CALL TO ORDER Mayor Margolis called the meeting to order at 5:30 p.m. 2. EXECUTIVE SESSION (THIS WILL BE DISCUSSED AFTER THE REGULAR SESSION.) 2A. The City Council shall convene into Executive Session pursuant to Texas Government Code Section 551.071 (Consultation with City Attorney) to deliberate on the filing of litigation against HMI Utilities and Frontier Communications for damages caused to traffic control signals. The City Council shall convene into Executive Session pursuant to Texas Government Code Section 551.074 (Personnel) to deliberate on the appointment, employment, evaluation, and duties of the City Manager and Section 551.071 (Consultation with Attorney) to discuss and receive legal advice from the City Attorney on the City Manager Employment Agreement. The City Councit shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney), to seek legal advice from the City Attorney regarding the Amended Economic Development Program Agreement with Yoco, LLC, and a proposed amendment thereto. Annual presentation from the Board of Adjustment. (30 minutes) City of Rowlett 11391 Munal Mauladad, Managing Director of Community Development and Engineering and Ken Romaine, Chair, reviewed the members, roles and responsibilities of the Board, and the cases that had been presented to them during the past year. 3B. Present an update for 2023 Fireworks on Main event. (15 minutes) Aaron Cleaver, Director of Parks and Recreation, and Pamela Vierus, Special Events Coordinator, reviewed details for this year's event = entertainment, activities, fireworks and parking information. 3C. Discuss proposed amendments to Chapter 6, Articles I-VIII oft the Code of Ordinances regarding Animal Regulations. (30 minutes) Ms. Mauladad and Asher Moore, Animal Services Manager, reviewed the background which prompted the review of the code and proposed revisions. Discussion regarding clarification of number of animals, educational entities, small and large livestock and registration tag requirements. Staff will make appropriate revisions and present to Council at a future meeting fort formal consideration. 3D. Discuss ordinance amendments to provide a vesting clause for accessory structures constructed prior to building permitting requirements. (20 minutes) Public comments: Bryan Abrams, Rowlett; Danny Haney, Rowlett; Mark Tascher, Rowlett Ms. Mauladad and Dale Jackson, Building Official, reviewed the background of the codes building code requirements VS. zoning code requirements, permit requirements for accessory structures, and the opportunity to request a variance. After further Council discussion, ity was the consensus of Council there were no needed changes. 3E. Discuss the establishment of the Development Review Ad-Hoc Committee (DRC). (20 Minutes) Mayor Margolis presented the proposal outlining a preliminary meeting had been conducted as at trial run. Council discussion regarding vetting process and how to move forward. It was the consensus of Council that there would not be an official standing committee, staffwould present meeting requests to the Mayor and then Counciimembers would be involved on an alternating basis using Place number as a reference. Consider action to approve a resolution accepting the bid of, awarding a contract to, and issuing a purchase order to Native Construction to provide mudjacking services in the amount of $76,647.19 utilizing BuyBoard Contract #638-21 pricing for the foundation repair and stabilization of the Police Evidence building. Consider action to approve a resolution authorizing a lease agreement with Flock Group Inc., fort ten (10) additional Flock Safety Automatic License Plate Recognition (ALPR) cameras, in the amount of $31,700, with a total FY2023 expenditure of $60,200 for twenty (20) cameras and authorizing the City Manager to execute the necessary documents. Consider action to approve a resolution accepting a bid from and awarding a contract to Road Master Striping, LLC for pavement striping at seventeen (17) locations in the total amount of $701,996.37 through an Interlocal Cooperative Purchasing Agreement with the City of Allen and authorizing the Mayor to execute the necessary documents for said services. Conduct a public hearing and take action to approve an ordinance approving a Development Plan with Major Warrants to allow the development, construction and use ofa a self-storage facility and imposing certain related development conditions on property zoned Form-Based Urban Village (FB-UV)District, situated northwest of the intersection of Sunset Boulevard and Dalrock Road, being Lot1A, Block C of the Bayside East Addition, in the City of Rowlett, Dallas County, Alex Koenig, Planning and Urban Design Manager, presented the information for this item. The public hearing opened and Ar motion was made by Councilmember Grubisich, seconded by Councilmember Britton, to DENY the item as presented. Appendix 1.1 to allow for self-storage use, with the stipulation that there is a minimum of 4,000 square feet of retail space, excluding the patio area, 7,900 2. Articles 2.4.6 and 2.8.6 to waive the tree streetscape requirements on Sunset Boulevard to allow for an 8-foot sidewalk, 6-feet from back of curb, to allow for 3. Article 2.8.6.a to waive the tree requirement inj parking islands at the ground level 4. Article 3.1.3 to allow a 1:8000 parking ratio for self-storage uses; and 5. Article 2.8.6 and Appendix 3.2 to allow for Spandrel glass on floors 21 through six, conditioned on the retrofit of glass compliant with Form-Based Code standards if Bell, to approve the request and grant major warrants to: square feet of retail space; and trees and lighting to be installed in the parkway; and where there is structure parking below; and the uses on any of those floors changes. Councilmember Galuardi requested clarification on the motion. After clarification, Ms. Shinder made a friendly amendment to her motion that Appendix 1.1 include the requirement that the patio area be a minimum of 500 square feet. Ms. Bell accepted the amendment.
