmember Grubisich, Councilmember Britton and Councilmember Bell CALL TOORDER 1. Mayor Margolis called the meeting to order at 5:00 p.m. 2. EXECUTIVE SESSION (5:00 P.M.) 2A. The City Council shall convene into Executive Session pursuant to Texas Government Code, Sec. 551.071 (Consultation with City Attorney), to consult with and receive legal advice from the City Attorney regarding the Sapphire Bay Development Agreement. (45 minutes) THIS ITEM WILL BE DISCUSSED AFTER THE REGULAR SESSION. Inat6 6:48 p.m. Outat7:13 p.m. 2B. The City Council shall convene into Executive Session pursuant to Texas Government Code Section 551.071 (Legal Advice) to consult with and discuss with the City Attorney possible settlements of Spectrum Litigation. (15 minutes) Inat5 5:01 p.m. Out at 5:11 p.m. 3. WORK SESSION (5:15 P.M.) *Times listed are estimated. City Council may receive public input on the following items: 3A. Discuss security staffing plan proposal for City of Rowlett sponsored special events. (30 minutes) Police Chief Michael Denning outlined the proposed plan and policy. Discussion regarding allocation of funds based on departments requesting events and clarification of number of officers. Additional information regarding Fire Department involvement in coordination with the Office of Emergency Management and the Special Events Coordinator will be presented at a future date. It was the consensus of Council to proceed with the proposed plan. City of Rowlett 11362 3B. Discuss the scheduled issuance and sale of City of Rowlett, Texas Series 2023 General Obligation Bonds authorized in 2021, and Series 2023 Waterworks and Sewer System Revenue Wendy Badgett, Director of Finance, reviewed the amounts that will be issued. Discussion regarding possible reallocation of funds. For the purposes of this discussion, it was related that the overall total and not the project details are needed in order to move forward. It was the Bonds. (25 minutes) consensus of Council to proceed with the sale of bonds as outlined. 3C. Discuss an agreement with Dallas County for mutual aid emergency response into the unincorporated portions of Dallas County that are within and adjacent tot the City of Rowlett. (30 Fire Chief Neil Howard reviewed the area to be serviced and the details known at this time. Discussion regarding recouping true costs as opposed to a flat rate and/or a cap on reimbursement. Itwas the consensus of Council to consider this agreement. Chief Howard will review these details with Dallas County and bring a final proposal at a future date for formal minutes) action. 3D. Discuss a proposal approving a list of projects for Waterview Golf Club for an estimated amount of $23,950. (30 minutes) Angie Smith, Deputy City Manager/Golf Advisory Board (GAB) Liaison, reviewed some of the recent projects that have been completed; list of projects the GAB proposes - 1 bunker each at holes #5 and #6 and landscaping in front of the clubhouse. Discussion regarding an annual allocation to the Golf Fund to address ongoing and future project needs and consideration of Capital Improvement Program for big project needs. It was the consensus of Council to proceed with the two projects. 4. DISCUSS CONSENT AGENDAITEMS pulled for Individual Consideration. City of Rowlett 11363 Mayor Pro Tem Winget presented the proclamation to Laura Tschoerner, Director of Library Services/AHC Liaison and Arts & Humanities Commission members Deborah Crosby and Steven Maldonado. 5B. Presentation ofay prochamatonrecognzing the month of March 2023 as Women's History Month and request to light the water tower inj purple, green and white. Deputy Mayor Pro Tem Shinder presented the proclamation to Tara Bradley, Neighborhood Planning SupervsOT/RDEIC Liaison, and Rowlett Diversity, Equity and Inclusion Commission members Dianal Moore, Susan Urrutia and Franchesker Scott. 5C. Presentation of the Annual comprenensive Financial Report for the fiscal year ended September 30, 2022, which includes the independent auditor's report. Ms. Badgett thanked the Finance Department staff for their hard work throughout the year with City staff and especially during the year end audit. She then introduced Claire Wootton, with Weaver, who presented the report. 5D. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. Consider action to approve a resolution exercising the first oft four one-year renewal options for Parks and Recreation Section II mowing services with DD Commercial Landscape in the unit amounts bid in an estimated annual amount of $172,876.58. This item was approved on the Consent Agenda as RES-022-23. 7E. Consider action to create an advisory board. Consider action to approve a resolution creating the Lakeshore Advisory Board. This item was withdrawn from the agenda and will be presented at at future date. City of Rowlett 11366 7F. Consider action to approve a purchase order for a cellular voice and data services provider. Consider action to approve a resolution approving a purchase order that might exceed $50,000 to a cellular voice and data service provider for multiple City departments. This item was approved on the Consent Agenda as RES-024-23. 7G. Consider action to award a contract for window replacement. Consider action to approve a resolution accepting the bid and awarding a contract to Native Construction in the amount of $119,825.25 for the replacement of 32 windows on the south side oft the City Hall building. This item was approved on the Consent Agenda as RES-025-23. 7H. Consider action awarding a contract for utility relocations around the Dalrock Road and State Highway 66 intersection. Consider action to approve a resolution accepting the bid and awarding a contract to A&M Construction and Utilities, Inc. in the amount of $1,071,225.50, with a ten percent (10%) contingency amount of $107,122.55, and up to $20,0001 for an early completion bonus, resulting ina a total project budget of $1,198,348.05 for utility relocations around the Dalrock Road and State Highway 66 (SH66) intersection, and authorizing the Mayor to execute the necessary documents for said services. This item was. approved on the Consent. Agenda as RES-026-23. 71. Consider action authorizing a license agreement with Dallas Area Rapid Transit. Consider action to approve a resolution authorizing the Mayor to execute a License Agreement with Dallas Area Rapid Transit (DART) for the construction, installation, operation, and maintenance of one 8-inch PVC wastewater main encased within a 15-inch steel casing pipe across and under the DART railroad tracks and right-of-way near Edgewater Drive. Consider action to approve a resolution authorizing the Mayor to execute a Facilities Agreement between the City of Rowlett, Texas, and Chick-fil-A, Inc., in the amount of $13,260 to construct an oversize wastewater main on Lakeview Parkway/SH66. City of Rowlett 11367 Jeff Cohen, Interim Director of Engineering, presented the information for this item. AI motion was made by Mayor Pro Tem Winget, seconded by Councilmember Grubisich, to approve the item as presented. The motion carried with a unanimous vote of those MEMBERS OF THE CITY COUNCIL MAY REQUEST TOPICS TO BE PLACED ON AN AGENDA FOR A SUBSEQUENT MEETING. TAKE ANY NECESSARY OR APPROPRIATE ACTION ON CLOSEDIEXECUTIVE SESSION Upon conclusion of Item 2B, a motion was made by Councimember Galuardi, seconded by Deputy Mayor Pro Tem Shinder, to approve the proposed settlement in the McAlen-Spectrum litigation on the terms discussed in Executive Session, subject to approval by the City Attorney, and authorizing the City Manager to execute any appropriate documents to accomplish the settlement.
